Whetstone, Leicestershire, Enclosure Bill.

With a Bill, intituled, "An Act for dividing and enclosing the Open and Common Fields, Common Pastures, Common Meadows, and other Commonable Lands and Grounds, in Whetstone, in the County of Leicester;" to which they desire the Concurrence of this House.

Ledbury and other Roads, Bill.

With a Bill, intituled, "An Act for continuing the Terms of, and amending, the Acts for repairing several Roads leading from Ledbury in the County of Hereford; and for widening and amending the Road through the Parish of Bromesberrow in the County of Gloucester, and through Corse Lawn, till it meets the Road from Gloucester to Worcester;" to which they desire the Concurrence of this House.

Carter to take the Name of Pollard, Bill.

With a Bill, intituled, "An Act to enable John Pollard Esquire (lately called John Carter) and his Heirs Male to take and use the Surname and Arms of Pollard, pursuant to the Will of Elizabeth Pollard deceased;" to which they desire the Concurrence of this House.

To return the Bill, intituled, "An Act for empowering the Committee or Committees, for the Time being, of the Estate of John Newport Esquire, a Lunatick, to make Leases of his Estates during his Lunacy;" and to acquaint this House, that they have agreed to the same, without any Amendment.

Alric's Nat. Bill.

With a Bill, intituled, "An Act for naturalizing James Alric;" to which they desire the Concurrence of this House.

Exempting Batchacre Grange from Payment of Ecclesiastical Dues, Bill.

The Earl of Sandwich acquainted the House, "That His Majesty, having been informed of the Purport of the Bill, intituled, "An Act for exempting Batchacre Grange, in the Counties of Stafford and Salop, or One of them, from Payment of Tithes and other Ecclesiastical Dues; and for settling other Tithes in Lieu thereof," was pleased to consent (as far as His Majesty's Interest is concerned) that their Lordships may proceed therein as they shall think fit."

Rochfort against E. Clanrickard & al. Pet. to put off the Hearing:

A Petition of George Rochfort Esquire and Alice his Wife, Appellants in a Cause depending in this House, wherein Smith Earl of Clanrickard in the Kingdom of Ireland and others are Respondents, which stands for Hearing on Wednesday next, was presented, and read; setting forth, "That the Petitioners are deprived of the Assistance of both their Counsel, who are instructed in the Cause; the one being incapable of attending at present, and the other being gone the Circuit, and will not return till Saturday the 24th Instant;" and therefore praying, "That their Lordships will be pleased to adjourn the Hearing of the said Cause to Monday the 26th Instant, or to such later Day as to their Lordships shall seem meet."

And thereupon the Agents on both Sides were called in; and heard at the Bar.

And being withdrawn:

Rejected.

Ordered, That the said Petition be rejected.

Walker & al. against Magistrates of Edinburgh & al.

After hearing Counsel in Part, in the Cause wherein John Walker, One of the old Baillies of the City of Edinburgh and others are Appellants, and George Drummond Esquire Lord Provost and the other Magistrates and Town Council of Edinburgh are Respondents:

L. Spencer's Bill:

Burton to Derby, Road Bill:

Dunbar, Duty on Beer, Bill.

The Lord Cathcart reported from the Lords Committees to whom the Bill, intituled, "An Act to continue an Act passed in the Tenth Year of the Reign of His late Majesty King George the Second, for continuing an Act passed in the Fifth Year of the Reign of His late Majesty King George the First, intituled, An Act for laying a Duty of Two Pennies Scots, or One Sixth Part of a Penny Sterling, upon every Pint of Ale or Beer that shall be vended or sold within the Town of Dunbar, for improving and preserving the Harbour, and repairing the Town-house, and building a School, and other Publick Buildings there; and for supplying the said Town with fresh Water," was committed: "That they had considered the said Bill, and examined the Allegations thereof, which were found to be true; and that the Committee had gone through the Bill, and directed him to report the same to the House, without any Amendment."

Horsham Road, Bill.

The Lord Sandys made the like Report from the Lords Committees to whom the Bill, intituled, "An Act for repairing and widening the Roads from Horsham in the County of Sussex, through the Parishes of Shipley, West Grinsted, Ashurst, Steyning, Bramber, and Breeding, in the said County," was committed.

Romsey, &c. Road Bill.

The Lord Boston made the like Report from the Lords Committees to whom the Bill, intituled, "An Act for repairing and widening the Roads from the End of Stanbridge Lane, near a Barn in the Parish of Romsey to the Turnpike Road at Middle Wallop, and from the Turnpike Road between Stanbridge Lane aforesaid and Great Bridge, to the Turnpike Road at Stockbridge, and from the Garden of Henry Hattat at Awbridge to the Garden Wall of Denys Rolle Esquire at East Tuderley, and from Lockerley Mill Stream to East Dean Gate, and from the said Garden Wall to the Turnpike Road leading from Stockbridge aforesaid, in the County of Southampton, to Salisbury," was committed.

Buxton to Derby, Road Bill.

The Lord Willoughby of Parham made the like Report from the Lords Committees to whom the Bill, intituled, An Act to amend and render more effectual several Acts of Parliament for repairing the Roads from Sherbrooke Hill, near Buxton and Chappel in the Frith in the County of Derby, through the Town of Stockport in the County of Chester, to Manchester in the County of Lancaster, and other Roads in the said Acts mentioned; and for turning and diverting the Roads from Whaley Bridge to Chappel in the Frith and to Sparrow Pit Gate, and from Whaley Bridge to the Western End of Longside Common in the County of Chester," was committed.

Horbling, Enclosure Bill.

The Earl of Westmorland reported from the Lords Committees to whom the Bill, intituled, "An Act for dividing and enclosing the Open and Common Fields, Meadows, and Common Fen, in the Parish of Horbling, in the County of Lincoln; and for draining and improving the said Fen," was committed: "That they had considered the said Bill, and examined the Allegations thereof, which were found to be true; that the Parties concerned had given their Consents, to the Satisfaction of the Committee; and that the Committee had gone through the Bill, and directed him to report the same to the House, without any Amendment."

Cox against Tolet, Writ of Error:

Upon reading the Petition of John Tolet, Defendant in a Writ of Error brought into this House, wherein John Cox is Plaintiff; praying, "In regard the Plaintiff hath not assigned Errors within the Time limited by the Standing Order, that the said Writ of Error may be Non pros'd, with such Costs as to their Lordships shall seem meet:"

After hearing Counsel, as well Yesterday as this Day, upon the Petition and Appeal of George Rochfort of Rochfort Esquire in the Kingdom of Ireland and Alice his Wife, Daughter and Residuary Devisee of Sir Gustavus Hume Baronet, deceased; complaining of a Decree of Dismission of the Court of Chancery in the said Kingdom, of the 19th of July 1762; and praying, "That this House would be pleased to make such Order for the Appellants Relief in the Premises, as the Nature and Circumstances of the Case might require:" As also upon the Answer of the Right Honourable Smith Earl of Clanrickard in the Kingdom of Ireland put in to the said Appeal; and due Consideration had of what was offered on either Side in this Cause:

Judgement affirmed.

Weller's Divorce, Bill.

The Order of the Day being read, for the Second Reading of the Bill, intituled, "An Act to dissolve the Marriage of John Weller Esquire with Charlotte Wilson his now Wife; and to enable him to marry again; and for other Purposes therein mentioned;" and for hearing Counsel for and against the same:

Then Ann Myers was called, in order to prove the Adultery; who, being sworn, gave an Account, "That she lived as a Servant with Mrs. Weller, who lodged at Mr. Saul's, a Surgeon, in Bow Street; that Mr. Weller was then in Jamaica; that she knew Mr. Scnell; that he often visited Mrs. Weller; and that, upon Mrs. Saul's reprehending Mrs. Weller for her Intimacy with him, she pretended she was going over to Jamaica to Mr. Weller, and accordingly made Preparations for going, and in a few Days afterwards took Leave of Mrs. Saul; that she (the Witness) went with Mrs. Weller in a Hackney Coach to Westminster Bridge, in order to meet the Dover Stage Coach; that they were met at Westminster Bridge by Mr. Senell, with whom (instead of proceeding on their Journey) they went to the House of Mrs. (fn. 2) Wordie, in Hemming's Row, Saint Martin's Lane, where Mr. Senell had taken a Lodging; that they lived together there for some Time in a very retired Manner; that she continued to live there with Mrs. Weller as her Servant, and was directed by her not to take any Notice who she was; that she has seen Mr. Senell and Mrs. Weller in Bed together several Times; that they afterwards went to Germany, and she (the Witness) went with them; and that, during the Time (which was about Nine Months) she was with them there, they cohabited together as Man and Wife."

She is directed to withdraw.

And Elizabeth (fn. 2) Wrodie was called in, and sworn, and gave an Account, "That she lives in Hemming's Row, Saint Martin's Lane; that Mr. Senell and a Lady (whom she afterwards discovered to be Mrs. Weller) and her Maid came and lodged in her House; that they had Two Rooms, with a Bed in each; that they lived in a very retired Manner, Mrs. Weller never going out all the Time she was there; that she and her Husband (since deceased) lay in the Parlour under the Dining Room, in which Room Mrs. Weller lay, and have heard Mr. Senell and Mrs. Weller in Bed together, and talking in Bed; that they left her Lodgings, and went away at Two o'Clock in the Morning; and that she and her Husband went up into their Room after they were gone, and, from what she observed, is consident, that Mrs. Weller and Mr. Senell had that Night lain together."

She was directed to withdraw.

Then William Skelton, Register of the Consistory Court of the Bishop of London, was called in; and, being sworn, produced the Original Definitive Sentence of Divorce of the said Court against the said Mrs. Weller, for Adultery.

And the same was read.

And then he withdrew.

Then Mr. Patience Thomas Adams was called, in order to prove, "That Mr. Weller was proceeding to outlaw the said Joseph Senell, for Criminal Conversation with the said Mrs. Weller;" who, being sworn, produced at the Bar, the Original Writ, Weller against Senell, for Criminal Conversation.

Gretton, as also of Charles Say, in relation to a Complaint made on Friday last, of a Paragraph highly reflecting upon the Earl of Hertford, in a printed News Paper, intituled, "The London Evening Post, from Tuesday, March 13th, to Thursday, March 15th;" and also in a printed News Paper, intituled, "The Gazetteer and London Daily Advertiser, March 16th, 1764," being read:

The House was informed, "That the said Persons were attending."

And thereupon John Gretton was called in.

And the said Paper, intituled, "The London Evening Post," as also the Paragraph complained of, were shewn to him; and he was asked, "if he is not the Printer and Seller of that Paper?"

Says, "He is not the Printer, but only sells them at his Shop for Mr. Meres; which he began to do about a Twelvemouth ago."

Then it was moved, "That the said John Gretton might be sworn."

Accordingly he was sworn; and, being again examined, gave the same Account as before.

He is directed to withdraw.

And John Meres was called in; and, the same Paper being shewn to him, says, "he is the Printer thereof."

He is asked, "How he came to insert the said Paragraph therein?" says, "It was through Inadvertency and Hurry of Business, not having Time to consider it before he printed it; that he did not know who sent it, the same having been flung over the Hatchdoor of his House; and produces the written Paragraph so flung over, but declares he doth not know whose Hand-writing it is; and that he did not insert it out of any Disrespect to the Earl of Hertford."

He is directed to withdraw.

And George Woodfall is called in, and sworn; and the Paper, intituled, "The Gazetteer and London Daily Advertiser," is shewn to him; and he is asked, "If he knows who prints that Paper."

Says, "He believes Mr. Charles Say is the Printer thereof."

He is directed to withdraw.

And Charles Say is called in; and the said Paper being shewn to him, as also the Paragraph complained of, he is asked, "If he is the Printer of that Paper, and how he came to insert such a Paragraph therein?"

Says, "He is the Printer of that Paper; and that he copied the Paragraph out of The London Evening Post of Thursday last."

He is directed to withdraw.

Resolved, by the Lords Spiritual and Temporal in Parliament assembled, That the Paragraphs in The London Evening Post from Tuesday, March 13, to Thursday, March 16, 1764, and in The Gazetteer and Londor, Daily Advertiser of Friday the 16th Instant, relating to the Earl of Hertford, His Majesty's Ambassador at the Court of France, are false, malicious, and scandalous, a gross and wanton Breach of the Privilege of this House, and tending to the Dishonour of the Nation.

Then it was moved, "That the said John Meres, Printer of the said London Evening Post, do, for his said Offence, pay a Fine to His Majesty of One Hundred Pounds; and that he be taken into the Custody of the Gentleman Usher of the Black Rod and conveyed to Newgate, there to be kept in safe Custody until he pay the said Fine."
