Macclesfield to Buxton, Road Bill.

The Lord Sandys reported from the Lords Committees to whom the Bill, intituled, "An Act for repairing and widening the Road from the Cross at Broken Cross in Macclesfield in the County of Chester, through Macclesfield Forest, to the present Turnpike Road at the South End of the Township of Buxton in the County of Derby," was committed: "That they had considered the said Bill, and examined the Allegations thereof, which were found to be true; and that the Committee had gone through the Bill, and directed him to report the same to the House, without any Amendment."

Chesterfield to Grindleford Bridge, Road Bill.

The Lord Sandys also reported from the Lords Committees to whom the Bill, intituled, "An Act for repairing and widening the Road from Chesterfield to the Turnpike Road at Hernstone Lane Head, and also the Road branching from the said Road upon The East Moore, through Baslow and Wardlow, to the Joining of the said Roads again near Wardlow Mires, and also the Road leading between the said Road and Branch from Calver Bridge to Baslow Bridge, and also the Road from the Turnpike Road near Grindleford Bridge in the County of Derby," was committed: "That they had considered the said Bill, and examined the Allegations thereof, which were found to be true; and that the Committee had gone through the Bill, and directed him to report the same to the House, without any Amendment."

Irish Tallow, Duties on to discontinue, Bill.

Account of Candles exported from Bristol, &c.

Ordered, That the proper Officer do lay before this House, an Account of the Quantity of Candles exported from the Ports of Bristol, Lancaster, Liverpool, and Whitehaven, from Christmas 1757, to Christmas 1758; distinguishing each Port.

Pierie to enter into a Recognizance on Wemyss's Appeal.

The House being moved, "That William Pierie of The Middle Temple may be permitted to enter into a Recognizance for James Wemyss Esquire and others, on account of their Appeal depending in this House; they living in Scotland:"

Marine Forces, Regulation, Bill.

The House (according to Order) was adjourned during Pleasure, and put into a Committee on the Bill, intituled, "An Act for the Regulation of His Majesty's Marine Forces while on Shore."

After some Time, the House was resumed.

Bishop's Waltham Enclosure, Bill.

A Message was brought from the House of Commons, by Mr. Thistlethwayte and others:

With a Bill, intituled, "An Act for dividing and enclosing certain Open Arable Fields and a Down, in the Manor of Bishop's Waltham, in the County of Southampton;" to which they desire the Concurrence of this House.

The said Bill was read the First Time.

D. of Gordon & al. against Gordon & al.

After hearing Counsel, upon the Petition and Appeal of Alexander Duke of Gordon and his Curators or Guardians, and of Katherine Dutchess of Gordon and Staats Long Morrice Esquire her Husband; complaining of an Interlocutor of the Lord Ordinary in Scotland, of the 20th of January 1758; and of an Interlocutor of the Lords of Session, of the 8th of February following, adhering thereto; and praying, "That the same might be reversed or varied; and that the Appellant might have such other Relief as to this House in their Lordships great Wisdom and Justice should seem meet:" As also upon the Answer of John Gordon of Auchanachy put in to the said Appeal; and due Consideration had of what was offered on either Side in this Cause:

The Lord Willoughby of Parham reported from the Lords Committees to whom the Bill, intituled, "An Act for raising Money, out of the Personal Estate of the late Dutchess of Buckinghamshire and Normanby, deceased, to renew a Lease of certain Manors and Estates in the County of York, in the Manner, and for the Purposes, therein mentioned," was committed: That they had considered the said Bill, and examined the Allegations thereof, which were found to be true; that the Parties concerned had given their Consents, to the Satisfaction of the Committee; and that the Committee had gone through the Bill, and made several Amendments thereto."

Which Amendments, being read Twice by the Clerk, were agreed to by the House.

Little Barrington Enclosure, Bill.

D. of Kingston's Bill: Motion for shortening the Time of the Meeting of the Committee.

The House being moved, "That the Standing Order of this House, requiring Fourteen Days Notice to be given of the Meeting of Committees upon Private Bills, might be so far dispensed with as that the Committee to whom the Bill, intituled, "An Act for vesting divers Manors, Lands, and Hereditaments, in the Counties of Bucks, Northampton, Salop, and Stafford, devised by the Will of Evelyn late Duke of Kingston, in Fee Simple; and for settling other Manors, Lands, and Hereditaments, in the County of Nottingham, of greater Value, in Lieu thereof, to the like Uses," stands committed, "may meet on an earlier Day than is appointed, in regard the Session is far advanced:"

Ordered, That the said Motion be taken into Consideration on Monday next; and the Lords summoned.

Account of Candles exported from Bristol, &c. delivered.

The House being informed, "That Mr. Tomkyns, from the Commissioners of the Customs attended:"

He was called in; and delivered, at the Bar, pursuant to their Lordships Order on Wednesday last,

"An Account of the Quantity of Candles exported from the Ports of Bristol, Lancaster, Liverpoole, and Whitehaven, from Christmas 1757 to Christmas 1758; distinguishing each Port."

And then he was directed to withdraw.

And the Title thereof being read by the Clerk:

Ordered, That the said Account do lie on the Table.

E. of Blesinton against Monsel & al. et è contra:

This Day being appointed for hearing Counsel, upon the Petition and Appeal of William Earl of Blesinton in the Kingdom of Ireland; complaining of a Decree of the Court of Exchequer in the said Kingdom, of the 12th of February 1757; and praying, "That the same might be reversed and set aside; and such other Relief given the Appellant as to this House should seem meet:" As likewise upon the Cross Appeal of William Monsell Esquire and George Tuthill Gentleman, complaining of Part of the same Decree; and praying, "That the same might be reversed, varied, or rectisied; and that the Appellants might have such Relief as the Nature of their Case required:" As also upon the Answer of the said William Monsell and George Tuthill, and the Answer of John Williams Esquire, surviving Executor of Charles late Lord Viscount Blesinton, put in to the said Original Appeal, and the Answer of the said William Earl of Blesinton and the said John Williams put in to the said Cross Appeal:

Counsel were accordingly called in.

And only One Counsel of a Side appearing:

The Counsel for the Appellant in the Original Appeal acquainted the House, "That the Parties were come to an Agreement, and consented that the Decree complained of in the said Appeals should be affirmed in toto."

And the Counsel for the said Respondents William Monsell and George Tuthill (no Counsel appearing for the said John Williams the other Respondent) likewise acquainting the House, "That the same was consented to on the "Part of the said Respondents:"

The Counsel were directed to withdraw.

Decree affirmed, by Consent.

Ordered and Adjudged, by the Lords Spiritual and Temporal in Parliament assembled (by Consent of the Counsel on both Sides, signified at the Bar) That the said Appeals be, and are hereby, dismissed this House; and that the said Decree therein complained of be, and the same is hereby, affirmed.

Irish Cattle, Bill.

The Order of the Day being read, for the House to be in a Committee on the Bill, intituled, "An Act to permit the free Importation of Cattle from Ireland, for a limited Time:"

The House was moved, "That the 13th, 14th, and 15th, Sections of an Act of the 15th Year of King Charles the Second, for the Encouragement of Trade, Cap. 7, might be read."

The same were read accordingly.

The 1st Section of an Act of the 18th Year of King Charles the Second, against importing Cattle from Ireland, Cap. 2. was also read.

Then it was moved, "That the following Question be put to the Judges; (videlicet,)
