Hodie 3^a vice lecta est Billa, intituled, "An Act to render more effectual the several Laws now in being, for the Amendment and Preservation of the publick Highways and Turnpike Roads of this Kingdom."

The Question was put, "Whether this Bill shall pass?"

It was Resolved in the Affirmative.

Message to H. C. that the Lords have agreed to it.

A Message was sent to the House of Commons, by Mr. Holford and Mr. Harris:

To acquaint them, that the Lords have agreed to the said Bill, without any Amendment.

Buchanan and Hamilton's Composition, Bill.

Hodie 2^a vice lecta est Billa, intituled, "An Act for empowering the Receiver General of His Majesty's Customs to release and discharge the Estate and Effects of George Buchanan and William Hamilton from a Debt due to His Majesty, upon Payment, by the Assignees under the Commission of Bankruptcy against them, of a Sum of Money therein mentioned."

Ordered, That the said Bill be committed to a Committee of the whole House.

Ordered, That the House be put into a Committee upon the said Bill, To-morrow.

Hodie 2^a vice lecta est Billa, intituled, "An Act for allowing a further Bounty on Vessels employed in the White Herring Fishery; for giving Liberty to alter the present Form and Size of the Nets used in the said Fishery; and for other Purposes therein mentioned."

Ordered, That the said Bill be committed to a Committee of the whole House.

Ordered, That the House be put into a Committee, upon the said Bill, To-morrow.

To widen the Avenue to Spring Carden, Bill.

A Message was brought from the House of Commons, by Mr. Cooke and others:

With a Bill, intituled, "An Act to enable the Commissioners for building Westm'r Bridge to widen the Street, or Avenue, leading from Cockspur Street to the Passage in Spring Garden, near Saint James's Park;" to which they desire the Concurrence of this House.

The said Bill was read the First Time.

To prevent Cheats, &c. Bill.

A Message was brought from the House of Commons, by Mr. George Onslow and others:

To return the Bill, intituled, "An Act for the more effectual Punishment of Persons who shall attain, or attempt to attain, Possession of Goods or Money by false or untrue Pretences; for preventing the unlawful Pawning of Goods; for the easy Redemption of Goods pawned; and for preventing Gaming in Publick Houses by Journeymen, Labourers, Servants, and Apprentices;" and to acquaint this House, that they have agreed to their Lordships Amendments made thereto.

Indemnisying Smugglers, on certain Conditions, Bill.

The House (according to Order) was adjourned during Pleasure, and put into a Committee on the Bill, intituled, "An Act to indemnify Persons who have been guilty of the unlawful importing, landing, or running, of prohibited, uncustomed, or other Goods or Merchandize, upon certain Terms therein mentioned."

After some Time, the House was resumed.

And the Earl of Warwick reported from the Committee, "That they had gone through the Bill, and directed him to report the same to the House, without any Amendment."

With a Bill, intituled, "An Act for granting to His Majesty certain Sums of Money out of the Sinking Fund; and applying certain Monies remaining in the Exchequer, and the Savings out of the Monies granted in this Session of Parliament for the Pay of the Troops of Hannover, for the Service of the Year One Thousand Seven Hundred and Fifty-seven; and for futher appropriating the Supplies granted in this Session of Parliament; and for Relief of Claud Johnson, with respect to a Bond entered into by him, for securing the Duties on Tobacco imported by George Buchanan and William Hamilton;" to which they desire the Concurrence of this House.

A Message was brought from the House of Commons, by Mr. Fellowes and others:

With a Bill, intituled, "An Act for enlarging the Times for the First Meetings of Commissioners or Trustees for putting in Execution certain Acts of this Session of Parliament;" to which they desire the Concurrence of this House.

The said Two Bills were read the First Time.

Order touching Privilege, in Cases of Habeas Corpus, Motion to make it a Standing Order.

The House being moved, "That the Order and Declaration of this House, of the 7th of February last, "That no Peer, or Lord of Parliament, hath Privilege against being compelled, by Process of the Courts in Westminster Hall, to pay Obedience to a Writ of Habeas Corpus directed to him," may be made a Standing Order, and entered upon the Roll of Standing Orders:"

Ordered, That the said Motion be taken into Consideration To-morrow; and the Lords to be summoned.

The King against Ponsonby, Writ of Error.

The House being moved, "That a Day may be appointed, for hearing the Errors argued in the Writ of Error, wherein the King is Plaintiff, and John Ponsonby and others are Defendants:"

It is Ordered, That this House will hear the said Errors argued, by Counsel, at the Bar, on the First vacant Day for Causes, in the next Session of Parliament, after the Causes which stand already appointed.

Militia Bill, Conference on it, and Amendments agreed to.

A Message was brought from the House of Commons, by the Lord George Sackville and others:

To desire a Conference with this House, upon the Subject-matter of the last Conference.

To which the House agreed.

And the Messengers were called in again, and told, That the Lords agree to a Conference, as is desired; and appoint the same presently, in the Painted Chamber."

Ordered, That the Managers of the former Conference be the Managers of this Conference.

The House being informed, "That the Managers for the Commons were ready for the Conference, in the Painted Chamber:"

The Names of the Managers for this House were called over.

And the Lords went to the Conference.

Which being ended, the House was resumed.

And the Duke of Bedford reported, "That they had met the Managers for the Commons, at the Conference, which was managed on their Part by Mr. George Townshend; who delivered to them the Bill, with the Amendments; and also a Paper, containing as follows; videlicet,

"The Commons agree to the Amendment made by your Lordships to the Bill, intituled, "An Act for the better Ordering of the Militia Forces, in the several Counties of that Part of Great Britain called England," Press 8, Line 13; which is, to leave out ["Four"], and insert ["Two"], with the following Amendments; (videlicet,) "Before the Word ["Two"], to insert ["according to the Proportion of One Serjeant to Twenty Private Men"]; and after the Word ["Two"] to add ["or more"].

"The Commons do not insist on their Disagreement to the Amendment made by your Lordships, Press 14, Line 21; or to any of the Twelve following Amendments, on which your Lordships have insisted.

"The Commons agree to the Amendment made by your Lordships, Press 21, Line 14, being Clause (C), with the following Amendments, videlicet, "Line 2, To leave out ["Three Years"]; and after ["Militia"] to insert ["when called out and assembled, in case of actual Invasion, or upon imminent Danger thereof, or in case of Rebellion"]; and, Line 11, after ["Regulations"], to insert ["and with the like Exception in respect to the Two Universities of that Part of Great Britain called England"].

"The Commons do not insist upon their Disagreement to any of the subsequent Amendments, on which your Lordships have insisted."

Which Report being read by the Clerk:

The said Amendments, made by the Commons to the said Two Amendments made by their Lordships to the said Bill, were read Three Times, and agreed to.

And a Message was sent to the House of Commons, by Mr. Holford and Mr. Harris, to acquaint them therewith.

Indemnifying Smugglers, on certain Conditions, Bill:

No Privilege against a Habeas Corpus, a Standing Order.

The Order of the Day was read, for taking into Consideration the Motion made Yesterday, for making the Order of this House, of the 7th of February last, in relation to Privilege in Cases of Writs of Habeas Corpus, a Standing Order.

And Consideration being had thereof accordingly:

It was agreed, after the Word ["Privilege"], in the said Order, to insert ["of Peerage, or of Parliament"].

And then the said Order, as amended, was read, as follows:

"Ordered and Declared, by the Lords Spiritual and Temporal in Parliament assembled, That no Peer, or Lord of Parliament, hath Privilege of Peerage, or of Parliament, against being compelled, by Process of the Courts in Westminster Hall, to pay Obedience to a Writ of Habeas Corpus directed to him."
