The Lords following took the Oaths, and made and subscribed the Declaration, and also took and subscribed the Oath of Abjuration, pursuant to the Statutes, (videlicet,)

Thanks to the Bp of Carlisle for his Sermon.

Ordered, That the Thanks of this House be, and are hereby, given to the Lord Bishop of Carlisle, for the Sermon by him preached before this House, on Saturday last, in the Abbey Church, Westminster, and he is hereby desired to cause the same to be printed and published.

Vexatious Arrests, to prevent, Bill.

Hodie 1^a vice lecta est Billa, intituled, "An Act to revive Two Acts of Parliament, One, made in the Twelfth Year of the Reign of His late Majesty King George the First, intituled, "An Act to prevent firvolous and vexatious Arrests," and the other, made in the Fifth Year of His present Majesty's Reign, to explain, amend, and render more effectual, the said Act."

Lloyd's petition referred to Judges.

Upon reading the Petition of Thomas Lloyd Esquire and Anne his Wife, for and on Behalf of themselves, and of John Lloyd, Anna Louisa Lloyd, and Jane Lloyd, their Infant Children, all of tender Years, and also of Beatrice Lloyd and Bridget Lloyd, Spinsters, Sisters of the Petitioner Anne, praying Leave to bring in a Bill, for Sale of a certain Estate of the Petitioner Thomas, in the County of Carmarthen, and some scattered Parts of an Estate in Pembrokeshire, and likewise an Estate of the said Petitioner, in the County of Cardigan, in the Petition mentioned, for Payment of Debts, and other Purposes therem expressed.

It is Ordered, That the Consideration of the said Petition be, and is hereby, referred to Mr Justice Wright and Mr Justice Burnett, with the usual Directions, according to the Standing Order.

A Message was brought from the House of Commons, by Mr. Hay and others.

With a Bill, intituled, "An Act for the better Relief of the Poor, by voluntary Charities," to which they desire the Concurrence of this House.

The said Bill was read the First Time.

Ordered, That the same be printed.

L Strange's Bill.

The Lord Willoughby of Parham, pursuant to the Order of this House of the 25th of January last, presented to their Lordships a Bill, intituled, "An Act to enable James Stanley Esquire, commonly called Lord Strange, Eldest Son and Heir Apparent of Edward Earl of Derby, and his Issue by Lucy his Wife (late Lucy Smith), to take and use the Surname of Smith, and bear the Arms of Smith and Heriz."

And the same was read the First Time.

Biddulph peremptorily to answer E Shelberne's Appeal.

The House was informed, "That Nicholas Biddulph Esquire, Respondent to the Appeal of Henry Earl of Shelburne in the Kingdom of Ireland and the Lord Dunkerron his Son, had not put in his Answer thereunto, though duly served with the Order of this House for that Purpose."

And thereupon an Assidavit, made by Edward Tolie of the City of Dublin Gentleman, of the due Service of the said Order, being read.

Ordered, That the said Respondent do peremptorily put in his Answer to the said Appeal in a Week.

Campbells peremptorily to answer Magdalen Campbell's Appeal.

The House was informed, "That Mrs Jane Campbell, and Mrs Jane Campbell her Daughter, and Colin Campbell, have not put in then Answer to the Appeal of Magdalen Campbell Widow, though duly served with the Order of this House for that Purpose"

And thereupon an Affidavit, made by Alexander Shaw Writer in Edinburgh, of the due Service of the said Order, being read.

Ordered, That the said Respondents do peremptorily put in their Answer to the said Appeal in a Week.

The Answer of Nicholas Biddulph Esquire, to the Appeal of Henry Earl of Shelburne in the Kingdom of Ireland and the Lord Dunkerron his Eldest Son and Heir Apparent, was brought in.

The House (according to Order) was adjourned during Pleasure, and put into a Committee upon the Bill, intituled, "An Act to revive Two Acts of Parliament; One, made in the Twelfth Year of the Reign of His late Majesty King George the First, intituled, "An Act to prevent frivolous and vexatious Arrests," and the other, made in the Fifth Year of His present Majesty's Reign, to explain, amend, and render more effectual, the said Act."

After some Time, the House was resumed.

And the Earl of Warwick reported from the said Committee, "That they had gone through the Bill, and made One Amendment thereunto, which he would be ready to report, when the House will please to receive the same."

Ordered, That the said Report be received on Wednesday next.

E Brooke, Leave for a Bill.

After reading, and considering, the Report of the Judges to whom was referred the Petition of Francis Earl Brooke and Elizabeth his Countess, praying Leave to bring in a Private Bill.

It is Ordered, That Leave be given to bring in a Bill, pursuant to the said Petition and Report.

L Strange's Bill.

The Lord Willoughby of Parham reported from the Lords Committees to whom the Bill, intituled, "An Act to enable James Stanley Esquire, commonly called Lord Strange, Eldest Son and Hen Apparent of Edward Earl of Derb, and his Issue by Lucy his Wife (late Lucy Smith), to take and use the Surname of Smith, and bear the Arms of Smith and Heriz," was committed "That they had considered the said Bill, and examined the Allegations thereof, which were found to be true, and that the Committee had gone through the Bill, and made One Amendment thereunto"

Which, being read Twice by the Clerk, was agreed to by the House.

Ordered, That the Bill, with the Amendment, be engrosted.

Badburs Common Fields, enclosing, Bill.

A Message was brought from the House of Commons, by Sir Robert Long and others.

With a Bill, intituled, "An Act to confirm and establish an Agreement for enclosing and dividing certain Common Fields, in the Hamlet of Badbury, in the County of Wilts," to which they desire the Concurrence of this House.

The said Bill was read the First Time.

Vexatious Arrests, to prevent, Bill.

The Earl of Warwick (according to Order) reported from the Committee of the whole House to whom the Bill, intituled, "An Act to revive Two Acts of Parliament, One, made in the Twelfth Year of the Reigh of His late Majesty King George the First, intituled, "An Act to prevent frivolous and vexatious Arrests," and the other, made in the Fifth Year of His present Majesty's Reign, to explain, amend, and render more effectual, the said Act," was committed, the Amendment made by the Committee to the said Bill.

Which was read Twice by the Clerk, and agreed to by the House, and is as follows:

"In the First Line of the Title, after the Word ["revive"], insert ["and make perpetual"]."

Mrs Ford Necessary Woman's Petition referred to Committee.

Upon reading the Petition of Mary Foord, Wife of Charles Foord, One of the Door keepers attending the Right Honourable the House of Peers, alleging, "That Sir Charles Dalton, late Gentleman Usher of the Plack Rod, appointed the Petitioner to the Place of Necessary Woman to this House, which is now claimed by Walter Birmingham, One of the Door-keepers, as given him by Sir William Saunderson, formerly Gentleman Usher," and praying, "That the said Birmingham may be required to pay the Petitioner the Money already due, and in Time coming, from her said Office of Necessary Woman, and to grant her such other Relief as to this House in their great Wisdom shall seem meet"

It is Ordered, That the said Petition be referred to the Consideration of the Lords Committees afore named.

Then Lordships, or any Five of them, to meet at the usual Time and Place, on Tuesday next, and to report then Opinion thereupon to the House.
