The recent petition of William Sayt, rector of the parish church of Clongell in the diocese of Meath (Miden.), contained that upon certain enemies (emulis) of his falsely and secretly reporting to John, bishop of Meath, that he had incurred perjury and irregularity, the said bishop summoned him and made inquiry, and that, inasmuch as the said bishop admitted the said enemies as both denouncers and witnesses, (fn. 12) he appealed to the apostolic see, but that the said bishop, in contempt of the said appeal, of which he was not ignorant, and whilst the said William was within the lawful time for prosecuting it, wrongfully proceeding further, deprived and removed him from the said church, and made collation of it to Richard Hone, clerk, his official, who took possession, wherefore the said William has appealed anew to the said see. The pope, therefore, at the said petition, hereby orders the above three to summon those concerned, absolve the said William conditionally (ad cautelam) from any sentence of excommunication incurred by reason of the foregoing, hear both sides, and decide what is just, without appeal, causing their decision to be observed by ecclesiastical censure. Sixtus IV at his petition united, etc., to his canonry and prebend of Houeden for his life the parish church of Everyngham in the diocese of York, which he was also holding, as is contained in the letters of the said pope; and, upon its being set forth to the said pope on his behalf that, inasmuch as it was stated in the said letters that the said churches are two miles apart, whereas they are seven miles from one another, although the bounds of his parishes were three miles apart, he doubted whether the said letters might not be held to be surreptitious, the said pope, under date 4 Kal. Footnotes

  • 1. On the back of the volume is ‘Sisto iv. 1484. Anno xiii. Innocent. viii. 1484. Anno 1.’ On an end-paper at the beginning of the volume, in the hand of the late Mgr. Wenzel, Prefect of the Vatican Archives, is ‘Innocent. viii. An. 1. to. 1.’ There are i–cccxiiij ff. of text, including a few blank leaves at the end of some of the quinternions. At least one leaf is lost at the end of the volume, the text on f. 314v. being unfinished. On the bottom edge of the volume is the almost illegible contemporary description, ‘Secundus (?) de diversis (?) …’ The Lateran Registers are without ‘rubricelle.’
  • 2. See below, f. 249r., note.
  • 3. On ff. 55r. and 57r. are dispensations for Henry ap John, rector of Bekyngham, and William Beverley, dean of St. George's, Wyndesore, respectively. As they belong to the 13th year of Sixtus IV, May-June, 1484, they have been transferred to p. 863 at the end of Vol. XIII of the Calendar.
  • 4. Also written ‘Westacre.’
  • 5. et ad cuius cimiterium mare propter propinquitatem causantibus tempestatibus et innu(n)ddationibus [sic] confluere ipsiusque cimiterii muros qui in periculo maris existebant diruere et destruere, cadavera quoque mortuorum inibi sepulta auferre sepenumero consueverat.
  • 6. Corrected, in the margin, from Decembris, cancelled.
  • 7. qui in dominica prima Passionis domini nostri Jesu Christi ac feria secunda post Pentecosten.
  • 8. Sanctus Eligius is St. Eloy, bishop of Noyon. The scribe seems to have written ‘sancti Eligii’ in error for ‘sancti Elerii,’ the spelling which he had already employed for the usual ‘sancti Hilarii,’ bishop of Poitiers.
  • 9. Also written ‘Pennederyn.’
  • 10. On f. 195v., under date 1494, 4 Id. Nov., anno 1 [10 Nov., 1484], is a mention of a moiety of the parish church of St. Mary de Loconeris [sic], in the diocese of Evreux (Ebroicen.), void per obitum quondam Johannis Anglici, i.e. Langlois.
  • 11. In the top margin is ‘Diversorum [libro] primo.’
  • 12. tamquam denuntiatores et tamquan testes.
