To the archdeacon of Dromore, and Thomas Obyrnd and Denis Omysteod, canons of the same. Mandate, as below. The pope has been informed by William Magynd, archdeacon of Down (Dunen.), that Thomas Magbruyn, rector of the parish church of Tulaclis in the diocese of Dromore, holding a canonry and prebend of Dromore, has for a certain sum of money resigned the said canonry and prebend to the official of Dromore in favour of John Magynd, clerk, of the said diocese, to whom the said official has made de facto collation and provision thereof. The pope, therefore, seeing that the said Thomas has thereby rendered himself unworthy of the said rectory, and wishing to do a special favour to the said William, who holds the said archdeaconry, which is a major dignity and habitually (fn. 2) has cure of souls, hereby orders the above three, if the said William will accuse the said Thomas before him, to summon the latter, and if they find the foregoing to be true, to deprive him of the said rectory and remove him therefrom, and in that event to collate and assign it, yearly value not exceeding 3 marks sterling, to the said William. To the bishop of Kildare (Dayren. [sic]), the abbot of the monastery de Flumine dei, and the prior of the monastery of Kyllkynny, wont to be governed by a prior, in the diocese of Meath (Medensis [sic]). Mandate, as below. The pope has learned that the rectory of the parish church of the town of Almoritia (ville Amoricii) in the diocese of Meath has been so long void that by the Lateran statutes its collation has lapsed to the apostolic see, although William Obrogy, priest, of the diocese of Clonfert, has, without any title, detained possession of it for a certain time. And, as the recent petition of Bernard Ydalayd, (fn. 3) prior of the monastery of St. Mary, Lochsydeie (?), (fn. 4) O.S.A., in the diocese of Meath, wont to be governed by a prior, contained, although by reason of the said priory he is bound to keep up hospitality, because the monastery is situate on the king's highway which is so much frequented that he is not so much bound, as above, to keep up the said hospitality, as forced by necessity to do so; that the fruits of the said priory (which is impoverished in regard to its spirituals and temporals, and is suffering utter ruin in respect of its dormitory, bell-tower, and other buildings, and is in such great need of ornaments and other things necessary for divine offices that they can hardly be celebrated in the said monastery) are so slender that, far from sufficing for the restoration of the aforesaid, they are barely enough for the support of the prior himself and one canon; and that the present bishop of Meath, who has pursued and constantly pursues with the greatest enmity the said prior Bernard (who has always done his best for the repair of the said monastery, and continually does so), does not cease wrongfully to disturb him, both by himself and by his officials and adherents, by imposing on him new and unwonted burdens and exactions, and by extorting them from him by force and violence, from which injuries, new burdens and exactions he has appealed to the apostolic see, after the loding of which appeal, and after he had betaken himself to Rome, the said bishop excommunicated him in his absence, not through contumacy. At the petition, therefore, of the said Bernard, who alleges that the yearly values of the said rectory and priorship do not exceed 6 and 10 marks sterling, respectively, to unite and appropriate the said rectory to the said priory, for as long as he shall hold the latter, (fn. 5) and to absolve him from the said sentence of excommunication, etc., the pope hereby orders the above three to absolve the said prior, if and as far as is just, from the said sentence, cite the said bishop and others concerned, hear both sides, and decide what is just, without appeal, causing their decision to be observed, by the said bishop by the pope's authority, and by others by ecclesiastical censure; and moreover if, after summoning the said william and others interested, they find the said rectory to be void in any way, etc., to unite and appropriate it to the said priory, removing the said William and any other unlawful detainer. To the bishop of Killaloe (Laon[i]en.), the abbot of the monastery of Holy Cross, Oterlain, in the diocese of Cashel, and John Machomayry (?), (fn. 6) a canon of Killaloe. Mandate, as below. The recent petition of Maurice, [son] of Nicholas Ymulcorcrey, clerk, of the diocese of Limerick, contained that the chancellorship of Limerick being void, and having been void so long that by the Lateran statutes its collation had lapsed to the archbishop of Cashel, the metropolitan, the present archbishop made collation and provision of it by his ordinary authority to the said Maurice, who in virtue thereof obtained possession. The said petition adding that he doubts whether the said collation and provision hold good, and the said Maurice alleging that papal letters of provision of the said chancellorship were surreptitiously impetrated more than a year ago by Jordan Porcelle, clerk, of Cork, and have not yet been presented to the executors thereof, the pope hereby orders the above three to summon the said Jordan and others concerned, and to collate the said chancellorship, a non-major dignity with cure, yearly value not exceeding 60 marks sterling, to the said Maurice, whether it be still void by the death of William Ymulcoyre (?), or of John de Geraldinis, or of Thomas Geraldi, also de Geraldinis, or of Denis Ybelcon [sic], or be void in any other way, etc. The pope further specially dispenses him not to be bound for seven years to be promoted to deacon's or priest's orders, provided that within two years he be promoted to the order of subdeacon. To the bishop of Lismore, the abbot of the monastery of Holy Cross, Uchth[e]rllaym, in the diocese of Cashel, and James Rusel, a canon of Lismore. Mandate, as below. The pope has learned that the monastery of St. Mary, Inishlounaght (de Suryo), O.Cist., in the diocese of Lismore, has been so long void that by the Lateran statutes its collation has lapsed to the apostolic see, although William Odomnachu, a monk thereof, has detained possession for between one and two years, without any canonical title. The pope, therefore, hereby orders the above three to receive Thomas Ocahyl, perpetual vicar of the parish church of Hyllsyllam in the said diocese, as a monk of the said monastery, give him the regular habit, and receive his profession, and if, after summoning the said William and others concerned, they find that the said monastery, the yearly value of which does not exceed 80l. sterling, is void in any way, or perhaps by the death of abbot Patrick, and if they find the said Thomas to be fit, to make provision to him, after he has received the habit and made his profession, of the said monastery, removing the said William and any other unlawful detainer; notwithstanding that he holds the said vicarage, yearly value not exceeding 8 marks sterling. The pope further grants that he may he blessed by any catholic bishop in communion with the apostolic see, and that he may retain for life the said vicarage with the said monastery, and may resign it when he pleases, etc. Apostolice sedis providentia circumspecta.
