To the dean of Tuam, and Davit [sic] Maclin and Nime[a]s Magnelly, canons of the same. Mandate, as below. The pope has been informed by John de Burgo, a canon of Annaghdown (Enachdunen.), that Magonius Omany, priest, of the diocese of Tuam, after having obtained a papal mandate to certain judges in those parts to erect the then void perpetual vicarage of the parish church of Seryn [sic], called the wardenship (custodiam) of the relics of St. Jarlath (sancti Erlay), in the said diocese, into a prebend of the church of Tuam for his lifetime, and to make provision to him thereof, made a bargain with Dermit Odonallan, a canon of Tuam, one of the said judges, before he proceeded to the execution of the said letters, to the effect that if the said Dermit would so erect and make provision he would pay him a certain sum of money, after which the said Dermit, proceeding to execution, erected the said vicarage into a prebend of Tuam, and made him collation and provision thereof, under pretext of which he took possession of it and has detained it, although for less than a year, taking the fruits, thereby incurring simony and the sentences of excommunication, etc., therefor. The pope, therefore, seeing that the said erection, collation and provision are without force, and that the said vicarage is still void as above, hereby orders the above three, if the said John will accuse the said Magonius before them, to summon the latter, and if they find the foregoing to be true, to declare the said erection, collation, and provision to have been and to be null and void, and to remove the said Magonius, and in that event to summon those interested, and unite and appropriate the said vicarage to the canonry of Annaghdown and the prebend of Leacatholide therein, which the said John holds, for as long only as he shall hold them, their yearly values not exceeding 5 marks and 1 mark sterling, respectively. To Master Egerdus Durcap, a papal chaplain and auditor. (fn. 2) Mandate, as below. The recent petition of James Strathanchin, clerk, of the diocese of St. Andrews, contained that on the rectory of the parish church of Clutyr [sic] in the diocese of Glasgow, which is of the patronage of laymen, viz. the baron of the barony of Cultyr, becoming void by the death of Robert Halkerston extraR.c., David Levingsten’ [sic], clerk, brother german and curator lawfully appointed of James de Levingston’, baron of the said barony, the patron, who was of unsound mind, (fn. 3) presented the said James Strathanchin, then only a scholar, to the then vicars-general in spirituals of Robert, bishop of Glasgow; and that upon a dispute arising before the said vicars between the said James Strathanchin and William Halherston [sic], clerk, who alleged that he had been presented to the said vicars by Elizabeth, countess of Ross, behaving as patron, the said vicars, after the said James Strathanchin had appealed to the apostolic see from the refusal to admit his presentation, instituted the said William, from which institution the said James Strathanchin appealed again to the said see; and that the pope, at his instance, committed the hearing and determining of the said appeal causes to the above auditor, who is said to have proceeded, short of a conclusion. The said petition adding that it is alleged that the said William has no right in or to the said rectory, the pope hereby orders the above auditor, if by the event of the suit he find that this is so, to collate and assign the said rectory, yearly value not exceeding 20l. sterling, howsoever void, to the said James Strathanchin, who was subsequently made a clerk.   • 2. He occurs passim in the registers, e.g. in Reg. Vat. 731. f.126r, where he is addressed as ‘Magistro Egerdo Durcap, decano ecclesic Mindensis, decretorum doctori, capellano nostro.’ and Reg. Vat. 732, f.56v., where he is addressed as ‘Magistro Egerdo Durcop, canonico Hildesemensi.’ On f.212v of the latter register his surname is spelt ‘Durkop.’
