To the abbot of St. Mary's, Annaghdown (b. M. de Portupatrum), in the diocese of Annaghdown, and Walter Blach and William de Burgo, canons of Annaghdown. Mandate, as below. The recent petition of William Omibleachlin (recte Omuleachlin), priest, of the diocese of Annaghdown, contained that (after he had been dispensed by papal authority on account of illegitimacy, as the son of a priest and an unmarried woman, to be promoted to all holy, even priest's orders and hold a benefice even with cure, and after he had been made a clerk and had been promoted to all the said orders, and had obtained the perpetual vicarage of the parish church of Rahuna in the said diocese, and had held possession of it for more than a year), upon the voidance of a certain perpetual vicarage or chaplaincy, called an office or stipend, (fn. 3) in the church of Annaghdown, which is canonically annexed to the metropolitan church of Tuam, by the death extra Rom. curiam of Walter Buin (?), Donatus, archbishop of Tuam and bishop of Annaghdown, made him collation and provision thereof, after he had resigned the said perpetual vicarage, in virtue of which collation and provision he obtained the said perpetual vicarage or chaplaincy, and has held it for about ten years in peace. The said petition adding that he fears lest the said collation and provision do not hold good, and the pope having learned that the said vicarage or chaplaincy is still void as above, he hereby orders the above three to collate and assign it, with cure and yearly value not exceeding 4 marks sterling, to the said William, whom the pope hereby specially, and as far as necessary, dispenses to receive and retain it, notwithstanding the said defect, etc. Vite etc. (Gratis pro deo. Juravit.) [5 pp.]

(f. 38r.)
To the dean of Annaghdown, and Richard Yoi and William Omuleachlyn, canons of Annaghdown. Mandate to collate and assign to Richard de Burgo, clerk, of the diocese of Annaghdown (who was lately dispensed by papal authority on account of illegitimacy, as the son of an abbot, O.S.A., in priest's orders, and an unmarried woman, to be promoted to all, even holy orders and [receive and] retain a benefice [even with cure], after which he had himself made a clerk), a certain perpetual benefice without cure in the church of Annaghdown, called a prebend, yearly value about 1 mark sterling, so long void that its collation has by the Lateran statutes lapsed to the apostolic see, although John Macgillanatht, priest, of the diocese of Kilmacduagh (Duacen.), has detained possession of it for some years without any title or right; the said John being removed. Vite etc. (Gratis pro deo, et juravit.) [3⅓ pp.]

(f. 87r.)
To Richard Murhede, clerk, of the diocese of Whiteherne (Candide case), bachelor in theology. Reservation, etc., as below. The pope recently ordered David Littoun, archdeacon of Ross (Ro [s]sen.), to be received as a monk in the church [sc. monastery] of St. Thomas of Canterbury, Abirbrothot [sic], O.S.B., in the diocese of St. Andrews, and the habit thereof to be given to him, and his profession as a monk thereof to be received and admitted. The pope, therefore, having learned that he has been so received, etc., whereby the said archdeaconry is to become void, reserves to his gift for the said Richard, who is also M.A., the said archdeaconry, a non-major dignity, yearly value not exceeding 30l. sterling; with mandate hereby to the bishop of Nocera (Nucerino), the prior of St. Andrews, and the archdeacon of Lothian (Laudonie) in St. Andrews, to collate and assign it to him upon its voidance, etc. Litterarum scientia, vite etc. [4 pp.]

Collation and provision to him (who was lately dispensed by papal authority on account of illegitimacy, as the son of a priest and an unmarried woman, to be promoted to all, even holy orders and [receive and] retain a benefice even with cure, after which he had himself so promoted, even to priest's orders) of the deanery of Cloyne, a major dignity, yearly value not exceeding 24 marks sterling, void by the death of Gerald de Geraldinis (to whom provision of it, previously reserved, had been made by papal authority, and who has died extra R. c. without having had possession), and reserved to the pope under his late reservation of all major dignities in cathedral churches; whether it be so void, or be void by the resignation of the said Gerald, or of James [son] of Philip, also de Geraldinis, or in any other way, and even if it be elective and have cure; with mandate executory hereby to the bishop of Clogher, the precentor of Cloyne, and Maurice Candum (?), a canon of Cloyne. To the bishop of Kilmacduagh (Duacen.), Malachy Omullonai, a canon of Kilmacduagh, and John Odonna, a canon of Annaghdown (Enacdunen.). Mandate, as below. The recent petition of Florence Ogerunaym. (fn. 8) a canon of Clonfert, contained that on the voidance of the perpetual vicarage of the parish church of Ryllogylhin (recte Kyllogylhin) in the diocese of Kilmacduagh, by the death of Geoffrey Ocuayn extra R. c., Cornelius, bishop of Kilmacduagh, made collation and provision of it by his ordinary authority to the said Florence, who in virtue thereof obtained and still holds possession; that subsequently a canonry of Kilmacduagh and the prebend de Sterkela (?) therein became and are void by the death of John de Burgo at the apostolic see, and therefore ipso facto reserved to the pope; and that he fears lest the said collation and provision do not hold good, and that the said vicarage is still void as above. The pope, therefore, hereby orders the above three to collate and assign to the said Florence the said canonry and prebend and vicarage, yearly values not exceeding 3 and 2 marks sterling, respectively; notwithstanding that he holds a canonry of Clonfert and the prebend of Kylashocmyllayn (?), yearly value not exceeding 2 marks sterling. To the archdeacon and the dean (fn. 9) of Clonfert, and Laurence Ogirna (?), a canon of the same. Mandate to collate, and assign to Kynetus (fn. 10) Odoeleayn, (fn. 11) a canon of the monastery of St. Mary, Clontuoseynt [sic] Omaeny, O.S.A., in the diocese of Clonfert, the perpetual vicarage or chaplaincy of the parish church of Crych alias Suchyn in the said diocese, with cure, and yearly value not exceeding 3 marks sterling, wont to be held by canons of the said monastery, and of the patronage of the prior and convent, of which monastery the said church is a member, so long void that its collation has by the Lateran statutes lapsed to the apostolic see, although John Okeally, a canon professed of the said monastery, who is to be summoned and removed, has without any title or right detained possession for some years. The pope hereby dispenses the said Kynetus on account of illegitimacy, as the son of a canon professed of the said monastery, in priest's orders, and an unmarried woman, to receive and retain the said vicarage or chaplaincy. Religionis zelus, vite etc. [4 pp.]
Kal. Jan.
(1 Jan.)
St. Peter's, Rome.
(f. 248v.)
To Walter Black, Thomas de Burgo, and John Odouna, canons of Annaghdown (Enachdunen.). Mandate, as below. The pope has learned that the perpetual vicarage of the parish church of Ryllcuayn (fn. 12) (recte Kyllenayn) in the diocese of Kilmacduagh (Duacen.) has been so long void that by the Lateran statutes its collation has lapsed to the apostolic see, although Thomas Odubgylla, priest, has without any title detained possession for many years. He has also been informed by Laurence Odonchu (?), (fn. 13) priest, of the said diocese, that Eugene alias Wochner Ostrachenasy [sic], abbot of the monastery of St. Mary, Kilmacduagh (de Petra), O.S.A., in the said diocese, has when under sentence of excommunication taken part in divine offices, in contempt of the Keys. The pope, therefore, hereby orders the above three, if the said Laurence (to whom lately, alleging that he had been dispensed by papal authority on account of illegitimacy, as the son of a bishop and an unmarried woman related in the second degree of affinity, to be promoted to all, even holy orders and receive and retain a benefice even with cure, in virtue of which he had himself so promoted, the pope ordered provision to be made of a certain canonry and prebend of Kilmacduagh, and whom the pope further dispensed, notwithstanding the said defect, to receive and retain any benefices with and without cure, of any number and kind, compatible with one another and with the said canonry and prebend), will accuse the said Eugene, before them, to summon the latter and the said Thomas, and if they find the said vicarage to be void, and the foregoing to be true, to deprive the said Eugene of the commenda of the treasurership of Kilmacduagh which he holds by papal grant and dispensation, and in that event to collate and assign the said vicarage and treasurership, a nonmajor elective dignity with cure, yearly values not exceeding 4 and 5 marks sterling respectively, to the said Laurence, removing the said Thomas and Eugene and any other unlawful detainers. The pope further dispenses him to receive and retain them for life, and to retain the said treasurership together with the said canonry and prebend under one and the same roof. Vite etc. [5½ pp.]

(29 Jan.)
St. Peter's, Rome.
(f. 265v.)
To the dean and the archdeacon of Clonmacnois (Cluanen), and James Oduarla, a canon of the same. Mandate, as below. The pope has learned that the perpetual vicarage of the parish church of Locluat alias de Stagno cinerum and that of Kyllomilcon, in the diocese of Clonmacnois, have been so long void that there is no certain knowledge of their last ways of voidance, and that by the Lateran statutes their collation has lapsed to the apostolic see, although Conchofinus Odullaynd, priest, has detained them for some years, and still detains them, under pretext of papal letters obtained by suppression of the truth, etc., and without any other title. And the recent petition of Bernard Ydullaind, a canon of Clonmacnois, contained that if the said vicarage of Kyllomilcon were erected for his lifetime into a prebend of the said church of Clonmacnois, in which there is no fixed number of canons, and if the said vicarage of Locluat alias de Stagno cinerum were united to such canonry and prebend for as long as he should hold them, it would be to the benefit of the said church of Clonmacnois and of the said Bernard. At the petition, therefore, of the said Bernard, who alleges that from time immemorial the said vicarages have been wont to be held by one man only, and that their combined fruits, etc., do not exceed a yearly value of 16 marks sterling, the pope hereby orders the above three to summon the said Conc[h]ofinus, etc., and also the chapter of Clonmacnois, and, if they find the facts to be as stated, to erect and unite, as above, and to collate and assign the said prebend thus to be erected, together with the said annexed vicarage, to the said Bernard, removing the said Conc[h]ofinus, etc. Apostolice sedis providentia circumspecta. [42/3 pp.]

St. Peter's, Rome.
(f. 280v.)
To Florence Ogaunayn, a canon of Clonfert. Mandate, as below. The pope has learned that a canonry of Annaghdown (Enacdunen.) and the prebend called the prebend of Lencolay, and the perpetual vicarage of the parish church of Kyllyly in the diocese of Kilmacduagh (Duacen.), have been so long void that by the Lateran statutes their collation has lapsed to the apostolic see. although Rory Macgillavanach, priest, has detained the said vicarage, and John Johy, priest, the said canonry and prebend, for some time without any title or right. And the recent petition of Walter de Burgo, clerk, of the diocese of Annaghdown, contained that the fruits, etc., of the said canonry and prebend are very slight, and that if the said vicarage were united thereto for his lifetime he could, after provision of the said canonry and prebend had been made to him, more conveniently maintain himself with the fruits, etc., thereof and of the said vicarage. At the petition, therefore, of the said Walter, who alleges that the yearly values of the said vicarage and canonry and prebend do not exceed 6 marks and 1 mark sterling, respectively, and that he is by both parents of noble birth, the pope hereby orders the above canon to summon the said Rory and John, and if he find the facts to be as stated, and the said Walter to be fit, to collate and assign to him the said canonry and prebend, and to unite thereto the said vicarage for as long as he shall hold them, removing the said John and Rory, etc. Dignum et [sic] arbitramur et congruum. Footnotes

  • 1. On the back of the volume: ‘Inn. viii. Bullar. Ann. i. Lib. iii.’ On the side of the original sheepskin binding, preserved at the beginning of the volume, is the contemporary ’Liber iii bullarum domini Innocentii pape viii,’ and on the back of it is the later ‘Innoc. 8. Lib. iii.’ There are 315 ff. of text, preceded by 5 ff. of ’rubricelle’ without heading.
  • 2. Also written Maurianus.
  • 3. quadam perpetua vicaria aut capp (ella)nia officio seu stipendio nuncupata.
  • 4. The scribe of the ‘rubricelle’ appears to have rendered the vaguely written name in the text as ‘Spieinecos.’
  • 5. Casalen. is Casale, a suffragan see of Milan.
  • 6. canonicatus et vicaria parrochialis ecclesie de Crochan nuncupata prebenda ecclesie Casalen. [sic].
  • 7. detinet (recte detinuit) indebite occupatum.
  • 8. The scribe of the ‘rubricelle’ appears to have written ‘Ogerunen.
  • 9. The order is unusual.
  • 10. The writer of the ‘rubricelle’ has ‘Rynete’ (in the dative case), and as regards the initial letter he might be right, as it seems to have been obscured in the text by correction, but ‘Kyneto,’ ‘Kynetum’ and ‘Kynetus’ occur distinctly further on.
  • 11. Or Odooleayn (i.e. Odoolan). The ‘rubricelle’ have ‘Odowil,’ which is not the same name.
  • 12. The fifth letter is doubtful.
  • 13. The letter or letters after the h are obscured by correction. The ’rubricelle’ have ‘Odunchu.’
