To the abbot of Wymondham in the diocese of Norwich, and the archdeacon of Norwich. Mandate, as below. The recent petition of John Patrik and Robert Langh[a]m, laymen, of the diocese of Norwich, executors of the last will of William at Wade, layman, of the said diocese, contained that whereas John Wly[p?]ttrott [?], (fn. 5) clerk, dwelling in the said diocese, acting under commission from James, bishop of Norwich, excommunicated Geoffrey Apuwy (recte Apulby), layman, of the said diocese, for forging a will, and, concealing the true will, administering the goods left by the said William, the said Geoffrey appealed to Thomas, cardinal priest of St. Ciriac's in Termis, who holds the church of Canterbury by papal grant and dispensation, and by reason of that church is legatus natus in those parts, and caused the above executors to be summoned in the cause of the said appeal before William Pykynham, auditor-general of causes of the court of the said cardinal, who, wrongfully proceeding, promulgated an unjust definitive sentence in favour of the said Geoffrey, and against the said executors, revoking and annulling the said censures, and condemning the said executors in costs, wherefore they appealed to the apostolic see; and that, inasmuch as the said auditor, refusing to defer to the said appeal, threatened to excommunicate the said executors if they did not obey his said sentence, they have again appealed to the said see. The pope, therefore, at the said petition, hereby orders the above two to summon the said Geoffrey and others concerned, grant the said executors conditional (ad cautclam) absolution from any such sentence of excommunication pronounced after the said appeal, hear both sides and, taking cognizance of the principal matter also, decide what is just, without appeal, causing their decision to be observed by ecclesiastical censure. To the bishop of Exeter, the abbot of Torre (de Torro) in the diocese of Exeter, and Nicholas Gosse, a canon of Exeter. Mandate, as below. The recent petition of William Hyl, temporal lord of the place of Bokelont [sic] in the diocese of Exeter, and the inhabitants thereof, contained that the said place is about three miles distant from the parish church of Lodeswil in the said diocese, within the bounds of which it is situate, and that between them flows a certain river which is very hard to cross, especially in time of winter floods, wherefore, seeing that the said inhabitants could not easily go to the said church for hearing masses and other divine offices, and for receiving the sacraments, a chapel was, it is believed, built of old in the said place of Bokelond, dedicated to St. Peter, in which, as in a daughter chapel, the rector or vicar of the said church might celebrate masses etc. for the inhabitants and parishioners of the said place, and administer the sacraments to them; that in course of time, it being a burden for the said rector or vicar to go to the said chapel for the said purpose, the said rector or vicar granted a certain part of the tithe fruits growing in the possessions situate within the bounds of the territory of the said daughter chapel to the rector of the college or house of Slapton in the said diocese, in order that the latter should celebrate the said divine offices in the said daughter chapel; that inasmuch as the said chapel was not being served duly and in accordance with ancient custom, a certain other part of the said tithe fruits was granted by the then rector or vicar of the said parish church to the rector of the parish church of Alvy[ng]ton in the said diocese, with the obligation of the said celebration; and that, notwithstanding the said grants, divine offices are not duly performed in the said chapel, but that, as far as regards them and the administration of the sacraments, the said parishioners [and] inhabitants of the said place of Bokelond suffer many drawbacks (detrimenta), so much so that hardly are they able to have masses in the said chapel on Sundays, the which has hitherto been and still is burdensome and costly (grave et dispendiosum) for them. The said petition added that if the said chapel (in which masses and other divine offices were wont from of old to be celebrated on Sundays and other holy days, and the sacraments of penance, baptism, and Eucharist, and other ecclesiastical sacraments were wont to be administered to the parishioners and inhabitants of the said territory, although the bodies of the dead were not buried therein), and the bounds thereof, were separated from the parish of the said church of Lodeswil, and the said chapel erected into a parish church, and to it, thus erected, were assigned the said place and territory of Bokelond, etc., for its parish, etc., and if to the rector of such erected parish church of St. Peter were assigned the tithes and all the rights which the rector or vicar of Lodessuil [sic] has been wont to receive in the said territory, etc., and if to him were reserved the patronage and right of presenting to the said church, thus to be erected, the inconveniences which the inhabitants and parishioners of the said territory of Bochelond [sic] suffer would be obviated. The pope, therefore, hereby orders the above three to summon the present rector [or vicar] of Lodesuil and others concerned, and if they find the facts to be as stated, to separate the said place or territory of Bokelond and its possessions within its bounds from the parish or vicarage of the said church of Lodeswil, and to erect the said chapel into a parish church with a cemetery and other parochial insignia, and assign to it the said place or territory of Bokelond, etc., as its parish, and the inhabitants thereof as its parishioners, and ordain that the said tithes and all the rights due to the said rector or vicar of Lodeswil shall belong to the rector of such erected church of St. Peter, reserving to the said rector or vicar de Lodeswil the patronage and right of presenting to the said chapel, thus erected into a parish church, for this first turn and at future voidances, etc. Admont nos suscepta cura regiminis.
