De Vacantibus.

1484.
7 Id. June.
(7 June.)
St. Peter's, Rome.
(f. 8v.)
To James de Sancto Claro, priest, of the diocese of Aberdeen. Motu proprio reservation to the pope's gift, for provision to him (who was lately dispensed sufficiently for the purpose on account of illegitimacy, as the son of a priest and a married woman), of the archdeaconry of the church of Orkney, called [the archdeaconry] in Shetland (in Zetlandia), a non-major dignity, value 9l. sterling, which is to become void by the provision which the pope has made to John, [bishop] elect of Caithness, of that church [Reg. Lat. DCCCXXXIII, f. 233v., above, p.—], and the consecration which is to be conferred on him. Vite etc.
Concurrent mandate to the bishop of Nocera, the chancellor of Moray, and the official of Orkney. Hodie cum archidiaconatus ecclesie Orckaden. [sic] in Zetlandia nuncupatus. (At the end: G. xiiii. xii. Septimo Idus Julii anno tertiodecimo. Polycarpus.) [4½ pp.]

(7 May.)
St. Peter's, Rome.
(f. 43v.)
To the dean of Cloyne (Clonen.). Mandate, as below. The pope has learned that acanonry of Cloyne and the prebend called [the prebend] of Kellenymoyt therein have been so long void that their collation has lapsed to the apostolic see, and has been informed by Edmund Canton, clerk, of the diocese of Cloyne, that John Plat, perpetual vicar of Glennyr’ in the diocese of Cloyne (?), has celebrated masses and other divine offices in a place laid under an interdict by authority of the ordinary, in contempt of the Keys, etc., and has buried a dead man in the same place. The pope, therefore, hereby orders the above dean, if the said Edmund (who was lately dispensed by the said authority on account of illegitimacy, as the son of unmarried parents, to be made a clerk, and hold a certain perpetual benefice without cure, called the parcel of Lynam, (fn. 2) within the bounds of the parish church of Brygoyas in the said diocese), will accuse the said John before him, to summon the latter, and if he find the foregoing to be true, to deprive and remove him, and to collate and assign the said canonry and prebend, value 4 marks sterling, to the said Edmund forthwith (ex nunc), and, in the event of his making the said deprivation and removal, to collate and assign to him the said vicarage, value 10 marks sterling, notwithstanding that the holds the said benefice called a parcel, value 2 gold florins of the Camera. The pope further dispenses him to be promoted to all, even holy and priest's orders and receive and retain the said canonry and prebend and vicarage, and to resign them, etc., and hold instead another canonry and prebend and a vicarage or a parish church. Dignum etc. (At the end: G. xx. Tertio Non. Maii anno tertiodecimo. Polycarpus.) [3½ pp.]
5 Id. April.
(11 April.)
St. Peter's, Rome.
(f. 45r.)
To Maurus Macklainche, rector of Dromeryn in the diocese of Ardfert. Collation and provision to him (who was lately dispensed by papal authority on account of illegitimacy, as the son of unmarried parents, to be promoted to all, even holy and priest's orders and hold a benefice even if with cure, in virtue of which he obtained the perpetual vicarage of Askethyny (?) (fn. 3) in the diocese of Limerick, value 12 marks sterling), of the parish church of Dromeryn in the diocese of Ardfert, value 10 marks sterling, void at the apostolic see, and therefore ipso facto reserved to the pope, by the death there of David Oruda (?). The pope further dispenses him to receive the said church of Dromeryn, and to retain it for life with the said vicarage, and to resign them, etc., and hold instead two other parish churches or perpetual vicarages. Vite etc.
Concurrent mandate to the archdeacon and the treasurer of Limerick, and John Macclanche, a canon of the same. Hodie dilecto filio Mauro Macklanche. (At the end: N. xii. x. Quarto Id. Junii anno tertiodecimo. Garilliati.) [3 pp. +]

(f. 71r.)
To the archdeacon of Ross. Mandate as below. The recent petition of [D]onaldus Ohegeritaide, (fn. 4) priest, of the diocese of Cork (Corchasien. [sic]), contained that after Pius II's renewal of all sentences of excommunication, etc., against simoniacs, and his reservation of absolution therefrom, upon the perpetual vicarage of Killmoluata in the diocese of Ross becoming void (because Cornelius Odonnwail, (fn. 5) after having obtained it by canonical collation, held it in peace for more than a year without having himself ordained priest, and without dispensation), he made a bargain with Donald Odonwail, clerk, of the said diocese, to the effect that if the latter procured provision for him of the said vicarage, he would give him a certain part of the first year's fruits, thereby incurring simony and the sentences etc. therefor; that by means of the said Donald Odonwail he got collation and provision made to him of the said vicarage by authority of the ordinary, and assigned to him part of the fruits, and under pretext of the said collation and provision obtained possession of the said vicarage, and has detained it for between one and two years. The said collation and provision being therefore without force, and the said vicarage being still void, as above, the pope hereby orders the above three to absolve the said Donald Ogertaid from simony and the said sentences, etc., enjoining a salutary penance, dispense him on account of irregularity contracted, and rehabilitate him, and, in the event of his so doing, to collate and assign to him the said vicarage, value 8 marks sterling. Before, however, he proceeds to the execution of these presents, the said Donald is to resign it to him. Sedis [sic] apostolica pia mater. (At the end: G. xx. Quarto Idus Aprilis anno tertiodecimo. Polycarpus.) [3 pp.]

To the bishop of Glasgow. Mandate to collate and assign to John Gwollad, priest, of the diocese of St. Andrews, the perpetual vicarage of the parish church of Cure in the said diocese, value 24 marks sterling, void at the apostolic see, and therefore ipso facto reserved to the pope, by his erection of it this day in the said church [above, p—]. Kal. April.
(1 April.)
St. Peter's, Rome.
(f. 73r.)
To the treasurer of Cashel, Walter Blach, a canon of Annaghdown (Enachdunen.), and Nicholas Whyt, a canon of Ossory. Mandate, as below. The recent petition of John Brenache, priest, of the diocese of Cashel, contained that (after he had been dispensed by papal authority on account of illegitimacy, as the son of a priest and an unmarried woman, to be promoted to all, even holy orders and hold a benefice even with cure, and after he had been made a clerk, and had been promoted to all the said orders, and had obtained by canonical collation the perpetual vicarage of le Aguroche (?) in the said diocese), upon the perpetual vicarage of Elleth in the diocese of Ossory becoming void in a certain way, John, bishop of Ossory, made collation and provision thereof to the said John, the said vicarage of le Agineche (?) having been resigned by him, without his having any other dispensation, and that under pretext of the said collation and provision he obtained possession of the said vicarage of Elleth, and still detains it, having taken its fruits to a value of 3 marks sterling. The said collation and provision being therefore without force, and the said vicarage of Elleth being still void, and the rectory of Ballimartyn (fn. 6) in the said diocese of Ossory, of lay patronage, being also void by the death of Rory Ydulchanta in the Roman court [and therefore ipso facto reserved to the pope], the pope, hereby rehabilitating the said John, and specially and expressly derogating from the said right of patronage for this turn only, orders the above three to collate and assign to him the said vicarage of Elleth, value (with that of the rectory of the parish church of Tyburduy in the said diocese of Ossory, which is annexed to it) 3 marks sterling, and the said rectory of Bellimartyn [sic], value 6 marks sterling. The pope further dispenses him to receive the said vicarage of Elleth and rectory of Bellimartyn [sic], which are about a mile apart and can be served by one man, and retain them for life, and to resign them, etc. Before, however, they proceed to the execution of these presents, as far as regards the said vicarage of Elleth, he is to resign it to them. Sedes apostolica pia mater. (At the end: G. xxv. Id. Aprilis anno tertiodecimo. Polycarpus.) [2½ pp.]

To the bishop of Limerick. Mandate, at the recent petition of Thomas Contelon, a canon of Limerick, to unite to his canonry of Limerick and prebend of Dyserth, value 4 marks sterling, for his lifetime only, the rectory of Dromyn OgleZyn (?) in the diocese of Limerick, of lay patronage and value 6 marks sterling, which David [archbishop] elect of Cashel held at the time of the pope's promotion of him to that church [Reg. Lat.—, f.—, above, p.—], and which he still holds, the said union to take effect as soon as the said rectory becomes void by the said promotion and by the consecration which is to be conferred on the said elect, etc. Ex iniuncto nobis. 11 Kal. April.
(22 March.)
St. Peter's, Rome.
(f. 253r.)
To the precentor of Cloyne (Clonen.), and Donatus Omurchu and Dermit Ohealithy, canons of Cloyne. Mandate, as below. The pope has been informed by Maurice Ocrumyn, perpetual vicar of Aglasmaythoala (fn. 7) in the diocese of Cork, that Donald Ocrumyn, perpetual vicar of Acchabolog in the diocese of Cloyne, laid violent hands on the late David Maikeallikan alias Ocrumyn, layman, of the said diocese of Cloyne, and led him captive to the temporal lord of the land of Muscrilaynd in the same diocese of Cloyne, which captive was hanged by order of the said lord, whereby the said Donald has contracted irregularity, and that, without having obtained any dispensation, he has celebrated masses and other divine offices, etc., and that he has also allowed one of his parishioners to die without the sacraments. The pope, therefore, hereby orders the above three, if the said Maurice (who in the course of litigation about the said vicarage of Aglasmaythoala has appealed to the apostolic see from a definitive sentence pronounced in virtue of papal letters in favour of a certain adversary) will accuse the said Donald before them, to summon the latter, etc., and if they find the foregoing to be true, to deprive and remove him from the said vicarage of Acchabolog, and in that event to collate and assign it, value 14 marks sterling, to the said Maurice. The pope further dispenses him to receive it, and to retain it for life with the said vicarage of Aglasmaythoala, if he win it. Vite etc. (At the end: G. xx. Tertio Non. Aprilis anno tertiodecimo. Polycarpus.) [2⅓ pp.]
3 Id. March.
(13 March.)
St. Peter's, Rome.
(f. 284v.)
To John de Gilis, a canon of London. Mandate, as below. The recent petition of Robert Carr, a canon of the priory of St. Mary, Newstead (de Nouo loco) in Shirwode, O.S.A., in the diocese of York, contained that on the voidance in a certain way of the perpetual vicarage, called [the perpetual vicarage] of Ryngmer, of the church of Sowth M(a)llyng in the diocese of Canterbury, which is parochial and collegiate, the then archbishop of Canterbury made collation and provision thereof to the said Robert, then surnamed Brande, without his having obtained any dispensation to hold a secular benefice, and that under pretext of the said collation and provision he took possession of the said vicarage, and has detained it for between fifteen and sixteen years. The said collation and provision being therefore without force, and the said vicarage being still void, the pope, hereby rehabilitating the said Robert, (who was a afterwards dispensed by papal authority to receive and retain any benefice with or without cure wont to be held by secular clerks, even if a parish church, etc., and to resign it, etc.), hereby orders the above canon to collate and assign to him the said vicarage, value not exceeding 10 marks 6 groats and 8 pence of the money of that country, worth about 27 gold ducats of the Camera. (fn. 8) Before, however, the above canon proceeds to the execution of these presents, the said Robert is to resign. Sedis apostolice copiosa clementia. (At the end: G. xxx. Decimo Kal. Aprilis anno tertiodecimo. Polycarpus.) [24/5 pp.]
