To the prior of Athassyll in the diocese of Cashel, and the archdeacons of Cashel and Emly. Mandate, as below. The pope has been informed by Denis Ohogayn, clerk, of the diocese of Killaloe (Laonien.), I.U.B., that David Ocrormachan [sic], dean of Killaloe, has alienated and dilapidated the moveable goods of the said deanery, and has committed perjury, and is defamed thereof in those parts. The pope, therefore, hereby orders the above three, if the said Denis (who was lately, notwithstanding his illegitimacy as the son of a priest and an unmarried woman, made a clerk by the present archbishop of Cashel, the see of Killaloe being then void, and who was afterwards successively dispensed, first by authority of the ordinary to hold a benefice without cure, and then by papal authority to be promoted to all even holy orders and hold another benefice [with cure], and whom, after the pope had ordered provision to be made to him of a canonry of Cashel and of the perpetual vicarage of Iniskealtra in the diocese of Killaloe, the pope dispensed to receive the said vicarage and retain it and the said canonry), will accuse the said David before them, (inasmuch as from fear of his power the said Denis cannot safely meet him in the city and diocese of Killaloe), to summon him, and if they find the foregoing to be true, to deprive him of the said deanery, and in that event to collate and assign it, a major dignity, value 16 marks sterling, to the said Denis, whether it be then void by such deprivation, or be now void by the resignation of the said David, or of the late John Yogayn extra R. c., or in any other way, removing the said David or any other unlawful detainer. The pope further dispenses the said Denis to receive and retain it and the said vicarage for life, or without them any two other benefices with cure or otherwise incompatible, even if parish churches, etc., and to resign them, etc. Litterarum etc. (At the end: L. xxxvi. To Donatus Omurchu, a canon of Cork. Mandate, as below. The pope has learned that the perpetual vicarage of Nocwmayllalla in the diocese of Ardfert has been so long void that its collation has lapsed to the apostolic see, and that there is no certain knowledge of the last way of its voidance, although David Ocronyn, priest, has for between two and three years detained it, collated to him by authority of the ordinary after the said lapse, without any other canonical title. And the recent petition of John Ymurchu, priest, of the said diocese, contained that (after he had been dispensed by papal authority on account of illegitimacy, as the son of a priest and an unmarried woman, to be promoted to all, even holy orders and receive and retain a benefice even with cure, and had been so promoted), provision was by papal authority ordered to be made to him of the perpetual vicarage of Cullynalla in the said diocese, the fruits etc. of which, if collation and provision be made to him thereof, are insufficient for his maintenance, and that if thereto were united the above vicarage of Nocwmayllalla for his lifetime he could be more becomingly maintained. At the said petition, therefore, alleging that the said churches are so near that their vicarages can be served by one man, and that the value of the vicarage of Cullynalla does not exceed 8 marks sterling, and that of Nocwmayllalla 4, the pope hereby orders the above canon (seeing that from fear of the power of the said David the said John cannot safely meet him in the city or diocese of Ardfert), if he find the facts to be as stated, to unite the latter vicarage to the former for the lifetime only of the said John. To the archdeacon of St. Andrews. Mandate, as below. The recent petition of Robert Bellyntyne, a canon of the monastery of Holyrood near Edinburgh, (fn. 2) O.S.A., in the diocese of St. Andrews, contained that on the voidance of the priory of Traile, of the said order, in the diocese of Whiteherne (Candide case), by the resignation of John Wardlaw to the abbot and convent of the said monastery, they, in accordance with ancient custom, made collation and provision of it to the said Robert, and that he doubts whether the said collation and provision hold good. The pope, therefore, having learned that the said priory is still void as above, hereby orders the above archdeacon, if he find the said Robert to be fit, to collate and assign to him the said priory, which is not conventual nor a dignity, depends on the said monastery, is wont to be held by canons thereof, is not elective, and has cure, value not exceeding 45l. sterling. Collation and provision to him, a priest, of the deanery of Ardfert, a major dignity with cure, value not exceeding 20 marks sterling, void by the death of Edmund FysMorys extra R. c., and reserved to the pope by his late reservation of all major cathedral dignities, void and to be void. Vite etc.
