1477.
Prid. Id. July.
(14 July.)
St. Peter's, Rome.
(f. 22r.)
To the bishop of Moray. Mandate, as below. The recent petition of Thomas Monymele [sic], a monk of Dunformlyne [sic], O.S.B., in the diocese of St. Andrews, contained that on the voidance of the sacristship of the said monastery by the death of John Bennala extraR.c., abbot Henry and the convent presented the said Thomas to William Sclaues (recte Scheues), archdeacon of St. Andrews, coadjutor of archbishop Patrick, who, in virtue of a faculty from the apostolic see, instituted him, in virtue of which presentation and institution he obtained possession, but now doubts whether they hold good. The pope, therefore, hereby orders the above bishop to collate and assign the said sacristship, which is a claustral office wont to be held by monks of the said monastery, has cure, and the yearly value of which does not exceed 9l. sterling, howsoever void etc., to the said Thomas. Dignum etc. (At the end: A. xx. Quintodecimo Kal. Augusti anno sexto. de Petra.) [2½ pp. See below, p. 577.]
Prid. Id. Aug.

St. Peter's, Rome.
(f. 63r.)
To the prior of St. John the Evangelist's, Inscorthy, in the diocese of Ferns. Mandate to collate and assign to Odo Offeraylle, clerk, of the diocese of Ferns (who was lately dispensed by authority of the ordinary on account of illegitimacy, as the son of unmarried parents, to be promoted to minor orders and hold a benefice without cure, and who has been made a clerk), the rectory of the parish church of St. Colman, Senbolhoch, in the said diocese, of the patronage of laymen, and value 12 marks sterling, so long void that there is no certain knowledge of the mode of voidance, and that its collation has lapsed to the apostolic see, although Odo Oronayn, priest, of the said diocese, who is to be summoned and removed, has detained possession for between four and five years, without any title. The pope hereby dispenses the said Odo Offeraylle to be promoted to all, even holy and priest's orders, and receive and retain the said rectory, notwithstanding the said defect, etc. Dignum etc. [2 pp. +]

(fn. 2) Mandate to collate and assign to Edmund Ohanrattayd, clerk, of the diocese of Clogher (who was lately, when a clerk, dispensed by papal authority on account of illegitimacy, as the son of a priest and an unmarried woman, to be promoted to all, even holy orders and hold a benefice even with cure, and subsequently to receive and retain the archdeaconry of Armagh, a non-major dignity, provision of which was ordered to be made to him by the said authority, and to resign it, simply or for exchange, when he pleased), a canonry of Clogher and the prebend which was lately, with consent of the chapter of Clogher and the patron of the below-named rectory, erected by bishop Roger by his ordinary authority from the rectory of the parish church of Mucnan in the said diocese, of lay patronage, value not exceeding 8 marks sterling, and void by the resignation of Peter Macmarcayd to the pope; provided that of the said canonry and prebend, which are also of lay patronage, the consent of the patrons be forthcoming. The pope hereby dispenses him to receive and retain them, notwithstanding the said defect, etc. Vite etc. (At the end: Jo. xxiiii. Sexto Kal. Septembris anno septimo. Gerona.) [3 pp.]

De Provisionibus

Prid. Kal. Aug.
(31 July.)
St. Peter's, Rome.
(f. 185r.)
To the prior of St. John the Evangelist's, Iniscorthy, in the diocese of Ferns. Mandate to make provision to Dermit Oduffryn, a monk of St. Mary's, Glassarg, O.S.B., in the diocese of Ferns (who, notwithstanding his illegitimacy as the son of a clerk and an unmarried woman, has been promoted to all, even holy orders (fn. 3) ), the monastery of St. Mary, Ferns, O.S.A., value not exceeding 16 marks sterling, void by the death of abbot Thomas Odriffyn (fn. 4)extraR.c., although Donald Omurchy, a canon of the said monastery, who is to be summoned and removed, has without any title or right detained possession for between thirteen and fifteen years. The pope hereby dispenses the said Dermit to rule the monastery etc., notwithstanding the said defect, and also grants him faculty to be blessed by any catholic bishop of his choice in communion with the apostolic see, without prejudice to the bishop of Ferns. He is to wear the habit worn in the said monastery of Ferns. Solicite considerationis. [24/5 pp.]

De Vacantibus.

Prid. Id. May.
(14 May.)
St. Peter's, Rome.
(f. 275r.)
To Thady Ohurayn, a canon of Ardfert, residing in the diocese of Cloyne (Clonen.). Mandate, as below. The recent petition of Philip Ymurvhu, priest, of the diocese of Cloyne, contained that (after he had been dispensed by papal authority on account of illegitimacy, as the son of a priest and a married woman, to be promoted to all, even holy orders and hold a benefice even with cure, and subsequently, after he had been made a clerk, to hold with such benefice one other compatible benefice, and resign them, for exchange or otherwise, once only, and hold instead two other benefices compatible with one another), collation and provision were made to him de facto by the then bishop of Cloyne of the perpetual vicarage of the parish church of Dromor in the said diocese, which had been void so long that its collation had lapsed to the apostolic see, in virtue of which he obtained possession, and has detained it for between three and five years, taking the fruits, also de facto, whereby he has incurred disability. The said collation and provision being therefore without force, and the said vicarage still void as above, and the perpetual vicarage of the parish church of Brekny in the said diocese being also void, and having been so long void that its collation has lapsed to the said see, although Donald Makcladean (?), (fn. 5) priest, has detained it for between twenty and twenty-five years without any title or right, the pope hereby rehabilitates the said Philip, and orders the above canon to collate and assign to him the said vicarage of Dromor, and also that of Brekyn, value not exceeding 7 and 4 marks sterling, respectively, summoning and removing the said Donald. The pope further dispenses him to receive and retain the said vicarages for life, and, without one or both of them, any one or two other benefices with cure or otherwise incompatible, even if parish churches etc., or dignities etc., and to resign them, simply or for exchange, as often as he pleases. Before the said canon proceeds to execution of these presents, the said Philip is to resign to him the said vicarage of Dromor. Sedes apostolica pia mater. (At the end: P. xxxii. Decimo octavo Kal. Julii anno sexto. de Varris.) [32/3 pp.]
Ibid.
(f. 316v.)
To the prior of Ballinskelligs (sancti Michaelis de Rupe) in the diocese of Ardfert. Mandate, as below. The recent petition of David Yhurayn, priest, of the diocese of Ardfert, bachelor of decrees, contained that on the voidance of the rectory of the parish church of Kylnanama, or a parcel of it called a parcel in ecclesiastical fee, (fn. 6) [in the said diocese], by the resignation of Thady Yhurayn to John bishop of Ardfert, the said bishop made collation and provision thereof by his ordinary authority to the said David, who in virtue thereof obtained possession, and has held possession for more than a year, without having himself ordained priest; and that on the voidance in a certain way extraR.c. of the rectory of Nohaval of Akymys (fn. 7) in the said diocese, of lay patronage, the said bishop, with consent of the chapter of Ardfert and of James earl of Desmond, (fn. 8) layman, patron of the said rectory, (fn. 9) united etc. the said two rectories for the lifetime of the said David, who took de facto possession of the said latter rectory, (fn. 10) and still detains the said two rectories without any new right or title, taking the fruits, also de facto. The said rectory of Kynanama being therefore void by the said non-promotion, and that of Nohaval (fn. 11) being still void, and the said union etc. being without force, the pope, at the petition of the said David, (which added that if the said rectories were united for his lifetime, and provision thereof made him, he could maintain himself), hereby absolves him, who alleges that the yearly values of the said rectory of Kylnanama and Nohaval (fn. 12) do not exceed 2 and 20 marks sterling, respectively, from any sentences of excommunication etc., and rehabilitates him, and orders the above prior to summon those concerned, and unite etc. the said rectories for the lifetime of the said David, and thereupon to collate and assign them to him. The pope further dispenses him to receive and retain with them for life any other benefice, and without them any two [other] benefices, with cure or otherwise incompatible, even if dignities etc., or parish churches etc., and to resign them, simply or for exchange, as often as he pleases. Before the said prior proceeds to the execution of these presents the said David is to resign to him the said rectories. Sedis apostolice copiosa benignitas. (At the end: A. xxxii. Quintodecimo Kal. Julii anno sexto. de Petra.) [3 pp.]
