1 Sixtus IV.

De Prebendis Vacantibus.

1471.
5 Non. Oct.
(3 Oct.)
St. Peter's, Rome.
(f. 42r.)
To Niallanus Maccuharta, a canon of Derry (Deren.). Mandate, as below. The pope has been informed by Niallanus Oclocordig, clerk, of the diocese of Derry, that Cornelius Oduy, a canon of Derry, has committed simony and perjury, been convicted thereof and condemned, and been publicly excommunicated, but that he has celebrated masses, etc., in contempt of the Keys, thereby incurring [ir]regularity. The pope therefore orders the above canon, if Niallanus will accuse Cornelius before him, to summon the latter, and if he find the foregoing to be true, to deprive him of his canonry of Derry and prebend of Maguile therein, and remove him, and in that event to collate and assign them, value not exceeding 18 marks sterling, to Niallanus. Dignum arbitramur. (At the end: P. xx. Undecimo Kal. Novembris anno primo. de Varris.) [22/3 pp.]

To the prior of St. Mary's, Rathgeala, in the diocese of Limerick. Mandate, as below. Paul II was informed by Gerald [son] of Gerald Micruicsayn, clerk, of the diocese of Limerick, that Gerald Omwlchorchary, archdeacon of Limerick, was a public adulterer, had dilapidated the precious moveable goods of the said archdeaconry and converted them to his own adulterous and immodest uses, (fn. 2) had committed perjury, and had dilapidated the immoveable goods of the said archdeaconry, allowing its principal manor to be occupied by laymen, etc. The said pope therefore ordered a certain judge, under date Kal. July anno 7 [1 July, 1471], if the said Geraldus Geraldi would accuse the said Gerald Omwlchorchary before him, to summon the latter, and if he found the foregoing to be true, to deprive and remove him from the said archdeaconry, and in that event to collate and assign it, a nonmajor non-elective dignity with cure, value 60 marks sterling, to the said Geraldus Geraldi, the said pope specially dispensing him on account of illegitimacy, as a son of unmarried parents related in the fourth degree of kindred, notwithstanding which he had been made a clerk, to receive and retain it, and to resign it, simply or for exchange, as often as he pleased, and hold another benefice in its stead, provided that it were not a canonry and prebend or a major dignity in a cathedral or a principal dignity in a collegiate church. The said pope having died before his letters were drawn up, the pope hereby decrees that they shall hold good from the said date, and orders the above prior to execute them. Rationi congruit.
