1484. 5 Id. April. (9 April.) St. Peter's, Rome. (f. 112v.) |
To John Gaufridi, prior of the priory of St. Mary's Isle, Trail (de Insula Trayl), O.S.A., in the diocese of Whiteherne (Candide case). Collation etc., as below. His recent petition contained that on the said priory becoming void by the resignation of Robert [then prior thereof, now] abbot of Holyrood near Edynburgh, O.S.A., in the diocese of St. Andrews, to the then abbot and convent of Holyrood, to whom belong by ancient custom the admission of such resignation and collation and provision of the said priory, the said abbot and convent made collation and provision to the said John, who had been sufficiently dispensed by papal authority on account of illegitimacy, as the son of an unmarried man of baronial race and an unmarried woman, had been made a clerk after the said dispensation, and had made his profession of the said Order; and that in virtue of the said collation and provision he obtained possession. His said petition adding that he doubts whether the said collation and provision hold good, the pope, to whom the said Robert has also resigned this day all right, if any, still belonging to him, hereby makes collation and provision of the said priory (which is not conventual nor a dignity, depends on the said monastery and has been wont to be held by monks thereof, of whom the said John is one, is not elective and has cure of souls, and the yearly value of which does not exceed 45l. sterling) to the said John; whether void as above, or by the provision of Robert to the said monastery, or by his resignation of the priory, or in any other way; with mandate executory hereby to the provosts of St. Giles, Edymburgh, and St. John Baptist's, Corstorfin, in the said diocese of St. Andrews, and John Baptista de Ferrariis, a canon of Modena. Religionis zelus, vite etc. (In the margin: Apri.) [3 pp.] |
7 Id. April. (7 April.) St. Peter's, Rome. (f. 116r.) |
To Thomas Gra[n]ston, abbot of Geduort, O.S.A., in the diocese of Glasgow. Provision to him, who is a canon of St. Andrews, O.S.A., is a member of the pope's household, and a continual commensal of Raphael, cardinal deacon of St. George's in Velabro, and is by both parents of noble birth, of the above monastery of Geduort, void by the death of abbot John without the Roman court, during whose life it was specially reserved by the present pope, the election by the convent of William Rofer (fn. 1) (recte Forstar), a canon thereof, and his confirmation or provision by authority of the ordinary, made after and against the said reservation, being hereby decreed null and void; with concurrent mandate hereby to him, to undertake the rule and administration, etc., and to the convent and to the vassals and subjects of the monastery, to accept him as abbot and obey him, etc. Inter sollicitudines. |
Simili modo to James, king of Scots. Gratie divine. (In the margin: Aprilis.) [4¾ pp. See below, f. 211r. See also Reg. Vat. DCXLIV, f. 244v., below, p. 172.] | |
1484. Non. April. (5 April.) St. Peter's, Rome. (f. 134r.) |
To the archdeacon of Cashel (Casalen.), the precentor (preceptori, recte precentori) of Waterford (Wat[er]forden.), and Richard Eluarde (?), (fn. 2) a canon of Cashel (Casalen). Mandate to collate and assign to Robert Edian, clerk, of the diocese of Ossory, (whom the present bishop of Ossory lately dispensed by his ordinary authority on account of illegitimacy, as the son of the then archdeacon of Cashel and an unmarried or a married woman, to be promoted to all minor orders, and who in virtue thereof has been made a clerk), the archdeaconry of Ossory, a non-major dignity, value 60 marks sterling, void by the resignation of Patrick Odriniri (?) to John, bishop of Ossory; summoning and removing Thomas Porchel, clerk, who has detained possession for between two and three years without any title, and whom Robert cannot safely meet in the city or diocese of Ossory. He is hereby dispensed to be promoted to all, even holy orders and hold the said archdeaconry, notwithstanding the said defect, etc. Vite etc. (In the margin: Apri.) [5½ pp.] |
6 Kal. May. (26 April.) St. Peter's, Rome. (f. 211r.) |
Monition and mandate, as below. On the voidance of the monastery of Geduorde, O.S.A., in the diocese of Glasgow, by the death of abbot John without the Roman court, during whose life it had been specially reserved by the present pope, he made provision of it to Thomas Granscon’ (recte Granston’) [now] abbot thereof [above, f. 116r.] The pope, therefore, having learned that William Forstar, a canon of the said monastery, alleging that he was elected by the convent, has intruded himself and detains possession, hereby declares, motu proprio, that the said election was and is null and void, and monishes the said William and convent, the vassals and other subjects of the said monastery, and all others, intruded or to be intruded in the monastery and its annexed priory of Restenet, O.S.A., in the diocese of St. Andrews, and their aiders and abettors, etc., within six days after these presents come to their knowledge, namely, the said William to give up possession of the said monastery and priory to the said Thomas (who has made his profession of the said Order, is a member … in Velabro [as above, f. 116r], the pope's chamberlain), and the said vassals etc. to be answerable to Thomas, and not to assist William or other intruders, etc., under pain of excommunication, etc.; with mandate executory hereby to the bishop of Glasgow, Brechin and Galloway (Galuidien? ). Ad fut. rei mem. (Officii nostri debitum.) [6 pp. See above f. 116r. See also Reg. Vat. DCXLIV, f. 244v., below, p. 172.] |
1483. 7 Id. Nov. (7 Nov.) St. Peter's, Rome. (f. 283r.) |
To Master Peter de Herrera, a papal chaplain and auditor. Mandate, as below. The recent petition of Walter Monipenni, a canon professed of St. Andrews, O.S.A., contained that a cause lately arose between him and John Elbron, clerk, about the priorship of the said monastery, wont to be governed by a prior, the said Walter alleging that on its voidance by the death of prior William Cameron without the Roman court he was elected by the convent, that the election was confirmed by the then archbishop of St. Andrews, and that the said John unjustly opposed and prevented the election etc. from taking effect, whilst the latter alleged that the priory lawfully belonged to him; and that the cause was at Walter's instance committed by the pope, although it had not lawfully devolved to the said court, to the above auditor, who has taken certain proceedings. At the said petition, which added that it is alleged that neither Walter nor John has a right in or to the priory, the pope hereby orders the said auditor, if as a result of the suit he find that neither has such right, to collate and assign the priory (which is conventual and, as some allege, a major dignity in St. Andrews, and the prior of which wears the mitre and pastoral staff, gives solemn benediction, takes precedence of the abbots of the realm in processions and other acts, (fn. 3) and exercises jurisdiction over the canons of the said monastery, and the value of which does not exceed 1200l. sterling) to Walter, whether it be void as above or in any other way, and whether it be reserved generally, because (as some allege) the said William, when holding it, was a papal acolyte, and whether it be elective and have cure, etc. Religionis zelus, vite etc. (In the margin: Aprilis.)
