To the abbot of Londonderry (Cella nigra) in the diocese of Derry (Derren.), and Roger Macconmigy and Magonius Ocuagearll (?), canons of Derry. Mandate, as below. The pope has been informed by John Occaidigan (?), clerk, of the diocese of Derry, that Donald Okerbullan, rector of Furmaigy in the said diocese, has, when under sentence of excommunication, celebrated masses and other divine offices, wittingly and in contempt of the Keys, etc. The pope, therefore, hereby orders the above three, if John will accuse Donald before them, to summon the latter, and if they find the foregoing to be true, to deprive and remove him, and in that event to collate and assign the said rectory, value 8 marks sterling, to John. Mandate to collate and assign to Nicholas Williams, rector of Twyford in the diocese of Norwich, priest, the parish church of Snoryng Magna in the same diocese, of lay patronage and value 24 florins of the Camera, void by the death of Thomas Smyth at Milan, when on his way to the Roman court; the said right of patronage being specially and expressly departed from for this turn only. Mandate to collate and assign to Maurice Oschichayn, priest, of the diocese of Ardfert, the perpetual vicarage of Vanys alias Liathmuoyn, in the diocese of Cork, value 7 marks sterling, so long void that there is no certain knowledge of the last mode of voidance, and that its collation has by the Lateran statutes lapsed to the apostolic see, although Donald Oconichuur, priest, of the said diocese, who is to be summoned and removed, has detained it for between one and two years, under pretext of a collation made by the ordinary after the said lapse. Absolution (the pope having this day ordered provision to be made to him of the abbey of Holyrood (Sancte Crucis) near Edinburgh, O.S.A., in the diocese of St. Andrews), from all sentences of excommunication, suspension etc., to the end only that the said provision may take effect. Apostolice mansuetudinis. |
Simili modo to Robert, abbot of Holyrood, etc. Provision, as below. Upon the said monastery becoming void by the resignation, made to William archbishop of St. Andrews, and admitted by that archbishop by his ordinary authority, of Archibald, during whose abbacy it was specially reserved by the present pope, the convent, in ignorance of such reservation, as is believed, elected the said Robert, who, likewise in ignorance, consented to the election and had it confirmed and himself blessed by the said authority, but, upon learning the said reservation, has caused the matter of the election to be set forth before the pope in consistory. The said election being therefore null and void, the pope hereby makes to the said Robert, who is prior of St. Mary's Isle, etc. (as above), in priest's orders, provision of the said abbey. To the abbot of Scone (de Schona) in the diocese of St. Andrews, the treasurer of the church of Dunkeld (?) (thesaurario Duhncen.,? recte Dunkelden.), and Thomas Cranston', a canon of the church of St. Andrews. Mandate, as below. The recent petition of David Lion, priest, of the diocese of St. Andrews, contained that on the voidance of the chapel of Fergundene in the diocese of Dunkeld, (fn. 6) of the patronage of the temporal lord of Glames in the diocese of St. Andrews, by the death of William Olinfan (?) at the apostolic see, the said David was presented by the patron, Alexander, temporal lord of the said place, to the bishop of Dunkeld, but that he has not been instituted nor had possession. The said petition adding that he doubts the validity of the said presentation, and the pope having learned that the said chapel is still void as above, he hereby orders the above three to collate and assign it, without cure and value 8l. sterling, to David. To the abbot of Y and the prior of Orwansay, in the diocese of Sodor (Sedonen.), (fn. 7) and the archdeacon of Sodor (Sodonen.). (fn. 7) Mandate, as below. The pope has been informed by Eugenius Fercharde, clerk, of the diocese of Sodor, that Eugenius Britii, priest, bargained with the late Angus, bishop of Sodor, that if the bishop would make him provision of a benefice in the city or diocese of Sodor he would pay him a sum of money, thereby incurring simony and the sentences of excommunication, etc. therefor; that on the parish church of St. Fyncheanus in Mule, in the said diocese, becoming void, the said bishop, after receiving the said sum, made him collation and provision thereof, under pretext of which he obtained and still detains possession, dilapidating, moreover, and dissipating its moveable goods. The pope, therefore, hereby orders the above three, if Fercharde (who was lately dispensed by authority of the ordinary on account of illegitimacy, as the son of unmarried parents related in the simple third degree of affinity and the double fourth degree of kindred, to be made a clerk, after which he was so made a clerk) will accuse Britii before them, to summon him, and if they find the foregoing to be true, to deprive and remove him, and in that event to collate and assign the said church, value 5 marks sterling, to Fercharde, The pope hereby dispenses him to be promoted to all, even holy and priests orders, and receive and retain the said church, and to resign or exchange it, as often as he pleases. To the bishop of Girgenti (Agrigentin.), the abbot of the monastery of SS. Chuanus and Broganus, Mothel (de Mothalia), in the diocese of Lismore, and Maurice Oronayn, a canon of Lismore. Mandate, as below. The recent petition of William Ymoryssa, clerk, of the diocese of Lismore, contained that provision was canonically made to him of the perpetual vicarages of Fydwn and Carryg in the diocese of Ossory and Lismore, and that he was dispensed on account of illegitimacy, as the son of the abbot of a monastery of St. Augustine and an unmarried woman, to be promoted to all holy, even priest's orders, and receive and retain for life the said vicarages or any two benefices with cure or otherwise incompatible with one another, etc., and any other benefices with and without cure, compatible with one another and with the foregoing benefices; that in virtue of the said dispensation he had himself promoted to all minor and subdeacon's orders, and in virtue of the said provision obtained the said vicarages, and has detained them for four years without being ordained priest and without dispensation for the purpose. Seeing that the said vicarages are therefore void, and that, as the pope has learned, the rectory of Celomoc in the diocese of Ossory is also void, and has been so long void that its collation has lapsed to the apostolic see, although John Odady (?), priest, has detained possession without any title, (fn. 8) the pope hereby orders the above three (seeing that, on account of the inordinate favour which the said John enjoys in the diocese of Ossory, William has no hope of obtaining justice therein) to summon the said John and others concerned, and if they find that the said rectory is void, to create a new (fn. 9) canonry in the church of Ossory, erect the said rectory, value 6 marks sterling, into a prebend, and unite thereto for William's lifetime the said vicarages of Fydwn and Carrig, value 10 and 6 marks sterling, respectively, and, in the event of their so doing, to collate and assign such canonry and prebend to William.
