To Thomas Porcell, [bishop] elect of Lismore and Waterford. Provision to him, a canon of Ferns (who is in priest's orders and of lawful age, and is illegitimate, being the son of a bishop and an unmarried woman related in the third or more remote (fn. 1) degree of kindred, and who holds a canonry and prebend of Ferns, value 20 marks sterling) of the united churches of Lismore and Waterford, void at the apostolic see, and therefore reserved, by the resignation to the pope of John, now bishop in the universal church, made by his proctor John Suwod (recte Sirwod), archdeacon of Richmond in York, orator of Richard king of England to the pope; with indult that even after he has been consecrated, and has obtained possession of the said united churches, he may retain in commendam therewith, as long as he is bishop thereof, the said canonry and prebend, notwithstanding the said defect, etc.; with letters hereby to the archbishop of Cashel, to the chapter of the said united churches, and to Richard king of England. To the same. Faculty for him, to whom the pope has recently made provision of the above united churches, to be consecrated by any catholic bishop of his choice in communion with the apostolic see, assisted by one or two like bishops, and for the said consecrating bishop to receive from him the usual oath of fealty according to the form enclosed: if not, the said bishop shall be eo ipso suspended from the exercise of the pontifical office, and both he and Thomas from the administration of their churches. The consecrating bishop shall without delay send the said oath to the pope by Thomas's (tuas) letters patent sealed with Thomas's (tuo) seal, by his own (proprium) messenger (fn. 2); without prejudice to the archbishop of Cashel, to whom the said united churches are by metropolitical right subject. To the abbot of St. Mary's de Petra, in the diocese of Kilmacduagh (Duacen.). Mandate, as below. The recent petition of Matthew Mayida Machnamarra, priest, of the diocese of Killaloe (Laonien.), contained that (after Paul II's renewal and reservation to himself of absolution from all sentences of his predecessors against simoniacs), upon a threat of litigation between him and John Ograda, clerk, of the said diocese, about the perpetual vicarage of Kilocenedig in the said diocese (provision of which on its voidance had been made to the said Matthew by papal authority), he bargained with Nicholas, also Ograda, clerk, of the said diocese, John's father, that if John would leave him in peaceable possession he would pay him a portion of the fruits as a yearly pension, as a result of which bargain he obtained possession and has paid the said portion for some time, whereby he has incurred simony and excommunication therefor. The pope, therefore, having learned that the said vicarage is void, and has been so long void that its collation has lapsed to the apostolic see, hereby orders the above abbot to absolve Matthew, enjoining penance, dispense him on account of irregularity, and rehabilitate him, and thereupon to collate and assign to him the said vicarage, value 6 marks sterling. Mandate to collate and assign to Odo [son] of Donald (fn. 5) Macnamara, clerk, of the diocese of Killaloe, the perpetual vicarage of Konylsolgoilue [sic] in the said diocese, value 3 marks sterling, so long void that its collation has lapsed to the apostolic see, although John Oflannura, priest, of the said diocese, who is to be summoned and removed, has without any title detained possession of it for between seven and ten years. (fn. 6) Mandate to reserve to their gift, for collation to Dermit Obrien, (fn. 7) clerk, of the diocese of Killaloe, if found fit, a canonry of Killaloe and the prebend of Inisckay, value 30 marks sterling, which are to become void by the pope's promotion of Theoderic, [bishop] elect of Killaloe, to that church, and by the consecration which is to be conferred on him, although Donatus Macmahona, clerk, who is to be summoned, has for between five and seven years held possession of a portion of the fruits etc. thereof without any title. To John Broun, a monk of Melros, O.Cist., in the diocese of Glasgow. Transferring him, motu proprio (seeing that the pope intends this day to appoint him, a Friar Preacher, to be coadjutor to Richard, abbot of the above monastery, who is old and a leper, and to make him provision thereof, if void, or when it shall become void by the resignation or death of the said Richard) from his said Order to the said monastery, and receiving him as a monk thereof, the pope's will being that as soon as these presents come to his knowledge he shall wear the same habit as is worn in the said monastery, and the pope hereby giving him the said habit, so that he may of himself assume and wear it, without its being given to him in any other way, and may conform himself to the regular institutes of the said monastery; with mandate hereby to the said Richard and the convent to receive him as a monk, etc. De statu personarum. |

Simili modo to the same. Appointing him (seeing that the above abbot Richard is old and has been for several years (fn. 8) a leper, and therefore unable to exercise the rule and administration of the above monastery, which the present pope lately reserved to his gift), who is a priest, and whom the pope has this day transferred from the Order of Friars Preachers to the said monastery, and whom he has received as a monk thereof, etc., to be coadjutor to the said abbot, and making provision to him of the said monastery, if already in any way void, or when it shall become void by the resignation or death of the said abbot. Before he begins to exercise the said office of coadjutor, he is to take the usual oath to exercise it faithfully, according to the form enclosed, to the bishop of Girgenti (Agrigentin.), the abbot of Paisley in the diocese of Glasgow, and the official of Glasgow, who are hereby ordered to cause him to be admitted to the said office, etc. The pope hereby grants that he may be blessed by any catholic bishop of his choice in communion with the apostolic see, who shall thereafter receive his oath of fealty according to the form enclosed, and send it without delay to the pope by his own letters patent sealed with his own seal, by his own messenger. To the archdeacon, the provost, and the official of Kilmacduagh (Duacen.) Mandate, as below. Upon the treasurership of Kilmacduagh lately becoming void at the apostolic see by the death there of John Odonchw, the pope, learning that it had already become and was void, and holding the true way of its last voidance as being expressed, ordered provision to be made of it, howsoever void, to Brandan Olyga, priest, the letters of provision making no mention that it had become void by the death of the said John at the said see, as above, under pretext of which Brandan had provision made to him, got possession, and has detained it for some time, without any title. The said letters being therefore surreptitious, and the treasurership being still void, as above, and consequently reserved, under the pope's reservation of all dignities etc. void at the said see, he hereby orders the above three to summon the said Brandan, and if they find that the said letters were surreptitious, to declare them null and void, and, in the event of their doing so, to grant the said treasurership, a non-major dignity, value 6 marks sterling, in commendam for life to Eugenius, abbot of St. Mary's de Petra, O.S.A., in the diocese of Kilmacduagh, the fruits etc. of which do not exceed in value 4 marks sterling, with which he cannot maintain himself, etc., removing the said Brandan.
