To James Lindesay, [bishop] elect of Varna (Dionisien.). Provision to him, vicar-general of the Order of Friars Minors in Scotland, professed of the said Order, bachelor in theology and in priest's orders, of the said church, void in a certain way (not here expressed). As soon as he has had the present letters expedited, he is to betake himself to the said church and to reside therein in person, and shall be unable to exercise pontifical offices without the city and diocese of Varna. To the same. Dispensation to him (to whom the pope has this day made provision, etc., as in the preceding), seeing that he cannot without danger go to the said church, which is in the parts of the infidels, that he shall not be bound to go thither and reside therein, and that, after he has been consecrated, he shall be able to exercise pontifical offices alike in the city and diocese of St. Andrews, and in others, when requested by the ordinaries, and with their special licence. Motu proprio reservation to him (to whom the pope has this day made provision etc., as above), of a yearly pension for life of 100l. of the usual money of Scotland, equal to 20l. sterling, on the fruits etc. of the [parish] church[es] of Scowinbb [? recte Scowin et] Adayl, united to the archiepiscopal mensa of St. Andrews, and on the other fruits etc. of the said mensa; to be paid by William, the present archbishop (who has consented), and by his successors, half at Whitsuntide and half at Martinmas, in the city of St. Andrews; with the usual sanctions for nonpayment, etc. Personam tuam.

Mandate, etc., as below. The late Donald, bishop of Ross [in Ireland], having decided to resign his church to the present pope, appointed a proctor for the purpose, who made the resignation to the pope, in ignorance that Donald had meanwhile died; and the pope, having admitted the resignation, made provision of the said church, as being void by the said resignation, to Odo, [now] bishop. Subsequently the pope, upon learning the true way of voidance, namely, by the death of Donald before the said resignation, decreed that Odo's letters of provision should hold good from the date thereof, and that the provision itself and also Odo's consecration (fn. 1) and his administration etc. as bishop should also be valid, as if provision had been made to him of the said church as being void by Donald's death. Recently, however, upon being falsely informed that the said church had become and was still void by the said death, the pope made provision thereof, as being so void, and without any mention being made of the foregoing circumstances, to Thady Macari, clerk, of the diocese of Cork, by both parents of noble birth and in his twenty-seventh year. The pope has since learned from John archbishop of Cashel, Matthew bishop of Killaloe, Thomas bishop of Limerick and Philip bishop of Emly, and the dean, precentor, chancellor, treasurer, chapter and canons of Ross, that Thady, with the help of lay power, has despoiled Odo (who had been consecrated by the said archbishop and bishops, and had been unanimously received and recognised by them and the said chapter, and by the clergy and people of the city and diocese of Ross, in provincial councils of Cashel and elsewhere as bishop, had exercised the office of bishop for about nine years in peace, and had received without hindrance the fruits etc. of the episcopal mensa) of the rule and administration and of the goods of the said mensa, and intruded himself, as he still does, to the grave hurt of the said Odo, who has therefore with great labour and expense and peril of the roads, come in person to the apostolic see. The pope, therefore, hereby admonishes and orders Thady and his abettors, etc., whosoever they be, and the said chapter, clergy, people, and other persons of the said church, city and diocese, etc., ecclesiastical and lay, under pain of excommunication, deprivation, interdict, etc., within six days after these presents come to their knowledge, namely, the said Thady to desist from his intrusion etc., his abettors etc. to desist from giving him aid etc., and Thady and his abettors etc. and the others above mentioned to admit Odo or his proctor to corporal possession of the rule and administration of the said church of Ross (fn. 2) and of its goods, and permit him to exercise the cure and administration in spirituals and temporals as formerly, and restore to him possession of the said church and its goods, etc. If Odo and the canons obedient to him cannot safely stay at the said cathedral church, the pope hereby transfers the chapter to such other church in the diocese as shall seem good to Odo or his proctor, etc. Ad fut. rei mem. Mandate to collate and assign to Thomas Ross, clerk, of the diocese of Moray (who is a continual commensal member of the household of Mark, [cardinal] bishop of Palestrina, and who was lately dispensed by papal authority on account of illegitimacy, as the son of a priest and an unmarried woman, to be promoted to all, even holy orders and hold a benefice even with cure, after which the present pope dispensed him to hold any mutually compatible benefices with and without cure, even if canonries and prebends, dignities, etc., and to resign or exchange them, etc., and who has since been made a clerk), the perpetual vicarage of Conuenuciy (? recte Conncuuciy) in the said diocese, value 8 marks sterling. Motu proprio reservation to him (who was lately dispensed by papal authority on account of illegitimacy, as the son of a priest and an unmarried woman, to be promoted to all, even holy orders and hold a benefice even with cure, after which he was made a clerk), of a benefice with or without cure, value 8 or 6 marks sterling accordingly, even if a dignity, etc., in the gift of the bishop and the dean and chapter etc. of Dromore; with special dispensation hereby to hold such dignity, etc., notwithstanding the said defect, etc. Vite etc.
