To the prior of Iniscronan in the diocese of Killaloe (Laonien.), and Donatus Qograydh [sic] and John son of Thady (Johanni Thathei) Macnamara, canons of Killaloe. Mandate to collate and assign to Laurence Macnoyerhyne, perpetual vicar of Clonlochan (fn. 1) in the diocese of Killaloe, who is by both parents of noble birth, the perpetual vicarage of Kyllansuyllach (recte Kyllnasuyllach) in the said diocese, value 8 marks sterling, so long void that its collation has lapsed to the apostolic see, although Laurence Omachayn, (fn. 2) priest, who is to be summoned and removed, has without any canonical title detained possession for between six and eight months. He is hereby dispensed to receive and retain it for life with the said vicarage of Clonlochan, value 4 marks sterling, and to resign or exchange them, etc. Nobilitas generis, vite etc. (In the margin: Apri.) Mandate to collate and assign to Cornelius Oberynd, clerk, of the diocese of Killaloe (Laonien.), who was lately dispensed by papal authority on account of illegitimacy, as the son of a nun professed of the Order of St. Augustine and an unmarried man, to be promoted to all, even holy and priest's orders and hold a benefice even with cure, the perpetual vicarage of Glundagut in the said diocese, value 8 marks sterling, void, and therefore ipso facto reserved, by the promotion of Thady, bishop of Killaloe, to that church, and by his consecration performed by the pope's order at the apostolic see; and also the rectory of the united parish churches of Ochorinth in the said diocese, value 12 marks sterling, void because Donald Oborynd [sic] held it for more than a year without being ordained priest, and without dispensation; summoning and removing Laurence Ogriffa, clerk, whom Cornelius is afraid to meet in the city and diocese of Killaloe, and who, under pretext of a collation by authority of the ordinary, and without canonical dispensation, has detained possession of the said vicarage and rectory for between a month and a year. Mandate to collate and assign to Donatus Macrach, a canon of the monastery of St. Peter and Paul de Forgio alias de Clar, O.S.A., in the diocese of Killaloe (Laonien.), who was lately dispensed by papal authority on account of illegitimacy, as the son of an abbot of the Order of St. Augustine, in priest's orders, and an unmarried woman, to be promoted to all, even holy orders and hold a benefice even with cure, and who has been promoted to all holy, even priest's orders, the parish church of Cloenforses, [in the diocese of] Kilfenora (Fynnaboren.), value 4 marks sterling, void by the death of Nicholas Margillissarta without the Roman court; summoning and removing Patrick Ohanrahanyn, priest, of the said diocese of Kilfenora (Fynnaboren.), who has without any canonical title detained possession for between one and three years. To Walter Balath, Dermit Olanru, and John Ocullayng, canons of Tuam. Mandate, as below. The recent petition of Walter de Burgo, clerk, of the diocese of Tuam, contained that after he had been made a clerk, notwithstanding his illegitimacy as the son of an unmarried nobleman and an unmarried woman, Donatus, archbishop of Tuam, made to him by his ordinary authority, without his having any dispensation ad hoc, collation and provision of a canonry of Tuam, and that on the voidance of the rectory of the parish church of Lochmesg in the said diocese, of the patronage of laymen, the patrons nominated him, without his having any dispensation, for presentation thereto, and that under pretext of the said nomination he took possession of the said rectory, value 6 marks sterling, and has held it for six years. The pope has furthermore been informed by him that Riscerdus, abbot of St. Mary's, Cong, O.S.A., in the said diocese, has dilapidated and alienated and turned to his own uses the immoveable goods thereof. He therefore orders the above three to cause Walter (whom the pope hereby rehabilitates on account of the foregoing, and who has resigned the said canonry and rectory) to be received as a canon of the said monastery of Cong, give him the regular habit and receive his profession, and moreover, if he will accuse the said Riscerdus before them, to summon the latter, and if they find the foregoing to be true, to deprive and remove him, and in that event to make provision of the said monastery, value 50 marks sterling, to Walter. The pope hereby dispenses him on account of the said defect, etc., and grants him indult to be blessed by any catholic bishop in communion with the apostolic see; without prejudice to the archbishop of Tuam, to whom the said monastery is by ordinary right subject. To the bishop of Meath, and the abbot of St. Mary's, Kilcooly (de Aurichamo, recte Arvicampo), in the diocese of Meath. Mandate, as below. It was lately set forth to the pope on behalf of Benedict de Salutatis, Leonard de Vernatiis, Alexander de Bardis, John Tolomei, and the late Francis de Pazzis, (fn. 4) merchants of Florence at the Roman court, and Laurence Mathei, a citizen and merchant of Rome, that they lent to the late John Fayhales, (fn. 5) a Friar Minor, archbishop of Armagh, then elect of that church, the sum of 1100 gold florins of the Camera, under the usual bonds etc., and that the said archbishop-elect expended the said sum for the expediting of the apostolic letters concerning the giving of the pallium (fn. 6) and for the prosecuting of his promotion; and that, after the said merchants had learned that he had died without the Roman court, without having had possession of the rule and administration of the goods of the said church, and without the said sum having been paid to them, a doubt was raised whether the successor of the said John and (fn. 7) the archiepiscopal mensa of Armagh remained bound (fn. 8) to make satisfaction in respect of the said sum to the said merchants, who feared lest they might be hindered by indirect means in regard to the exaction of the said sum. The pope, therefore, at the petition of the said merchants (who alleged that they had borne the said debt for about three years), declared that the successor of the said John for the time being was bound to make satisfaction, etc., as if he had himself contracted the said debt, and ordered Stephen, then cardinal priest of St. Adrian's, now of St. Mary's in Trastevere, to compel him to make satisfaction. The said merchants, therefore, summoned before the said cardinal the said John's successor, Edmund, then archbishop of Armagh, [now] archbishop in the universal church, and, after the cardinal had taken certain proceedings, the said archbishop and merchants agreed to choose as arbitrator the said cardinal, who put forth an award by which he condemned archbishop Edmund to pay the said sum in the city of London within the next three years to John de Bardis and the partners aforesaid, viz. a moiety to the said John de Bardis at London within the next eighteen months, and the other moiety at the end of the said period. Subsequently the said Edmund resigned, without having paid the said sum, and provision was made to Octavian, who, although he obtained possession and was Edmund's successor, refused to pay the said sum. The pope, therefore, at the petition of the said merchants ordered by other letters the above bishop and abbot to summon Octavian, and (unless he proved that satisfaction had been fully made to the said merchants) assign to him a term within which to make such satisfaction and, if he refused to do so, after the lapse of such term to interdict him from entering the church, the pope also himself so interdicting him, and, in the event of his being contumacious for a month, to suspend him from divine offices and from the rule and administration of the said church, the pope also himself so suspending him in the said event, and, in the event of the said archbishop being contumacious for other ten days, to sequestrate the fruits etc. of the archiepiscopal mensa to the amount of the said sum, make satisfaction therefrom to the said merchants, and maintain the sequestration until such satisfaction had been made or an amicable agreement had been come to with the said archbishop. The recent petition of the latter contained that it is unbecoming and unjust that at the instance of the said merchants, who are not his creditors, (fn. 9) and on account of a debt contracted on behalf of another person, he, a bishop, (fn. 10) should suffer interdict and suspension, and that the said fruits etc. should be sequestrated; and alleged that the said John and Edmund did not present their letters of promotion, did not make satisfaction to the Camera, and never obtained possession of the said rule and administration, and that on account of wars etc. the said church is much impoverished and is so much in debt that he can hardly maintain himself and bear his burdens. The pope, therefore, at the said petition, hereby inhibits the above two judges and any others to proceed against the said archbishop, church and mensa, and orders the said two, under pain of eo ipso interdict etc., if they find what the said archbishop has set forth to be true, to restore him to the state in which he was before the pope's said letters were addressed to them, decree that he is not bound and cannot be compelled to pay the said debt, and that he cannot on account of such non-payment be interdicted etc., nor the said fruits etc. sequestrated, and absolve him, if necessary, from any sentences, etc., enjoining penance, in the measure of his fault, (fn. 11) etc. Humilibus supplicum votis. To the prior of Ynyscronan in the diocese of Killaloe (Laonien.). Mandate, as below. The pope has been informed by Lucan Ocoray, clerk, of the diocese of Killaloe, that William Ohogayn, priest, of the said diocese, who was in possession of the precentorship of Killaloe, and Maurus Ohuraly, priest, of the said diocese, who claimed it, agreed that Maurus should leave William in peaceable possession, and that the latter should give him every year a sum of money or part of the fruits etc., which was done; and the pope lately, upon being informed of the foregoing by John son of Matthew (Johannem Mathei) Machomari (recte Macho[n]mara), ordered the said William and Maurus, if the said John would accuse them and the foregoing should be found to be true, to be deprived and removed from the said precentorship and all right in or to it, as is contained in other letters, in which the said John alleged that the value of the precentorship did not exceed 8 marks sterling. The pope, therefore, hereby orders the above prior, if Lucan (who, notwithstanding his illegitimacy as the son of unmarried parents related in the simple third degree of affinity and the third and fourth degrees of kindred, has been made a clerk) will accuse the said William and Maurus before him, and if he find that, as Lucan alleges, the value of the said precentorship does not exceed 12 marks sterling, to summon William and Maurus, and if he find the facts to be as stated, to deprive and remove them from the precentorship and all right in or to it, and to declare the said letters surreptitious, and in that event to collate and assign the said precentorship, a non-major dignity with cure, to which a prebend is annexed, to Lucan, who is hereby dispensed to receive and retain it, notwithstanding the said defect, etc., provided that within a year he be promoted to the subdiaconate. To John Oculayn, Walter Klach [sic], and Malachy Omale, canons of Tuam. Mandate, as below. The recent petition of Thady Vhalutayn, clerk, of the diocese of Tuam, contained that once when he was in the company of some armed men a fight took place, in which two men were killed, but that he himself wounded neither of them, (fn. 12) and that he was afterwards dispensed by authority of the ordinary, on account of illegitimacy as the son of a clerk and an unmarried woman, to be promoted to minor orders, and subsequently by papal authority to be promoted to all, even holy orders and hold a benefice even with cure, in virtue of which he was made a clerk, and obtained by authority of the ordinary collation and provision of the perpetual vicarage of Maygrays in the said diocese of Tuam, without having obtained any other papal dispensation on account of the foregoing, and has held it for between one and two years, also without being promoted to any holy order, taking the fruits to a value of one mark sterling. The said vicarage being therefore void, and the pope having learned that a canonry of Tuam and the prebend called the prebend of the small churches of Conquincaile and Conquinemara in the said diocese are void because Eymundus de Burgo has contracted marriage per verba de presenti, he hereby orders the above three to absolve Thady from the guilt of homicide, enjoining penance, and dispense him on account of irregularity, dispense him to be promoted to all holy orders and minister therein, except in the ministry of the altar, (fn. 13) and rehabilitate him, and in the event of their doing so, to collate and assign him the said canonry and prebend and vicarage, value 12 and 3 marks sterling, respectively, and to unite the vicarage to the canonry and prebend [for as long as he shall hold the latter]. (fn. 14) He is hereby dispensed on account of the said defect, etc., to receive and retain the said canonry and prebend, and is to resign the said vicarage before they proceed to execute these presents. To Walter Bunch, abbot of St. Eruardus's (sic) alias St. Mary's, Belmerinach, O. Cist., in the diocese of St. Andrews. Provision to him (who is a licentiate in theology, and holds the priory of Du(n)bog, of the said order and diocese, value 30l. sterling) of the monastery alias the chapel of St. Eruardus etc. (as above), value 100 marks sterling, so long void that its provision has lapsed to the apostolic see, whether it be still void by the death of Richard Cowyntie, some time abbot, or in any other way; with concurrent mandate herewith to the bishop of Dunkeld, the abbot of Scone in the diocese of St. Andrews, and the treasurer of the church of St. Hermès de Renaix (sancti Hermitis Rothnacensis) in the diocese of Cambrai. The pope hereby grants him indult to be blessed by any catholic bishop of his choice in communion with the apostolic see, who shall thereafter receive his oath of fealty according to the form enclosed, and shall send it by his own (suas) letters to the pope, sealed with his own (suo) seal, by his own (proprium) messenger. To Nicholas, son of Denis (fn. 15) de Ripa, a canon of the monastery of St. Mary, Tristernagh alias Chilvvischi, O.S.A., in the diocese of Meath. Collation and provision of the parish church of St. John Baptist or [St. John] the Evangelist de Galbiat(e) in the diocese of Milan, of lay patronage, value 75 gold florins of the Camera (from which John de Vierana, priest, of Imola, has by papal authority a yearly pension of 25 of the said florins), the commenda whereof, held by papal grant by John Antonius, bishop of Alessandria, who holds by the pope's order the place of a papal auditor, has ceased by the said bishop's resignation of it to the pope this day, so that the said church is void in the same way as before the said commenda was granted; with mandate executory hereby to the bishop of Orte, John Baptista de Ferrariis, a canon of Modena (Mutinen.), and the vicar-general of the archbishop of Milan.
