To John Felayn, a canon of Ferns, nuncio of the pope and collector of the papal Camera throughout all Ireland. Appointing him, during the pleasure of the pope and the apostolic see, papal nuncio and collector-general in the provinces of Armagh, Dublin, Cashel and Tuam, and throughout all Ireland; with the usual privileges, faculties and powers, etc. He is to take the oath of fealty to Raphael, cardinal deacon of St. George's in Velabro, the pope's chamberlain. To the abbot of Kirieleyson in the diocese of Ardfert. Mandate, as below. The recent petition of Donatus Macmothona, clerk, of the diocese of Killaloe (Laonien.), contained that the present pope ordered Brandan, abbot of Rathoa in the diocese of Ardfert, to summon Theoderic Obrien, clerk, (fn. 1) and if he found to be void the canonry of Killaloe and prebend of Yniskate therein which the said Theoderic was then holding, to make provision thereof to the said Donatus; that the said abbot delivered a definitive sentence by which he made collation and provision to Donatus, removed Theoderic, and inducted Donatus; that Theoderic appealed to the apostolic see, and that at his instance the pope committed the appeal to John son of Thady (Johanni Tatei) Macnamam (recte Macmamnan), a canon of Killaloe, who delivered an unjust definitive sentence by which he revoked the said former sentence; that Donatus appealed therefrom, and that at his instance the pope committed the appeal to the above abbot; and that, before the commission was presented to him, the said Donatus and Theoderic agreed that the cause should be suspended for a certain time, which is not yet expired. (fn. 1) The said petition adding that Donatus fears that the agreement was for the purpose of deceiving and injuring him, in order that the term for prosecuting his appeal might lapse, and that it is alleged that neither he nor Theoderic has any right in or to the said canonry and prebend, the pope hereby orders the above abbot, when the said commission is presented to him, and when the end of the agreed suspension arrives, to restore Donatus to the state in which he was before the said agreement, proceed to the execution of the said commission, and if in the event of the suit he find that neither Donatus nor Theoderic has such right, to collate and assign the said canonry and prebend, value 30 marks sterling, to Donatus. To the priors of St. John Baptist by (iuxta) Lenenach and Lorrha (Fontis vivi de Lochra), in the diocese of Killaloe (Laonien.), and John Ofaelan, a canon of Ferns. Mandate, as below. The recent petition of William Omeara, clerk, of the diocese of Killaloe, contained that on the voidance of the chancellorship of Killaloe, a non-major dignity with cure, the present pope ordered provision to be made to him thereof, and dispensed him (already dispensed by papal authority on account of illegitimacy, as the son of a priest and an unmarried woman, to be promoted to all, even holy orders and hold a benefice with cure) to receive and retain it. At his said petition, which added that he got provision made to him of the said chancellorship in virtue of the said letters, obtained possession, and has held it for between one and two years, but doubts whether the said letters are surreptitious (because no mention was made in them that the said priest his father had made his profession of the Order of St. Augustine and was warden or prelate of a monastery of that Order), and whether, therefore, the said provision and dispensation hold good, the pope hereby grants that the said letters and their consequences shall nevertheless hold good from the date of these presents, and orders the above three to collate and assign the said chancellorship, non-elective and value 12 marks sterling, to the said William; with dispensation on account of the said defect, etc. Vite ac morum. To Nicholas Whyt and Philip Okerog, canons of Ossory, and Malachy Odollane, canon of Kildare (Daren.) dwelling in the diocese of Ossory. Mandate, as below. The conventual priory of Fyrkearan (recte Syrkearan), O.S.A., in the diocese of Ossory, is void by the deprivation of Nicholas Omayngchayn by John, bishop of Ossory, by his ordinary authority, and is reserved to the pope under his late reservation of all conventual priories; and the pope has been informed by Cornelius Macgillaphoyll, clerk, of the diocese of Killaloe (Laonien.), that Rory Maccoscy, perpetual vicar of Maydrythnyht in the said diocese, has, not in ignorance, openly and publicly celebrated divine offices in places under interdict, The pope, therefore, hereby orders the above three to cause the said Cornelius (who alleges that he has been dispensed by papal authority on account of illegitimacy, as the son of a priest, who had made his profession as a canon of the said Order, and an unmarried woman, both nobles, to be promoted to all, even holy orders and hold a benefice even with cure; that he has taken an oath not to seek to obtain the said vicarage against the said Rory; and that the said Nicholas has detained possession of the said priory without any title for between five and ten months since his deprivation) to be received as a canon of the said priory, give him the regular habit and receive his profession, and moreover, if Cornelius will accuse the said Rory before them, to summon both Nicholas and Rory, and if they find the foregoing to be true, to deprive Rory and remove him, and to collate and assign to Cornelius, after he has received the habit and made his profession, the said priory, with cure and value 40 marks sterling, and moreover, in the event of their making the said deprivation and removal, to grant to him the said vicarage, value 12 marks sterling, to be held by him in commendam for life with the said priory, removing Nicholas as well as Rory. Cornelius is hereby dispensed to receive and retain them, and not to be bound for seven years to be promoted to deacon's or priest's orders by reason of the said priory, whilst studying letters in an university; notwithstanding the said defect, etc. Sedis apostolice.
