To the archbishop of Cashel. Mandate, as below. The recent petition of Nicholas, bishop of Lismore and Waterford, contained that the pope lately made him provision of the said united churches, on their voidance by the resignation to the pope of John, now bishop in the universal church, and that he has obtained possession, but that the dean, etc. of Waterford, especially James Risse and John Bottiller, laymen, citizens of the said city (alleging that the said resignation did not take place, and that Nicholas does not understand the English language, and cannot speak it intelligibly), refuse to receive him as bishop. The pope, therefore, hereby orders the above archbishop to compel them to receive Nicholas as bishop of Waterford, obey him, and restore to him all fruits etc. taken from the episcopal mensa from the time of the said provision, etc. Ad personam venerabilis fratris nostri. To the priors of St. Mary's, Killagh (de Bello loco) and St. Michael's, Ballinskellings (de Rupe), [both] O.S.A., in the diocese of Ardfert, and the archdeacon of Aghadoe (de Achadeo) in Ardfert. Mandate to collate and assign to Donatus Offalue, clerk, of the diocese of Ardfert, the perpetual vicarage of Kylcumin in the said diocese, value 12 marks sterling, so long void that its collation has lapsed to the apostolic see, although Donatus Oleyn, priest, of the said diocese, who is to be summoned and removed, has without any canonical title detained possession of it for some years. To the bishops of Raphoe, Clonfert and Achonry. (fn. 1) Mandate, as below. The recent petition of Donald (fn. 2) Oduda, prior, called the master [and the friars] of the house of Balemouta, of the Order of St. Francis, called [the Order] of Penance, in the diocese of Achonry, (fn. 3) contained that Donatus Macdonkayd, layman, of the said diocese, attacked (fn. 4) with his accomplices the said house and its church, to which a certain chapel is subject, burned the said house and seventeen stacks (?) of corn, (fn. 5) as well as the town (villam) in which it is situate, drove the friars into exile, and violently despoiled them of all their goods. At the petition of the said master and friars (which added that although the said Donatus afterwards pretended to repent, and promised to make satisfaction to the said Donald and friars, he has not only not done so, but has injured them as much more as he could; and that Bernard Macdonkayd (fn. 6) has been wont to impose unlawful cesses and tributes on the said master and friars and their servants), the pope hereby orders the above three to summon Donatus and Bernard, and their accomplices, and compel them under penalty of excommunication etc. to make satisfaction to the said master and friars; with faculty to absolve and enjoin penance on them, absolution in case of contumacy being reserved to the pope and his successors. To Carbricus Oberind, a canon of Elphin. Grant in commendam for life to him (who alleges that he was dispensed by authority of the ordinary on account of illegitimacy, as the son of a canon, then also prior of a conventual priory of the Order of St. Augustine and in priest's orders, and an unmarried woman, related in the third and third degrees of kindred and the third and fourth degrees of affinity, to be made a clerk and hold a benefice without cure, after which he was made a clerk and was elected a canon of Elphin (fn. 7); that he is of race of dukes; and that the fruits etc. of the rectory of Tyrbruyn in the diocese of Elphin, (fn. 8) called a prebend, without cure, provision of which the pope lately ordered to be made to him, are not worth more than 10 marks sterling a year, and are insufficient to maintain him) of the priory of St. Mary, Kyllmoyrnasina, in the said diocese, O.S.A., conventual, with cure and elective, dependent on no other monastery, and value 20 marks sterling, provision of which, on its voidance by the resignation by proxy of Cornelius Yberind to the present pope, before which it had been reserved to the papal gift, the pope on 19 Kal. Jan. anno 12 (14 Dec. 1482) granted to Thady Ocynaid, priest, of the diocese of Clonfert, who has this day given up the said grant to the pope before the letters thereof were drawn up, so that the said priory is still void and reserved; provided that the disposal thereof belong to the pope for this turn, and that the convent consent; with mandate executory hereby to the bishop of Raphoe, Walter Blacke, canon of Tuam, and the official of Elphin. Mandate to collate and assign to Dermit Omagnay, perpetual vicar de Castroco(n)hatuy (sic) in the diocese of Kellala, a canonry of Killala and the prebend called Killhanle, value 1 mark sterling, void by the death without the Roman court of Nellanus Odubda; although Murianus Mackillcacan, priest, who is to be summoned and removed, has without any canonical title detained possession of them for between one and two years. Grant in commendam for life to him (who is by both parents of noble birth, and who cannot be maintained with the too slender fruits etc. of the said archdeaconry, a non-major dignity, value 16 marks sterling) the priory of St. Catherine, Ehacdrui(m) Omaine, O.S.A., in the diocese of Clonfert, a conventual dignity with cure, nonelective and dependent on no other monastery, value 40 marks sterling, void at the apostolic see by the resignation to the pope of Carbricus Maghaid; with mandate executory hereby to the prior of St. Mary's, Clonatuascerta Omane, O.S.A., in the said diocese, and Charbricus Oberny (?) and Walter Blac, canons of Elphin and Annaghdown.   • 5. cum decem et septem cumulis bladorum; but if ‘tumulis’ be read the meaning may be seventeen fields of standing corn. The word ‘tomulo’ is still used in the sense of a land measure, as well as in that of a grain measure, in Sicily and South Italy. See, e.g., Du Cange.
  • 6. It is not explained who he was.
  • 7. in canonicum ecclesie Elphinen. electus fuisti. Presumably the canons of Elphin were normally appointed by election.
