Confirmation, motu proprio, of the recent erection by the ordinary into a collegiate church, at the instance of the patron, Richard duke of Gloucester, brother german of Edward king of England, and in honour of Our Lord Jesus Christ and His most glorious Mother the Virgin Mary and St. Alkilda the Virgin, of the parish church of Middelham in the diocese of York, in the archdeaconry of Richmond, and of the reasonable statutes made and to be made therefor. To the bishops of Chichester and Norwich, and the archdeacon of Richmond. Mandate, as below. The recent petition of William Rosse, a Carmelite friar of the English province, contained that lately, (in virtue of a faculty by the pope to certain commissaries appointed by the master and convent of the hospital of St. John of Jerusalem for the defence of the Christian faith and the Island of Rhodes against the Turks), he was absolved from homicide and other grave sins etc., and from consequent sentence of excommunication, and that he desires to serve God in the orders which he has received and in the ministry of the altar, and to celebrate masses for the souls of the departed, etc. At the petition of the said William (who has come in person to the Roman court at great labour and peril) and that of Edward, king of England, the pope hereby orders the above three to dispense him, who is a priest, on account of any irregularity contracted on account of the foregoing, dispense him to minister in all his orders, even in the ministry of the altar, after a year's suspension therefrom, and rehabilitate him. To the archbishop of Patras (Patracen.), the dean of Dunkeld, and the official of St. Andrews. Mandate, as below. The recent petition of Duncan Bully, priest, of the diocese of St. Andrews, M.A., contained that on the voidance of the archdeaconry of Dunblane by the death without the Roman court of Walter Stewart, a papal acolyte, before which it had been reserved to the pope's gift, provision was made thereof by papal authority to the late Alexander Rate, clerk, of the said diocese, a continual commensal member of the pope's household, and by authority of the ordinary to Andrew Purwes; that the cause which arose between them was committed to a papal auditor, and that whilst the cause was pending, and without making mention thereof, Alexander (in virtue of a papal faculty to resign or exchange his benefices) resigned the archdeaconry and all right to it, without having had possession, in the presence of John Boner, clerk, of the same diocese, public notary by imperial authority, and other witnesses, to William Lauder, a canon of Dunkeld, who admitted the resignation, and made collation and provision of the archdeaconry as being thus void to John Rant (? recte Kant), a canon of Abbernethy in the diocese of Dunblane, in virtue of the authority contained in the said faculty; that the said John, without having had possession of the archdeaconry, resigned all right in or to it to William, archbishop of St. Andrews, who admitted the resignation under a commission from John, bishop of Dunblane; and that the said Andrew (who was then in possession) and Duncan exchanged with one another the said archdeaconry and the rectory of Kynnell in the said diocese of St. Andrews, the exchange being carried out by the said archbishop William, who in respect of the archdeaconry had special faculty from the said bishop of Dunblane. Seeing that in accordance with the foregoing the said archbishop's collation and provision of the archdeaconry to Duncan are without force, and seeing that, as the said petition added, Alexander has died, and that, as the pope has learned, the archdeaconry is still void, as above, he hereby calls up the said cause to himself and extinguishes it, and orders the above three to collate and assign to the said Duncan (whom the late Andrew, bishop of Glasgow, under a special papal faculty, dispensed on account of illegitimacy, as the son of a priest and a married woman, to be promoted to all, even holy orders and receive and exchange, etc., two compatible benefices, even if one had cure, etc., after which the present pope dispensed him to receive and resign etc., any other compatible benefices, etc.), the said archdeaconry, a non-major dignity, value 20l. sterling, whether void as above by the deaths of the said Walter or Alexander, or by the resignation of the said Walter, Alexander, John Cant and Andrew, or in any other way. The recent petition of Duncan Bully … contained that … Alexander … resigned the archdeaconry … without having had possession (as in the preceding (fn. 1) ); that John Cant resigned his canonry and prebend of the church of Abbirnethi in the diocese of Dunblane, an exchange of the said two benefices then taking place in virtue of the above-mentioned faculty to exchange (ibid.); that the said John, likewise without having had possession of the archdeaconry, resigned all right to it to William, archbishop of St. Andrews, who admitted the resignation under a commission from John, bishop of Dunblane; and that the said Andrew (who was then in possession of the archdeaconry) and Duncan exchanged with one another the said archdeaconry and the rectory of Rinnell (recte Kinnell) in the said diocese [of St. Andrews], the exchange being carried out by the said archbishop William, who in respect of the archdeaconry had special faculty from the said bishop of Dunblane.
