1436[-7]. 5 Id. March. Bologna. (f. 34d.)	To Hugh Vythyrspune, an Augustinian canon of Holyrood, Edynburgh, in the diocese of St. Andrews. Reservation to the pope's gift, for collation to him, who is a priest, by these present letters, which the pope wills to hold good as if they had been granted under the date of 8 Kal. May anno 1 [1431], of a benefice with or without cure, wont to be governed by canons of St. Andrews or Holyrood, even if it be a priory or a dignity, not being conventual, or be a claustral office, and even if such priory, dignity or office be elective, and even if such benefice have cure, (fn. 2) value not exceeding 30 marks sterling, in the gift of the bishop and the prior and chapter etc. of St. Andrews and the abbot and convent of Holyrood; with decree that, as soon as by vigour of these presents he obtains possession of a benefice wont to be governed by canons of St. Andrews, he is to be transferred to that church and to be received as a canon thereof. 1437. Non. Nov. Bologna. (f. 47d.)	To the bishop of Moray, the abbot of Cupar in the diocese of St. Andrews and the archdeacon of Hainaut in Liége. Mandate, at the petition of Patrick Piot, rector of the Bethlehemite hospital of St. Germains, of the order of St. Augustine, in the diocese of St. Andrews, containing that the said hospital, wont to be assigned to secular clerks as a perpetual benefice, having become void by the death of Richard Langlandis, was by papal authority granted in commendam for life to the late Dominic, bishop of Bethlehem, and that, on the death of the said bishop, collation and provision thereof were made by the same authority to the said Patrick, but that, nevertheless, Archibald Laurencii, clerk, of the said diocese, making a false claim, prevented the said collation etc. from taking effect; that the present pope, at Patrick's instance, committed the cause between them, although not lawfully devolved to the Roman court, to Master Peter Martini de Caueisrubeis, a papal chaplain and auditor, who by a definitive sentence declared the said collation etc. to have been and to be canonical, adjudged the hospital to Patrick, and imposed perpetual silence on Archibald, condemning him in the costs, which he afterwards assessed at 26 florins of gold of the camera. At Patrick's said petition, adding that he fears lest Archibald will not obey the said sentence and the processes to be make by vigour of these presents, the pope orders the above three to publish the aforesaid, where and when expedient, induct Patrick, and remove any unlawful detainer, causing satisfaction to be made to Patrick in respect of fruits and the said costs, invoking the aid of the secular arm, etc. Exhibita nobis. 10 Kal. Sept. Bologna. (f. 55.)	To John Goldesburgh, Augustinian prior of St. Mary's, Marton, in the diocese of York. Dispensation, at his petition (containing that the said priory, which was formerly opulent, has by divers calamities which have afflicted those parts become so poor that the prior and convent cannot easily be maintained and pay episcopal dues etc.) so that he, who was lately, when a canon of the said priory, dispensed by papal authority, notwithstanding his illegitimacy as the son of unmarried parents, to receive and hold any dignities etc., even if such dignities were priories of the said order, may receive and hold in commendam for life with the said priory any other benefice with or without cure, wont to be governed by secular clerks, even if of lay patronage, and if a parish church etc., and convert its fruits to the uses of himself and of the said priory, and may resign it, simply or for exchange, as often as he pleases. 1436. 8 Kal. June. Bologna. (fn. 3) (f. 123.)	To the abbots of Kynlos, Cupar and Balmorynach, in the dioceses of Moray, Dunkeld and St. Andrews. Mandate as below. The pope exemplifies his letters Inter solicitudines varias, addressed to Laurence, abbot of the Cistercian monastery of Culros in the diocese of Dunblane, and dated at Bologna, in the year of the Incarnation 1436, 8 Kal. June anno 6, which have emanated this day, (fn. 4) making provision to him, a Cistercian monk of Balmorynach in the diocese of St. Andrews, in priest's orders, a minor penitentiary of the pope and the Roman church and a papal chaplain, of the said abbey of Culros, void by the death of John, during whose life it was specially reserved by the pope [above, p. 613]. At the recent (nuper) petition of the said abbot, containing that he fears to be hindered from obtaining peaceful [possession] of the administration of the goods of the said monastery, the pope orders the above three to induct the said abbot or his proctor into the said possession, and defend him therein, removing any detainer, etc., invoking the aid of the secular arm, etc. Hodie (fn. 4) nostre emanarunt. 1437. 10 Kal. Nov. Bologna. (f. 152.)	To the bishop of Clonfert. Mandate, at the recent petition of the prior general and friars of the order of St. Mary of Mount Carmel—containing that in a certain place called Monteceancohe in the diocese of Elphin, where a venerable sign of the Cross (venerabile signum crucis) was found sixty years ago, a number of faithful built an oratory, but without assigning to it any possessions or rents, and that William, bishop of Elphin, and Donald, temporal lord of the said place, gave the said oratory and place to the said prior and friars, in order that they might therein celebrate divine offices and build a house and a church—if he find the facts to be as stated, to grant to the said prior and friars faculty to receive the said oratory and place, and to build a house and a church with bell-tower, bell, dormitory, refectory, cloister, cemetery, gardens, orchards and other necessary offices.Sacre religionis. Dispensation, notwithstanding his illegitimacy, as the son of a married nobleman and an unmarried woman, to be elected etc. to any dignities, even abbatial, [or] priories, even (et[iam]) conventual, and administrations and offices of the said order, even if they be elective and have cure. Dispensation to hold for life any benefice with or without cure, wont to be governed by secular clerks, even if a parish church or a perpetual vicarage, and if of lay patronage, and to resign it, simply or for exchange, as often as he pleases. 17 Kal. Dec. Bologna. (f. 184d.)	To the chancellor of Killaloe. Mandate, at the recent petition of Cornelius Macgillapoyl, an Augustinian canon of St. John's by le Naenach in the diocese of Killaloe—containing that after he had obtained, collated to him by papal authority, the parish church of Rosscre in the said diocese, he held it, after the lapse of a year, for about another year without being ordained priest; and that, after Thomas Macgrayth, [now] a canon of the said monastery, had freely resigned before notary and witnesses the priorship thereof, which is conventual and has cure, the said Cornelius, being still a secular, simonically got himself postulated as prior by the convent, who believed that the monastery was void by the said resignation, thereby incurring the sentences etc. against simoniacs, and, having made his profession as a canon of the said monastery, under pretext of the said postulation took possession of the said priorship and has detained it for about six years, getting himself ordained meanwhile subdeacon and deacon—after Cornelius has resigned, to absolve him from the said sentences etc., enjoining penance, and rehabilitate him. Mandate, recapitulating the preceding, seeing that the said postulation is invalid, after making the said absolution etc. and after Cornelius has duly resigned, to admit his resignation, and if he find him fit, to collate and assign to him the said priory, which depends on no monastery or other regular place, value not exceeding 50 marks sterling, whether it be void by the said resignation, or by the death of William Umegra, or in any other way.
