Lateran Regesta, Vol. CCCIII (fn. 1)

De Prebendis Vacantibus

1431.
5 Id. June.
St. Peter's, Rome.
(f. 139.)
To the abbot of St. Mary's, Inishlounaght (de Surio), in the diocese of Lismore, and the archdeacon and precentor of Lismore. Mandate to collate and assign to Richard Scadan, clerk, of the diocese of Lismore (who has studied canon and civil law for about six years at Oxford, and who was lately dispensed by papal authority, as the son of an unmarried man and an unmarried woman, to be promoted to all, even holy orders and hold a benefice even with cure), the canonry and prebend of Merton in Lismore, value not exceeding 10 marks, void at the apostolic see, and therefore reserved, by the resignation of Robert Reve, made to the pope by David Oflin, precentor of Lismore, specially substituted as proctor for the purpose by Robert's proctor, the above Richard, who had special mandate for the purpose; David Odwyr, dean of Cashel, who has unduly detained the same for more than three years, being summoned and removed. Richard is hereby specially dispensed on account of the said defect. Vite etc. (B. and P. de Montella. B. xxiii. Sextodecimo Kal. Augusti Anno Primo. Valven.)
8 Id. May.
St. Peter's, Rome.
(f. 144.)
To the abbot of Kynlos and the prior of Urqhuard, in the diocese of Moray, and the official of Moray. Mandate as below. Martin V, on learning the voidance of the canonry and prebend of Moy in Moray by the resignation, made without the Roman court before John Oding, clerk, of the diocese of Paderborn, notary public, and witnesses, of the late Christopher Pontfret, ordered the dean of Moray and two others [not here named], if they found the said resignation lawful, to admit it by papal authority, and thereupon to collate and assign the said canonry and prebend, howsoever void, to Alexander de Casteltaris, priest, of the diocese of Glasgow [above, p. 113]. Subsequently, as the recent petition of Laurence Piot, priest, of the diocese of St. Andrews, contained, Walter Steuart, dean of Moray, admitted the said resignation, and made collation and provision, as void by the said resignation, to the said Alexander. The said canonry and prebend having become and being void by the resignation of the said Alexander, without having had possession, made to the pope by his proctor James Ragueta, clerk, of the diocese of Toul (Tullen.), the pope orders the above three to collate and assign them, value not exceeding 8l. sterling, to the said Laurence, summoning and removing Henry Heruy, priest, of the diocese of Aberdeen, bachelor of canon law, who took and has for more than a year and a half unduly detained possession, under pretext of a collation made to him by the ordinary after the date of the said letters and after the death of the said Christopher, who died less than two days’ journey from the Roman court; notwithstanding that by papal authority provision was lately ordered to be made to Laurence of the chancellorship of Dunblane, a non-major nonelective dignity with cure, and that provision was granted to be made to him of the perpetual vicarage of Tibermure in the diocese of Dunkeld, value not exceeding 20l. and 15l. sterling respectively, and that the pope recently ordered provision to be made to him of a benefice with or without cure in the gift of the bishops and the deans and chapters etc. of Dunkeld and Brechin, dispensing him at the same time to hold for two years such benefice, if it were with cure or were a dignity or a personatus, together with either the said chancellorship or vicarage. Vite etc. (An. and G. de Elten. An. xxv. Septimo Kal. Augusti Anno Primo. de Adria.)
1430[–1].
13 Kal. April.
St. Peter's, Rome.
(f. 155.)
To the bishops of Alet and Aberdeen and the treasurer of Aberdeen. Mandate to collate and assign to Ingram Lindesay, canon of Moray, licentiate of canon law (who was lately dispensed by papal authority, as the son of a baron, unmarried, and an unmarried woman, to be promoted to all, even holy orders and hold any mutually compatible benefices with or without cure, of any number and kind, and to resign them, for exchange or otherwise, as often as expedient, and to be eligible to the episcopal dignity), the precentorship of Moray, a non-major nonelective dignity with cure, value not exceeding 40l. sterling, to which a certain canonry and prebend are annexed, void by the death of Robert Stewart; whether it be so void, or by the death of John de Halyburton, or of John de Spineto, clerks, or in any other way, or by Richard de Crech's obtaining, by authority of the ordinary, the parsonage (personatus) of Herole in the diocese of St. Andrews; and notwithstanding that Ingram holds the canonry and prebend of Kynor in Moray, a canonry and prebend of Brechin, and the perpetual vicarage of Monckton in the diocese of Glasgow, value altogether not exceeding 38l. sterling. Upon obtaining the said precentorship, he is to resign, as he has offered, the said canonry and prebend in Moray and the said vicarage. Litterarum etc. (Pe. and H. Raiscop. Pe. xxv. Decimo Octavo Kal. Maii Anno Primo.de Casatiis.)
1431
Id. June.
St. Peter's, Rome.
(f. 245.)
To John de Hawyk, canon of Glasgow. Collation and provision (he and John Forstar having, with a view to exchange, resigned this day to the pope by their proctor Ingram Lyndesay, canon of Moray, their respective benefices, namely the rectory of Kylmane in the diocese of St. Andrews and the canonry and prebend of Kyrkmaqwo in Glasgow) of the said canonry and prebend, value not exceeding 50l. sterling, of the patronage of John Forster of Corstorfyn, knight, of the diocese of St. Andrews, who has consented. Apostolice sedis.
Concurrent mandate to the bishop of Alet, the dean of Glasgow and the treasurer of Aberdeen. Apostolice etc. (B. and N. Volrat. Pro H. Raiscop, Jo. Rode. B. xii. xiiii.Secundo Id. Julii Anno Primo. Valven.)
Id. July.
St. Peter's, Rome.
(f. 253.)
To the bishop of Cloyne, the prior of St. Mary's, Durmach, in the diocese of Meath, and the official of Clonfert. Mandate as below. Martin V made provision to William, [now] elect of Kildare, then a canon of Kildare, of that see, after which, as the pope has learned, the said elect, the papal letters in the matter of the said provision not having been drawn up, entered upon and still exercises the administration. Seeing that, if the aforesaid be true, the canonry and prebend of Ley in Kildare (fn. 2) are to be considered to have become and to be void on account thereof, the pope orders the above three to summon the said elect and others concerned, and if they find the facts to be as stated, to decree that the said canonry and prebend became and are void on account of the aforesaid, and in that event to collate and assign the same, value not exceeding 12 marks sterling, to David Oduynd, clerk, of the diocese of Kildare, who has studied at universities (in studiis) for about seven years, and who was lately dispensed by papal authority, as the son of an unmarried man and an unmarried woman, of a race of dukes and related in the fourth degree of kindred, to be promoted to all, even holy orders and hold a benefice even with cure, removing the said elect and any other; notwithstanding that provision was lately ordered to be made to him by papal authority of the rectory of Rossyndglaisce in the diocese of Kildare, value not exceeding 20 marks of silver [above, p. 200]. He is hereby specially dispensed, on account of the said defect etc., to receive and hold the said canonry and prebend, and to resign them and the said rectory, simply or for exchange, as often as he pleases, and hold instead two other compatible benefices. Vite etc. (An. and H. Raiscop. An. xxiiii. Nono Kal. Augusti Anno Primo. de Adria.) [See Cal. Lett. VII., p. 164.]
