Lateran Regesta, Vol. CCLXXV (fn. 1)

11 Martin V

De Beneficiis Vacantibus

1428.
9 Kal. Nov.
SS. Apostoli, Rome.
(f. 7.)
To Solomon Odubeanaych, rector of St. Eugenius's, Ardsracha, in the diocese of Derry. Grant as below. The pope lately [above, p. 267] ordered provision to be made to him (who had previously received papal dispensation, as the son of a priest and an unmarried woman, to be promoted to all, even holy orders and hold a benefice even with cure) of the above rectory, on its voidance by the death of Ysag Oculean. His recent petition contained that Cornelius Ochaemagayd, priest, of the said diocese, had before the pope's said mandate of provision unlawfully detained the said rectory for more than six years, and was still doing so; that Solomon, in his cause against Cornelius before two of the executors of the said mandate, gained a definitive sentence in his favour, and obtained possession of the rectory; and that he fears lest, inasmuch as the said mandate did not mention that Cornelius was detaining the rectory, he may suffer molestation. The pope therefore grants to Solomon (to whom he recently ordered provision to be made of the perpetual rectory (sic) of the parish church of Chepach in the said diocese, value not exceeding 8 [cf. p. 237] marks, dispensing him on account of the said defect to receive it, and to hold with it for life the above rectory of St. Eugenius's) that the said mandate of provision and the provision made to him in virtue thereof shall hold good from the date of these presents, notwithstanding the said omission. Vite etc. (Ri. xvi. Gratis pro deo in bulla et Registro de mandato domini nostri pape. Quinto Idus Nouembris Anno Undecimo. coldus.)

[De Beneficiis Vacantibus]

(f. 190d.)
To the bishop of Raphoe, and Nemeas Obeollayn and Laurence Obeollayn, canons of Killala (Aladen.). Mandate [to collate and assign to] Cormac Macdonnchaid, clerk, of the diocese of Elphin, who cannot have in the city and diocese of Achonry (Akaden.) a competent judge, the perpetual benefice called the rectory of Dacorand and Mota in the diocese of Achonry, value not exceeding 25 marks, which takes its name from no church, and is of the patronage of laymen, and which has been so long void by the death of Odo Oconchubair that its collation has lapsed to the apostolic see; although Donald Macdonnchaid, priest, of the diocese of Achonry, who is to be summoned [and removed], has detained possession for more than six years, under pretext of papal letters [see Cal. Lett. VI, p. 254] which contain no mention of the fact that the said benefice is of the patronage of laymen. Vite etc. (Unfinished and cancelled with strokes, without note.)

De Dignitatibus Vacantibus
1427.
15 Kal. Dec.
SS. Apostoli, Rome.
(f. 192.)
To the bishop of Adria, and the priors of the priories of St. John's, [Newtown by] Trym, and St. John's, Athyrde, in the dioceses of Meath and Armagh. Mandate to collate and assign to William Haddesors, priest, of the diocese of Armagh, I.U.B., who is a priest and of noble race, and who lately received papal dispensation, as the son of a married man and an unmarried woman, to be promoted etc. as above, f. 7, the archdeaconry of Armagh, a non-major non-elective dignity with cure, value not exceeding 20 marks, so long void by the death of Maurice Suetman that its collation has lapsed to the apostolic see; notwithstanding that the pope recently ordered provision to be made to him of the parish church of Derver in the diocese of Armagh, value not exceeding 16 marks, with which he is hereby dispensed to hold the said archdeaconry for life, and to resign both, simply or for exchange, as often as he pleases. Litterarum etc. (Pe. xxx. Octauo Kal. Decembris Anno Undecimo. de Casatiis.)
2 Kal. July.
SS. Apostoli, Rome.
(f. 220.)
To the prior of St. Mary's, Eachros, and the prior of Inysgluayr alias de Cros, in the diocese of Killala, and the official of Killala. Mandate to collate and assign to Laurence Obeollayn, canon of Elphin, bachelor of canon law—who lately received papal dispensation, as the son of a married man and an unmarried woman, (i) to be promoted etc. as above, f. 7, (ii) to receive and hold any dignities, major or principal, and to resign them, simply or for exchange, and to receive and hold instead similar or dissimilar benefices, and also to be promoted to any episcopal dignities [above, p. 445]—the provostship of Killala, a non-major elective dignity with cure, value not exceeding 20 marks, void by the resignation to the late Thomas, bishop of Killala, of Charles Ychannichy, removing John Bared, priest, of the diocese of Killala, who, after the said resignation, took possession without title, and has detained it for more than eight years; whether it became void as stated, or because the said John, when holding the deanery of Killala, obtained the provostship, and held both together for some time, or in any other way; notwithstanding that the pope recently [above, p. 436] made provision to Laurence of a canonry with reservation of a prebend and a dignity, not major, personatus, etc. of Elphin, and of a benefice with or without cure [value not here stated], in the common or several gift of the bishop and chapter of Killala, etc. He is hereby dispensed to hold two incompatible benefices for ten years. Litterarum etc. (Ja. xxviii. Tercio Non Julii Anno Decimo. de Cerretanis.) [See also above, pp. 91, 540.]
Kal. Nov.
SS. Apostoli, Rome.
(f. 266d.)
To Miles (Miloni) Roch. Collation and provision to him (who is of noble race, and to whom the pope intends to make provision this day of the perpetual vicarage of Kynsall in the diocese of Cork, value not exceeding 40 marks, and to dispense him to hold it for seven years with the deanery of Cork) of the deanery of Cork, a major dignity, value not exceeding 5 marks, his election to which by the chapter, on its voidance by the death of Richard Pellin, is null, the deanery having been reserved in virtue of the pope's late general reservation of all major cathedral dignities; notwithstanding that he holds the chancellorship of Cork, which, upon obtaining the deanery he is, as he has offered, to resign. Nobilitas generis, vite etc.
Concurrent mandate to the bishops of Adria and Ardfert and the archdeacon of Cork. Nobilitasdilectus filius Milo Roch … (Ja. xii. xiiii. Quarto Id. Nouembris Anno Decimo. de Cerretanis.)
