To the bishops of Alet and Frigento, and the official of Winchester. Mandate as below. The petition of Edmund Aldefordi, rector of Stoke in the diocese of Winchester, contained that he formerly obtained, by authority of the ordinary, the said church on its voidance by the resignation of Stephen Overton made to bishop Henry, and had held peaceable possession for some time when John Powle, rector of Aldenbi in the diocese of Lincoln, claiming Stoke, dispossessed him and himself still detains possession, wherefore Edmund appealed to the apostolic see; that at Edmund's instance the pope committed the appeal etc. to Master Peter Nardi, papal chaplain and auditor, who condemned the said dispossession, removed John and restored Edmund to possession, imposing perpetual silence on John and condemning him in fruits and costs, which latter he subsequently assessed at 21 gold florins of the camera. The said petition adding that Edmund fears that John will not obey the present letters and the above processes, the pope orders the above three to proceed to execute them, restoring Edmund and removing John, causing satisfaction to be made to Edmund in respect of the said fruits and costs, invoking the aid of the secular arm etc. Exhibita nobis.

To the bishop of Alet and the archdeacon and the chancellor of Limerick. Mandate to collate and assign to Cornelius Odygi, priest, of the diocese of Killaloe, the still void perpetual vicarage of Kyllmealayn in the diocese of Limerick, value not exceeding 6 marks; the said Cornelius doubting whether the collation and provision which he received from bishop Cornelius, on voidance by resignation to the said bishop of John Hwlchay, hold good. The collation is to be made whether the vicarage became void as stated, or by the death of Philip Mecheachayn, or in any other way. Vite etc. (Ja. xviii. Tercio Non. Mandate to collate and assign to Gillibertus Yleayn, canon of Limerick (who lately received papal dispensation, as the son of a priest and an unmarried woman, (i) to be promoted to all, even holy orders and hold a benefice even with cure, (ii) to hold two other mutually compatible benefices, after which dispensation he obtained by collation of the ordinary the canonry and prebend of Croch in Limerick, value not exceeding 20 marks), the still void perpetual vicarage of Croch, of the patronage of laymen, value not exceeding 8 marks, to which on its voidance by the resignation of Jordan Pursel made to bishop Cornelius, he was presented by James, earl of Desmond (comitem Decemonic), and instituted by the said bishop. He doubts whether the said presentation and institution hold good, because some assert that the vicarage became void, not as above, but by the death of Thomas Russel. Dignum etc. (Pe. xxi. To the bishop of Alet, and the chancellor and the treasurer of Limerick. Mandate to collate and assign to James Oleayn, priest, of the diocese of Killaloe, the still void perpetual vicarage of Inyskefryny in the diocese of Limerick, value not exceeding 6 marks, to which, on its voidance by the resignation of Edmund Micadam to bishop Cornelius, he (who had received papal dispensation, as the son of an unmarried man and an unmarried woman, to be promoted, etc. as above, f. 21d) was presented by John Kyndton, rector of Ballingarry (de Villa orti) in the diocese of Limerick, specially empowered by the ancient patron, William, (fn. 2) Augustinian abbot of Kynysan in the diocese of Bath, and was instituted by the said bishop. He doubts whether the said presentation and institution hold good. The collation is to be made whether the vicarage became void as stated, or because Gillabertus Ykatyl held it for more than a year without being ordained priest, or in any other way. To the bishops of Alet and Kilmore, and the official of Meath. Mandate as below. At a former petition of John Offyne, rector of St. Lonan's, Kyllebbellach (sic), in the diocese of Meath (setting forth that in his cause, long ventilated in the papal palace, against Hugh Trache, priest, of the diocese of Dublin, about the said church, provision of which had been made to him by papal authority, and of which Trache had unduly taken possession, he had won a definitive sentence by which the church was adjudged to him and perpetual silence imposed on Trache, and that he had impetrated letters of execution addressed by the pope to certain judges, but that he feared lest others might intrude themselves), the pope ordered the said judges to execute the said letters against such other intruders. At his recent petition (containing that after Trache had resigned the said church, and before the said execution was made, John Nuugent, priest, of the diocese of Meath, intruded himself and still detains possession, that he has remained excommunicate for more than a year, and has caused Offyne to be wounded, captured and imprisoned and plundered of divers muniments, in contempt of the apostolic see) the pope orders the above three to proceed to the further execution of the said letters and sentence, invoking the aid of the secular arm, and to publicly pronounce Nuugent excommunicate. To the bishop of Alet, and the archdeacon and John Joy, canon, of Tuam. Mandate as below. The recent petition of David Valentis, priest, of the diocese of Tuam, contained that on the voidance of the rectory of Lochmeassca in the said diocese, of the patronage of laymen, by Cornelius Macheagayn entering and making his profession as a canon of the Augustinian monastery of Holy Trinity, Ballintober (de Fonte Sancti Patricii), in the said diocese [see above, p. 275], he was presented to archbishop John by Nicholas Scondund (sic), Augustinian prior of the church of Dublin, asserting himself to have been empowered by the patron, Edmund earl of March, then absent, and was instituted by John de Burgo, archdeacon of Tuam, vicar-general in spirituals in absence of the said archbishop from his city and diocese; that in virtue of the said presentation and institution he obtained possession, taking the fruits; and that subsequently the said earl, on his return home, presented him again, after the lawful time, and that he continued, as he still does, to take the fruits, but now doubts whether the said presentation and institution hold good. The pope therefore orders the above three to collate and assign to him the said rectory, with cure, value not exceeding 8 marks, howsoever void, notwithstanding that he has lately ordered provision to be made to him of a benefice with or without cure in the common or several gift of the archbishop and the chapter of Tuam which, upon his obtaining the said rectory, shall be null as far as regards a benefice with cure only. To Cornelius Ogriffa, perpetual vicar of Bunrathy in the diocese of Killaloe. Grant as below. The pope lately [above, pp. 236, 237] ordered certain judges (not here named) to collate and assign to him the perpetual vicarage of Kyllmaellychry in the diocese of Killaloe, as being void because the late Matthew Macinnercheny held it for more than a year without being ordained priest and without dispensation, and dispensed Cornelius who, the son of a married man and an unmarried woman, had been promoted to the order of acolyte and to other minor orders, to minister therein and be promoted to all holy orders, and in the event of his obtaining the said vicarage, to resign it, simply or for exchange. At his recent petition—containing that some assert that the said vicarage, which he obtained by a collation made in virtue of the said letters, was at the date thereof void not as stated but otherwise, and was then and still is void, and that in consequence he, to whom the pope subsequently [above, p. 354] ordered provision to be made of the perpetual vicarage of Bunrathy, dispensing him to hold it and that of Kyllmaellychry together for life, fears molestation in respect of Kyllmaellychry —the pope grants to him, who is a priest, and holds the said vicarages, value together not exceeding 8 marks, that the said collation and its consequences shall hold good from the date of these presents, even if the said vicarage of Kyllmaellychry became void because the late David Oheny or Thomas Mackayla or John Oroddayn or Thady Oconnuyb held it for more than a year without being ordained priest, or became void in any other way. To the bishops of Alet and Dunblane, and the abbot of St. Thomas the Martyr's, Abirbrothok, in the diocese of St. Andrews. Mandate as below. The petition of John Boumaker, archdeacon of Teviotdale in Glasgow, contained that provision was formerly by papal authority ordered to be made to him of the said archdeaconry, void by the death of James Watson, but that William Croyser, clerk, of the diocese of Dunkeld, claimed it, and still prevents the said mandate from taking effect, and is in possession; that the cause, the said parties being then sufficiently present in the Roman court, was committed by the pope to Master John de Opiczis at Boumaker's instance, and then to Master John Walling, papal chaplains and auditors, the latter of whom gave a definitive sentence in favour of Boumaker, adjudging the archdeaconry to him, and removing Croyser, imposing perpetual silence on him and condemning him in the costs, which he subsequently assessed at 32 gold florins of the camera. The said petition adding that Boumaker fears that while the suit has been pending, others have intruded themselves or may do so, and that Croyser may refuse to obey the said sentence, the pope orders the above three to execute the preceding, inducting Boumaker and removing Croyser, etc. and to make execution against such intruders as if the said sentence had been delivered against them, invoking, if necessary, the aid of the secular arm. To the dean of Cloyne, the precentor of Ossory, and the chancellor of Limerick. Mandate to collate and assign to Henry Burnham, clerk, of the diocese of Norwich, who is by both parents of noble race, the archdeaconry of Lismore, a non-major dignity with cure, value not exceeding 10 marks, which he formerly obtained by collation and provision of the late John, bishop of Lismore, by his ordinary authority, as being void by the death of John Reve; it being asserted that it became void, not as stated, but by the promotion [above, p. 477] of Richard, bishop of Lismore, to that see and by his consecration, which took place by the pope's order at the apostolic see [see above, p. 473]; notwithstanding that the pope has lately ordered provision to be made to him of the rectory, called the plebania, of Dumgarvan in the diocese of Lismore, value not exceeding 40 marks, and dispensed him to hold it for life with the said archdeaconry, which he asserted that he was then holding, and to resign both, simply or for exchange.
