To the bishop of Ciudad Rodrigo (Ciuitaten.) and Donatus Okearbolan and Maurice Macblosgaid, canons of Derry. Mandate to collate and assign to John Okearbolan, priest, of the diocese of Derry, the rectory, value not exceeding 8 marks, of Dompnach Caidi in the said diocese, which, on its voidance by the death of Michael Okahan, John XXIII ordered [Cal. Lett. VI, p. 268] to be collated and assigned to John, who had received papal dispensation, as the son of a priest and a married woman related in the third degree of kindred, to be promoted to all, even holy orders and hold a benefice even with cure; it being asserted by some that the said rectory, collation of which John obtained in virtue of the said mandate, became void otherwise than as stated and is still void. To Master Peter Nardi, papal chaplain and auditor. Commission and mandate, as below, in behalf of Adam Knaygh, priest, of the diocese of Ossory alias Lismore, to whom (already dispensed by papal authority, as the son of a priest and an unmarried woman, to be promoted etc. as in the preceding, after which he obtained and subsequently resigned to the ordinary the perpetual vicarage of St. Nicholas's in the diocese of Waterford) the pope on 11 Kal. Sept. anno 1 [1418, above, p. 92], ordered the dean of Emly and two others [not here named] to collate and assign the archdeaconry of Ossory, void by the death of Thomas Herbryg, at the same time dispensing him to hold it. Adam's recent petition contained that John Penlyn, dean of Emly, proceeding alone, duly made collation and provision to him; that before dean John Adam brought Walter Stanton, [now] dean of Ossory, who was then in possession of the archdeaconry and claimed it, and who appealed from dean John to the apostolic see, obtaining thence letters addressed to the abbot of St. Saviour's, Dowsgy, in the diocese of Ossory, before whom he caused Adam to be cited; that after the abbot had proceeded short of a conclusion, Adam appealed from him to the said see, which appeal the abbot disregarded: that subsequently, whilst the suit was pending, the deanery of Ossory became void and the said Walter was elected dean, but refused to consent to the election unless Adam consented to his having the fruits etc. of the archdeaconry, of which he was still in possession, for two years, on the ground that the fruits etc. of the deanery were due for one year to the last dean, and for the second year to the episcopal mensa; that Adam refused, but consented that after Walter resigned to bishop Patrick his suit and his possession of the archdeaconry, the bishop should ordain whatever he thought fit; that Walter did so resign, and that the said bishop ordained that Adam should give up to Walter the fruits of the first year; that Adam consented, obtained the archdeaconry, and has had possession for about nine months, receiving none of the fruits, they being given up to Walter. The said petition adding that on the said date, 11 Kal. Sept., a suit was by commission of the present pope pending before the above auditor about the said archdeaconry between Maurice Coggeran, [now] precentor (cantor) of Ossory, and Adam Taylor, [now] archdeacon of Kildare (Daren.), and the late Philip Rokelef, William Pirron and William Purcellis, priests, of the dioceses of Limerick, Leighlin, Meath and Lichfield, each of whom claimed it; and that subsequently, while the said suit has been still pending, the said Maurice has obtained the precentorship of Ossory and Adam Taylor the archdeaconry of Kildare, both by authority of the ordinary, whilst the said Rokelef, Pirron and Purcellis have died, the pope hereby commits to the above auditor the appeal from the said abbot and the cause itself, and orders him to surrogate Adam to whatever right was possessed by each of the said Walter, Maurice, Taylor, Rokelef, Pirron and Purcellis etc., and if he find that neither Adam himself nor any of the others had any right, to collate and assign to Adam the archdeaconry itself, a non-major dignity with cure, value not exceeding 70 marks, whether it became void as above, or by the free resignation of Nicholas Haket, [now] treasurer of Cashel, or otherwise; notwithstanding that the pope has lately granted him provision of the canonry and prebend of Newcastle, Lyons (de Nouocastro de Lyonis) in Dublin and the rectory of Kylneygh in the diocese of Ferns, the former of which grants he has resigned at the apostolic see. He is hereby dispensed to hold the archdeaconry, upon obtaining possession of which under these presents, the said grant in respect of the said rectory shall be null. Vite etc. (Ja. xxxiiii. Mandate to collate and assign to Cornelius Magongayl, priest, of the diocese of Raphoe, the rectory of Inbernayle in the said diocese, value not exceeding 6 marks, collation and provision of which, on its voidance by the death of Laurence Mechinchrega, he received from bishop John by his ordinary authority. To Master John de Opiczis, papal chaplain and auditor. Mandate as below, at the recent petition of Nicholas Tunnok, canon of Ross, M.A. of Paris, priest, containing that a cause arose between the late Alexander Barberii, priest, and Thomas de Grenlaw, canon of Dunkeld, about the archdeaconry of Caithness, upon the voidance of which and its annexed canonry and prebend (because Alexander, [now] bishop of Caithness, sometime elect of Orkney, after receiving provision of Orkney from Benedict XIII did not have himself consecrated within the canonical time) the said Barberii claimed that he had received papal provision, Thomas claiming that the archdeaconry belonged to him; that the cause, although not lawfully devolved to the Roman court, was committed by the present pope, at the instance of Thomas, to the above auditor, and that whilst the suit has been pending before him Barberii has died. The pope orders the auditor to surrogate Nicholas to Barberii's right, if any, and moreover to collate and assign to him the archdeaconry itself, an office with cure, value with its said annexes not exceeding 40 marks sterling; notwithstanding that he holds a canonry and prebend of Ross and the parish church of Furvi in the diocese of Aberdeen, value not exceeding 12 and 16 marks respectively, and that the pope lately granted him provision of canonries with expectation of prebends of Aberdeen and Moray.
