Mandate at the petition of Richard Sywel, priest, of the diocese of Lincoln (who is at present in the Roman court and has to remain there for some time on certain business of his, and who states that when he was only in his thirteenth year he was fraudulently induced by certain enemies to enter the Cluniac priory of St. Andrew, Northampton, in which he assumed the monastic habit, but before completing (fn. 2) the year of probation refused to make his profession and left the said priory and abandoned the habit), if he find the facts to be so, to declare that he is not bound to the observance of the said or other religious order, but is free to live in the world. Reduction to 100 marks of the 300 marks which, by statute of Boniface IX [in Cal. Lett. V, pp. 529–531, here briefly recapitulated] each new canon of London has to pay on going into residence, bishop Richard having set forth in the pope's presence that the said sum of 300 marks is so far excessive that 10 or 12 years’ fruits etc. of the corps of a prebend are not enough, and that, as a result, of the thirty canons scarcely five reside. The said 100 marks shall be thus distributed:—each minor canon shall receive 20s., the sacristan, chamberlain, perpetual vicars and choir priests, 1 mark each, the clerks called choristers 5 marks among them, 20 marks shall be spent on the fabric of the old work, and the rest of the 100 marks on the conservation of the new work and on the betterment of the books, ornaments etc. for divine worship, according to the pleasure of the bishop and the dean and canons residentiary. Grant that his election to the see of Salisbury, made by the chapter when he was dean, on the voidance of the see by the death of bishop Robert in the castle of Gottlieben without the walls of Constance, during the Council of Constance and the voidance of the apostolic see, and the confirmation of the election by Henry, archbishop of Canterbury, by his ordinary authority as metropolitan, and his consecration, shall hold good as if the provision had not been, as he fears, reserved. As soon as he has had the present letters expedited, he is to take to the bishops of Bath and Bangor the usual oath of fealty according to the form which the pope is sending to them. On the alleged voidance of the rectory of St. Patrick's, Magmora, in the diocese of Meath, by the death of Donald Magluagii, he (who had received papal dispensation, as the son of a priest and an unmarried woman, to be promoted etc. as above, f. 86d) was (although Thomas Magluagii had obtained possession of it under collation made by papal authority as having become void by Donald's resignation made at the apostolic see and admitted there by papal authority) presented by the patrons, Margaret, prioress, and the convent of the Cistercian priory of St. Mary, Lochseudy, in the said diocese, to William Yonge, archdeacon of Meath, the see being vacant, who, after John had given for the purpose a number of presents to divers persons, instituted him. John, under pretext of the said presentation and institution, dispossessed Thomas, who, after bringing John, not by papal delegation, before bishop Edward, accepted from him a sum of money, and resigned before a notary public and witnesses the said suit and all right in or to the rectory, which John still detains, taking the fruits. Mandate (at the petition of John, bishop of Lichfield and Coventry, containing that sixty years ago the late Geoffrey de Wolseleye, clerk, with consent of the king and others, for the welfare of the souls of his parents and progenitors and all faithful, and to the praise of the Divine Name and the Most Blessed Virgin Mary, All Saints and all the heavenly court, founded and endowed with tenements etc. to the value of 5 marks, and with ornaments, books, chalices and other necessary utensils etc., a chantry in the church of Colewich in the diocese of Lichfield, for one chaplain; and adding that the said endowment has diminished so much in value that for several years mass and other divine offices have not been celebrated in the chantry, and that nobody is willing to reside, and that near the said chantry, on a bridge over which there is much traffic, a chapel of Holy Trinity has been newly built from the offerings of wayfarers, in which a chaplain celebrates mass every day, which bridge and chapel are kept up and chaplain maintained by alms) to appropriate to the said chapel the said chantry and all its endowment, the value of which does not exceed 2 marks a year. Alexander V granted letters whereby he ordered the bishop of London, as executor, to grant indult to the master and minor canons of the college of minor canons in the church of London (in which, besides the dean and chapter, are twelve perpetual beneficiaries called minor canons, of whom one is called master or warden, and two are called ‘cardinals’) that they and their successors, whilst residing in the said church, could take, without being bound to residence, the fruits etc. of all other benefices held by them in any other churches or places, the daily distributions alone excepted, as though resident therein, with the consent, however, of the diocesans, if the benefices had cure and were situate without the diocese of London, and that they could rent, let or farm, to clerks or laymen, the said fruits etc.; as is contained in letters of Baldassar, called John XXIII, Alexander V having died before his letters were drawn up. At the recent petition of the said master and minor canons (containing that each of them, under the oath which he has to take at his admission to his canonry and minor prebend, has to reside in the said church and be present at the canonical hours, day and night), the pope orders the bishop to grant to them that whilst residing in the said church they may take the fruits etc. of such benefices situate within and (fn. 5) without the said diocese, even if they have cure, in other respects as granted in the above letters, and that they may do so without requiring the consent of the diocesans or any other, and orders him to proceed, in this respect also, to the execution of the said letters, as if they did not contain the words ‘with the consent, however, of the diocesans, if the benefices had cure and were situate without the diocese of London.’ Deuotorum precibus. Relaxation of the oath which he took to accept the arbitration of the late Thomas, archbishop of Canterbury, in the suit, which had been introduced to the Roman court and long heard short of a decision by a papal auditor, between himself and the dean and chapter of London about the oblations made at (circa) a picture, situate in the nave of the cathedral church, of St. Mary the Virgin de Graciis, which oblations the bishop claimed for the episcopal mensa, and the dean and chapter for the capitular mensa, the said archbishop, deceived, having given an unjust decision.
