Indult—at his recent petition, containing that the dean and chapter and their stewards (senescalli) and other ministers and officers have unjustly taken away, and still take away from him, the moiety of certain oblations hitherto made and still being made in the said church, and a number of rights and emoluments due to him by virtue of his treasurership, a non-major dignity, and [due to him] for the continual burdens he has to bear by reason thereof; that they have imposed and still impose on him and his servants in the said church divers unwonted and heavy burdens, and divert to their exchequer (scachario) part of the portions or emoluments belonging to him and his said servants by virtue of his treasurership; on account of all which he is forced to go to law with them and their accomplices, but doubts whether he can lawfully or conscientiously absent himself in order to prosecute his suit on account of the oath of personal residence which he took as treasurer, in accordance with which oath he has resided continuously during seven years; his petition adding that the fruits etc. of his canonry and prebend, over and above the corpus, 6 marks, of the said prebend, consist solely and wholly in the daily distributions and a share of the meals (refectionibus), greater and lesser, firing and gratifications (necnon focalibus ac super excrescenciis), distributions for the anniversaries of the dead, and certain other things, [all] which are given only to canons who reside and are present at divine offices, and commonly exceed at present 80 marks; and that he fears that if whilst litigating against the dean and chapter he do not reside, which he probably cannot do without greater loss (dispendio) and scandal, they will in like manner take away his portion of the preceding—that whilst prosecuting his suit in the Roman court or elsewhere he shall not be bound to personal residence in the said church nor presence at divine offices therein; that he may meanwhile take the fruits etc. of his canonry and prebend and treasurership, and, with the same entirety as if resident, the portion which would fall to him of all the abovenamed daily distributions etc.; notwithstanding his said oath, the constitutions of Otto and Ottobon, the statutes and customs of Exeter etc. Litterarum sciencia, vite etc.
