Mandate to collate and assign to Peter Paul Sanse, alias Sansetta, the canonry and prebend of St. George's in Velabro, value not exceeding 40 gold florins, of which he received provision from John archbishop of Durazzo, as administrator of all void churches of cardinals, upon their resignation by Richard Possewik, made to the said archbishop at the apostolic see, through his proctor, Master Peter de Esculo, canon of Ascoli, writer of apostolic letters. The bishop's letters patent—Ad ecclesiam parochialem, of which exemplification is given, addressed to Richard de Docking, son of Adam de Dockyng, priest—are dated at Hoxne 15 Dec., 1388, the 19th year of his consecration. To the bishops of Monopoli and Worcester and the prior of Worcester. Mandate to collate and assign to Thomas Wybbe, priest, of the diocese of Worcester, the church of Hambury, in the same diocese, value not exceeding 50 marks, which he obtained by exchange with John Salwarpe for the perpetual vicarage of Malmesbu[r]y, in the diocese of Salisbury, by authority of bishop Henry, who had power from John, bishop of Salisbury. Thomas now doubts whether the collation and provision hold good. The mandate is issued notwithstanding that the pope has lately ordered provision to be made to him of canonries of Abergwill and Hereford, with the respective prebends, then void and value not exceeding 30 marks, of Landalandaweylok, and Norten, possession of which he has not yet obtained, and of a canonry of Hereford with expectation of a prebend. To Master Branda de Castellione, papal chaplain and auditor. Mandate motu proprio to surrogate Thomas Weston, canon of York, licentiate of civil law, to whatever right John Mandour, canon of Wells, at the time of his obtaining the parish church of Faustede, in the diocese of London, had to the archdeaconry of Durham, value not exceeding 240 marks; and, if he find that neither Weston nor Mandour has any such right, to collate and assign it to the former. Upon a cause arising lately and being lawfully introduced into the apostolic see about the said archdeaconry between Marinus, cardinal deacon of New St. Mary's— who claimed that papal provision thereof had been made to him upon its voidance through the deprivation by Urban VI of
Pileus, bishop of Tusculum—and the above Mandour and the late Hugh de Herle, clerk, who each claimed it, it was successively committed by Urban VI. to John, [now] bishop of Hereford, and to the late Henry Godeborn, then papal chaplains and auditors. Whilst the cause was before Godeborn Urban VI died, and the present pope successively committed it to Masters John de Dulmen, Richard Jong, and Nicholas, [now] bishop of Ferentino, chaplains and auditors, before the last of whom it was pending when Herle died. The pope thereupon ordered Nicholas to surrogate cardinal Marinus to Herle's right, but before this was done Marinus resigned the same to the pope, who thereupon ordered Nicholas to surrogate Weston—to whom Walter, bishop of Durham, perhaps in ignorance of the suit that was pending, had made provision by his ordinary authority of the archdeaconry as void by the death of Herle—to Herle's and the said cardinal's right, and if he found Herle and the cardinal to have had, and Mandour to have, no right to the archdeaconry, to collate and assign it to Weston. Before Weston had been so surrogated the pope committed the cause to Master John Preue, chaplain and auditor, who carried out the surrogation, and then to the above Master Branda, who is now ordered to surrogate, etc. as above. To the dean, archdeacon, and Gerald FizMoris, canon, of Cloyne. Mandate to collate and assign to Henry Carthynt, priest, canon of Limerick, the canonry and prebend of Culewyne in Cloyne, value not exceeding 12 marks, which became void by the resignation, made to bishop Richard, of John Ryne, into which Robert de Rupe, priest, of the same diocese, unlawfully intruded himself, and which the said Henry, under letters of the present pope by which he, holding a canonry of Cloyne, was expecting a prebend thereof, accepted, but not within the lawful time, had provision thereof made to him, and obtained possession, against which Robert appealed to the apostolic see. The mandate is issued notwithstanding that Henry holds the deanery of Lismore, value not exceeding 16 marks, and, under letters of the present pope, a canonry of Limerick with expectation of a prebend. Upon his obtaining the said canonry and prebend, the above letters under which he accepted, etc., shall be null as regards another canonry and prebend of Cloyne. Vite ac morum. |

To the abbot of Clare (de Forgio) in the diocese of Killaloe and the archdeacon and official of Killaloe. Mandate to collate and assign the still void rectory, with cure, of Killinnubuych, in the said diocese—which became void by reason that Thomas Ochanynd held it for more than a year without having himself ordained priest and without obtaining dispensation—to Cornelius Ochanynd, clerk, of the same diocese, who has been presented by the patron Bernard Obryn, layman, and instituted by bishop Matthew, but doubts whether the collation, etc., holds good. The pope has also this day granted Cornelius dispensation to hold the perpetual vicarage of the said church, provision of which he has by other letters ordered to be made to him. The value of rectory and vicarage does not exceed 16 marks. Vite ac morum. (De mandato.) |

To Master James Steube, papal chaplain and auditor. Mandate to collate and assign the perpetual vicarage of Wictoft in the diocese of Lincoln, value not exceeding 30 marks, to John Hervy, priest, of that diocese, whose recent petition contained that a cause arose lately between him and John Tailor, priest, of the same diocese, about the said vicarage, to which, on its voidance by the death of Philip [Wyden, supplied from f. 312] he was presented by the patron, Jordan, Cistercian abbot of Dore, in the diocese of Hereford, but to which Tailor, taking possession, prevented him from being instituted by John, [now] bishop of Lichfield, then bishop of Lincoln [sic; f. 312 has here simply—John, bishop of Lincoln]; and that the pope at Hervy's instance committed the cause, although not lawfully devolved to the Roman court, to the above auditor, who has proceeded short of a conclusion. As the petition adds, it is asserted that neither he nor Tailor has any right to the vicarage.Vite ac morum. |

To the archdeacon of Kilmore (Tiburnen). Mandate after examination to collate and assign to John Mecbradaych, clerk, of the diocese of Kilmore, the perpetual benefice without cure, called the rectory, in Culbrydyn and Sendamair, in the said diocese. The said benefice, value not exceeding 6 marks, is in no church, and became void by the consecration of bishop Nicholas. John has been presented by the patron Donatus Macbradaich, donsel, to the said bishop, who, being perhaps ignorant of the pope's general reservation of all benefices void by his promotion to cathedral churches, has instituted John, equally ignorant. The mandate is issued notwithstanding that the pope has this day ordered provision to be made to John of the perpetual benefice with cure, called the vicarage, of Culbrydin and Sendamair, value not exceeding 5 marks. To the bishop of Concordia, the prior of Spaldyng and Thomas de la Warre, canon of Lincoln. Mandate, confirming the sentence below, and ordering them to place John Hervy in possession of the perpetual vicarage of Wittofe (sic) in the diocese of Lincoln, removing John Taylor, and to execute these presents as against the latter or any other intruders. Hervy's recent petition contained, &c., as above f. 278d., as far as the pope, at Hervy's instance committed the cause, although, etc. to Master James Steube, papal chaplain and auditor, who at the instance of Hervy, who appeared before him at first in person, and afterwards by his proctor, Master John de Scrivanis, repeatedly cited Taylor. It being then set forth to the pope on Hervy's behalf that some persons asserted that neither he nor Taylor had any right to the vicarage, the pope ordered the auditor (f. 278d.) to collate and assign it to Hervy, which mandate Taylor prevents from taking effect. After this the auditor declared Taylor contumacious, concluding in favour of Hervy, and, notwithstanding the general vacation of the Roman court, cited Taylor by his letters patent posted on the doors of the apostolic palace to hear his definitive sentence, and upon his non-appearance adjudged the vicarage to Hervy, afterwards condemning Taylor in costs, 46 gold florins of the camera. Hervy's petition adds that he doubts whether others may not intrude themselves. Exhibita nobis. |
