Dispensation to him (who was lately dispensed by authority of the ordinary on account of illegitimacy, as the son of a priest and an unmarried woman, to be promoted to minor orders only and hold a benefice without cure), to be promoted to all holy, even priest's orders, and hold any compatible benefices of any number and kind, with and without cure, even if they be canonries and prebends, non-major or non-principal dignities, etc., and to resign them, simply or for exchange, as often as he pleases; notwithstanding the said defect, etc. Vite etc. (P. and Ja. To the abbot of St. Saviour's, Duysky, in the diocese of Ossory. Mandate, as below. The pope has learned that the rectory of the parish church of Balbimartun (recte Ballimartun) in the diocese of Ossory has been so long void, because William Valche, having obtained it by canonical collation, has held possession for more than a year without having himself ordained priest and without dispensation, that by the Lateran statutes its collation has lapsed to the apostolic see, although James Maydul, clerk, has, even after the said lapse, by his own temerity and without any title, unduly detained possession for between five and eight years; and the recent petition of Philip Okerog, canon of Ossory, contained that the fruits etc. of his said canonry and of the prebend of St. Maul's (de Sancta Malla) are so slight that he cannot be maintained etc. therewith, but that if the said rectory were united thereto for his life he could be so maintained, and could study for at least seven years in some university or non-university place, according to Irish custom. (fn. 2) The pope therefore orders the above abbot to summon the said James and others concerned, and if he find the facts to be as stated, to unite the said rectory to the said canonry and prebend, value not exceeding 8 and 10 marks sterling, respectively, for Philip's lifetime only, and as long as he shall hold the latter, removing James and any other unlawful detainer. The pope hereby specially dispenses him to take the fruits etc. of the said canonry and prebend and rectory for seven years whilst so studying, (fn. 3) the daily distributions alone excepted. To all Christ's faithful who shall see the present letters. Relaxation of seven years and seven quarantines of enjoined penance to all who, being truly penitent and having confessed, visit the church of Ossory on the feasts of the Annunciation of St. Mary the Virgin and Corpus Christi, and give alms for the repair of its buildings, manors, ornaments etc. If similar indulgence, in perpetuity or for a certain time not yet elapsed, have been granted by the pope, the present letters shall be null and void. To Thomas Nelson, perpetual vicar of the parish church of Kyrkeby in Kendale in the diocese of York. Grant and decree to him (whom the present pope lately dispensed to receive and retain for life, together with the parish church of Weryngton in the diocese of Coventry and Lichfield, any one other benefice, or without that church any two other benefices, with cure or otherwise incompatible, even if they were parish churches or their perpetual vicarages, or major or principal dignities, etc., and to resign them, simply or for exchange, as often as he pleased; and whose recent petition contained that at the time of the pope's said letters he was holding, not the said church of Weryngton, but the perpetual vicarage of Kyrkeby in Kendale, in the diocese of York, which he still holds, wherefore he fears lest the said letters and dispensation may be reputed invalid), that the said letters and dispensation and their consequences shall hold good from the present date, as if it had been stated therein that he held, not the said church of Weryngton, but the said vicarage.
