To the dean, the sacrist and the official of Clonfert. Mandate, as below. The recent petition of the abbot and convent of St. Mary's de Portu puro, (fn. 2) Clonfert, O.S.A., contained that although they have been wont to collate the perpetual vicarage of the parish church of Lochrach in the diocese of Clonfert, when void, to canons of the said monastery, and although the said vicarage has hitherto been held and governed by the said canons, both bishop Cornelius and the dean, archdeacon and chapter of Clonfert (considering that pope Boniface VIII confirmed the said vicarage to the abbot and convent, and that they had for a very long time been in peaceable possession), in order to obviate any disputes which might arise out of such collation, have decreed and declared that the vicarage belongs to the said monastery and its abbot and convent, and the said bishop, with consent of the said dean and chapter, has granted to them the said vicarage anew, as is said to be more fully contained in a public instrument or authentic letters, sealed with the seals of the said bishop, dean and chapter. At the said petition, which added that although the abbot and convent have from time immemorial been and are in peaceful possession of the collation of the vicarage to a canon of the said monastery, nevertheless, inasmuch as it has been sometimes held by secular clerks, they fear that they may be molested in regard to their right of collation, the pope hereby orders the above three to summon the said bishop and chapter and others concerned, and if they find the said declaration lawful, to approve and confirm it and its consequences, and in that event not to suffer the said abbot and convent to be molested contrary to the same.Sacre religionis. To the archbishop of Cashel. Mandate, as below. The pope has been informed by William Sumr, (fn. 3) a monk of the monastery of St. Mary the Virgin de Vony, O. Cist., in the diocese of Emly, that Denis (Dionisius) alias Doncuon (fn. 4) Ofaulu, abbot of St. Mary's, Horeabbey (de Rupe) of the said order, in the diocese of Cashel, a notorious fornicator, has dilapidated many of the goods of that monastery, and turned them to purposes of fornication and [other] evil purposes, (fn. 5) that through his negligence the said monastery and its buildings have become ruinous, and divine worship therein greatly diminished, and that, indeed, it is to be feared that, unless a remedy be quickly provided, the said monastery will fall into such desolation that divine worship will wholly perish and its buildings fall to the ground. The pope therefore hereby orders the above archbishop, if the said William (who is a priest, has made his profession of the said order, and is illegitimate, being the son of a priest, a monk of the said order and an unmarried woman), will accuse Denis before the above archbishop, to summon Denis and others concerned, and he find the foregoing to be true, to deprive and remove Denis, and in that event, and if he find William fit, to make provision to him of the said monastery, value not exceeding 24 marks sterling. The pope hereby specially dispenses him, so that provision may be made to him thereof, and that he may rule it in spirituals and temporals, notwithstanding the said defect, etc., and also grants that he may be blessed by the above archbishop or by any catholic bishop of William's choice, in communion with the apostolic see.Solicite consideracionis. To John Kynggyswod, a monk of St. Mary's, Stanley in Ardern, O. Cist., in the diocese of Coventry and Lichfield. Dispensation, as below. Pius II dispensed him to receive and retain any benefice with or without cure wont to be held by secular clerks, even if it were a parish church or its perpetual vicarage, or a free chapel or chantry or hospital, or were of lay patronage, and to resign it, simply or for exchange, as often as he pleased, the letters of dispensation stating that he was of noble birth, and that he was a chaplain of William, bishop of Winchester. At his recent petition, containing that he was then, and is now, neither the one nor the other, and that in virtue of the said dispensation he holds a certain perpetual benefice, called an annual service or chantry, at the altar of St. Mary in the parish church of the same Saint (fn. 6) in Marlinggysburg, in the diocese of Salisbury, without cure and value not exceeding 8 marks sterling, the pope hereby dispenses him anew to receive and retain any benefice with or without cure, wont to be held by secular clerks, even if it be a parish church or its perpetual vicarage, a free chapel or chantry or hospital, or be of lay patronage, as above, and to resign it, simply or for exchange, as often as he pleases. To the bishop of Worcester. Mandate, as below. The recent petition of Thomas Twynnyng, a monk of the monastery of SS. Mary and Kenelm, King and Martyr, Winchecumbe, O.S.B., in the diocese of Worcester, contained that in his eighteenth year, after having laudably lived for some time as a professed monk in the said monastery, he threw off the habit, put on secular garments, left the monastery and wandered about as an apostate for about four months, thereby incurring sentence of excommunication, after which, led by repentance, he resumed the habit, returned to his monastery, was received by the abbot, and has since remained therein, and that, whilst under the said sentence, he celebrated masses and other divine offices, not, however, in contempt of the Keys but through ignorance, thereby contracting irregularity. The pope therefore hereby orders the above bishop to absolve the said Thomas from the crime of apostasy and the said sentence of excommunication, enjoin a salutary penance, etc., rehabilitate him, and dispense him on account of irregularity thus contracted. To the bishop of Kilmore, and John Ogoband and John Macubuartayn, canons of Kilmore. Mandate (the pope having been informed by Malachy Osiriden, priest, of the diocese of Kilmore, that Fergal Osiriden, prior of Holy Trinity de Lochwoctir, O. Prem., in the said diocese, is a notorious fornicator, has committed simony, and dilapidated the goods of the said priory, so that unless remedy be quickly taken it will soon be reduced to naught: the pope having also learned that the said Malachy desires to enter and make his profession in the monastery of Holy Trinity de Lochque, of the said order, in the diocese of Elphin), if Malachy will accuse Fergal before them, to summon Fergal and others concerned, and if they find the foregoing to be true, to deprive and remove Fergal, and in that event to receive Malachy, or cause him to be received, as a canon of the said monastery, give him the regular habit, and receive his profession, and thereupon to collate and assign to him the said priory, which is conventual and depends on the said monastery, is wont to be governed by canons thereof, and has cure, value not exceeding 8 marks sterling.
