Mandate, at the recent petition of David Nobil, clerk, of the diocese of Glasgow, M.A. (containing that on the voidance of the perpetual vicarage of the parish church [of] Kirkyntulacht in the said diocese by the death of William de Daugles, Andrew, bishop of Glasgow, made collation and provision thereof to the said David, who in virtue thereof obtained possession, but now doubts whether they hold good), to collate and assign to the said David, who alleges that he is of noble birth, the said vicarage, value not exceeding 12l. sterling; whether it be void as above, or by the death of David Red, or by the resignation of the said William, or in any other way. To the archbishop of Canterbury and the bishops of London and Ely. Mandate, as below. The recent petition of Robert Worth, donsel, of London, contained that although Elizabeth, relict of the late William Venor, also of London, of her own accord contracted marriage with him per verba legitime de presenti, and solemnized it before the church, she afterwards, falsely alleging that she had been forced to do so by fear, (fn. 2) caused him to be brought before George, [now] abbot, then archdeacon, of the monastery of St. Peter's, Westminster, and John Al[c? ]ock, clerk, LL.D., of London, to whom the late Edward, then abbot of the said monastery, had committed the cause, (inasmuch as the cognizance of such causes brought against persons of the district of the said monastery, wherein the said Robert then dwelt, belongs by ancient custom to the abbot); and that after abbot Edward's death she caused the said Robert to be brought, not by papal delegation, before the said George, who, wrongfully proceeding in the cause, by an unjust definitive sentence declared the said marriage null, from which sentence Robert has appealed to the apostolic see. The pope therefore orders the above three to decide what is just, without appeal, causing their decision to be observed by ecclesiastical censure. Humilibus supplicum votis. To the prior of the priory of St. Mary, Ardicaten, the archdeacon of Sodor, and the provost of St. Mundus's, Kilmon, in the diocese of Lismore. Mandate, as below. The recent petition of John Labunnde, layman, of the diocese of Lismore, contained that although the patronage of the parish churches of Kilfenanem and Euorkelan in the said diocese lawfully belonged to his progenitors, whose heir he is, nevertheless, inasmuch as a certain guardian (fn. 3) of one of them, who was then a minor (fn. 4) and lay patron of the said churches, without consulting the said minor, and to his prejudice, gave the patronage of Kilfenauen [sic] to the abbot and convent of Paisley, and that of Euorkelan to the minister and convent of the Trinitarian house or preceptory of Failfurde, in the said diocese, the said abbot, minister and convents unduly detain possession thereof. The pope therefore orders the above three to summon the said abbot, minister and convents, and others concerned, and if they find that the said patronage lawfully belonged to the said progenitors, and that the said donations were null, to restore the said John and his heirs and successors to the said patronage. To the archdeacon of Aghadoe (de Achdeo) in the church of Ardfert, and the priors of St. Michael's, Ballinskelligs (de Rupe), and St. Mary's, Ynysfayleyad, in the diocese of Ardfert. Mandate, as below. The recent petition of Thomas Ogelvvayn, perpetual vicar of the parish church of Cachyrbreslayn alias Inisdasliowog in the diocese of Ardfert, contained that Thady Odey, canon of Ardfert, alleged (after the said Thomas had obtained by collation made by authority of the ordinary the said vicarage, then void by the resignation of Donatus Macneill to Maurice, bishop of Ardfert, and by that bishop admitted by the said authority), that pope Pius II, having been falsely informed by Matthew Ofalue, treasurer of Ardfert, that the said Thomas had committed divers excesses and crimes, then expressed, ordered the said Thady, if he found the foregoing to be true, to deprive and remove Thomas, and to make provision of the vicarage to Matthew; that the said Thady by his unjust sentence deprived Thomas, and made collation and provision of the vicarage, as being thus void, to Matthew, wherefore Thomas has appealed to the apostolic see. (fn. 5) The said petition adding that it is alleged that neither Thomas nor Matthew has any right in or to the said vicarage, the pope hereby orders the above three to proceed in the appeal cause, and decide what is just by the pope's authority, causing their decision to be observed by ecclesiastical censure; and, moreover, if by the result of the suit they find that neither Thomas nor Matthew has such right, to collate and assign the vicarage, value not exceeding 12 marks sterling, to Thomas. To the bishop of Ardfert and Sidon (Cidonien., recte Sidonien.). Mandate, as below. The recent petition of Thomas Harward, citizen of London, contained that a suit arose between him, of the one part, and Nicholas Fouler, layman, of London, and Isabel Elmys of Henly, in the diocese of Lincoln, of the other part, the said Thomas alleging that he had contracted marriage per verba legitime de presenti with the said Isabel, whilst the said John (recte Nicholas) falsely alleged that he, too, had contracted marriage with her etiam per similia verba, that the cause was brought before Thomas Winterborn, auditor of causes of the court of Thomas, archbishop of Canterbury; and that the said Thomas Harward has from certain grievances [expressed], inflicted on him by the said auditor, appealed to the apostolic see. The pope therefore orders the above two bishops to summon Nicholas and Isabel and others concerned, hear both sides, taking cognizance also of the principal matter, and decide what is canonical, without appeal, causing their decision to be observed by ecclesiastical censure. To the abbot of Lindores (de Lundoris) in the diocese of St. Andrews. Grant etc., as below. Pius II, at the petition of James Andree, clerk, of the diocese of St. Andrews, (setting forth that on the voidance of the perpetual vicarage of the parish church of Noutile in the said diocese, by the resignation of David Dissyngton to James, bishop of St. Andrews, and by that bishop admitted by his ordinary authority, the same bishop by the same authority made collation and provision thereof to the said James Andree, who in virtue thereof obtained possession, but doubted whether they held good) granted, under date 3 Non. Feb.anno 6 [1463/4], a mandate to a certain judge, if he found James fit, to collate and assign to him by papal authority the said vicarage, value not exceeding 4 marks of silver. In order that the said grant may not remain without effect, because the said pope died before his letters were drawn up, the pope hereby grants that it shall take effect from the said date, and that the present letters shall suffice as proof thereof; with mandate to the above abbot, if he find James fit, to collate and assign to him the said vicarage. To the official of St. Andrews. Mandate, as below. The recent petition of John Lerment, clerk, of the diocese of St. Andrews, contained that on the voidance during the lifetime of Pius II of a canonry of Orkney and the prebend of St. Olaf (Sancti Olavi) therein by the resignation of Richard Wyly, then collector-general of the papal Camera in Scotland, made to William, bishop of Orkney, and admitted by that bishop by his ordinary authority, the said bishop, perhaps in ignorance of the said pope's general reservation of all void benefices of collectors, made by the same authority collation and provision of the said canonry and prebend to the said John, who was likewise ignorant of the said reservation, and who in virtue thereof obtained possession. The said pope having died without having otherwise disposed of the said canonry and prebend, which therefore remain void and reserved, the pope hereby orders the above official, if he find the said John fit, to collate and assign to him by papal authority the said canonry and prebend, value not exceeding 6l. sterling.
