To the bishop of Cloyne (Clonen.). Mandate, as below. The recent petition of Richard Pursell, clerk, of the diocese of Limerick, contained that under pretext of a collation made to him by papal authority he obtained possession of the precentorship (fn. 2) of Limerick, a non-major dignity, then void in a way of which there was no certain knowledge, and so long void that its collation had [by the Lateran Statutes] lawfully lapsed to the apostolic see, no mention being made that it had cure of souls; and that he has unduly detained possession for about fourteen years. The pope therefore, holding the value of the said precentorship and the last mode of its voidance as being expressed by these presents, and rehabilitating Richard on account of the foregoing, orders the above bishop to collate and assign to him (who was lately dispensed by the said authority, on account of illegitimacy as the son of unmarried parents, to be promoted to all even holy orders and receive and retain the precentorship) the said precentorship, value not exceeding 50 marks sterling. To the prior of St. Mary's, Clontuoskert Omane, in the diocese of Clonfert. Mandate, as below. On the voidance of the archdeaconry of Clonfert, a non-major dignity, by the death of James Ybrogay, pope Pius II ordered provision thereof to be made to Donatus Ohanyn, clerk, of the diocese of Clonfert, by letters in which it was expressed that it has not cure of souls, certain executors (not here expressed) being appointed. And upon its being set forth to the present pope on Donatus's behalf that the said pope Pius died before execution was proceeded to, he gave commission and mandate to the said executors to proceed to execution, as if execution had begun during the lifetime of the said pope. Donatus's recent petition contained that Eugenius Odonallayn, clerk, of the same diocese, alleging that the said letters of pope Pius were surreptitious, and that the archdeaconry was still void by the death of the said James, extorted letters of the present pope [addressed] to Denis Odeayg, (fn. 3) under pretext of which he caused Donatus to be summoned before the said Denis, who, wrongfully proceeding in the cause, promulgated a definitive sentence by which he adjudged the archdeaconry to Eugenius and imposed perpetual silence on Donatus, condemning the latter in the costs, from which sentence Donatus appealed to the apostolic see; and that the pope gave commission to the above prior, if he found that, as Donatus stated, on account of a lawful impediment he had not presented the cause of the appeal within the due time, to hear and determine the said appeal cause and also that of the principal matter. The said petition adding that the said last letters have not yet been presented to the said prior, and that it is alleged that neither Donatus nor Eugenius has a right in or to the archdeaconry, the pope, holding the state of the suit to be expressed by these presents, hereby orders the prior if, after the said letters are presented to him, and the cause in virtue thereof has been lawfully brought before him, he find by the result of the suit that neither Donatus nor Eugenius has such right, and if he find Donatus to be fit, to collate and assign to him (who was lately dispensed by papal authority, on account of illegitimacy as the son of a priest abbot of the order of St. Augustine and an unmarried woman, to be promoted to all even holy orders and hold a benefice with cure) the said archdeaconry, elective and with cure, value not exceeding 16 marks sterling. To the bishop of Meath and the priors of St. Peter's, near Trim and St. John's, Naas, in the dioceses of Meath and Kildare (Daren.). Mandate, as below. The recent petition of Thomas Clinton, a canon of Dublin, contained that formerly, on the voidance of the deanery of Dublin by the death of Philip Norrigis, (fn. 4) the better part of the canons duly elected the said Thomas by way of scrutiny, and published the election, whilst other canons voted for John Alleyn, a canon of the said church, knowing him to be unworthy of holding the deanery; and that although Thomas sought from Michael archbishop of Dublin a decree of the nullity of the election of John and the confirmation of his own, the said archbishop confirmed that of John, and because Thomas refused to acquiesce in the confirmation, excommunicated him and caused him to be publicly proclaimed excommunicate, wherefore Thomas has appealed to the apostolic see, etc. The pope therefore orders the above three to summon John and others concerned, absolve Thomas ad cautelam if and as far as is just, hear both sides, and decide what is just without appeal, causing their decision to be observed by ecclesiastical censure.
