To the priors of St. Mary's, Killagh (de Bello loco), and St. Michael's Mount (de Rupe) in the diocese of Ardfert, and the dean of St. Mary's, Antwerp, in the diocese of Cambrai. Mandate as below. The recent petition of Matthew Ofalylbe (recte Ofalywe), clerk, of the diocese of Ardfert, contained that formerly on the voidance of the treasurership of Ardfert by the deprivation of Remundus Fismoris made by John bishop of Ardfert, that bishop made collation and provision thereof by his ordinary authority to the said Matthew, who in virtue thereof obtained possession and still holds it, but now doubts whether the said collation and provision hold good. The pope therefore orders the above three to collate and assign the said treasurership, a non-major non-elective dignity, with cure from of old, value not exceeding 5 (fn. 2) marks sterling, to Matthew; notwithstanding that provision was lately made to him by authority of the ordinary of a certain parcel of land without cure, called de Kylmichun, (fn. 3) within the bounds of the parish church of Dryssean in the said diocese, wont to be assigned to a secular clerk as the title of a perpetual benefice, value not exceeding 1 mark sterling, and that he at present holds it. To Alvarus, bishop of Silves (Siluen.), resident in the Roman court. Mandate, as below. The recent petition of Thady Macgillacosgli, priest, of the diocese of Clogher, contained that Calixtus III (having been informed by the said Thady that Philip Macthomays, perpetual vicar of the parish church of Achadlurcane (sic) in the said diocese, an open and notorious fornicator, and under sentence of excommunication by authority of the ordinary, had celebrated masses and other divine offices in contempt of the Keys, and taken part therein) ordered the abbot of Lisgabayl in the said diocese (his own name not being expressed) and John Magugyr and Peter Offlannagan, canons of Clogher, if and after Thady accused Philip before them, to summon Philip and others concerned, and if they found the foregoing to be true, to deprive and remove Philip and to make provision of the vicarage to Thady; that Bernard, the present abbot of the said monastery, and the said John, duly proceeding and finding the foregoing to be true, deprived and removed Philip by their definitive sentence, from which Philip appealed to the apostolic see, and made provision to Thady; and that after the present pope had committed the cause of the appeal to Master Sancius Romerus (or Romero), (fn. 5) a papal chaplain and auditor, and afterwards to Master Peter William Rocha, (fn. 6) a canon of Barcelona, a papal notary, resident in the Roman court, the said Thady and Philip, at the intervention of certain common friends, agreed upon an arbitrator, who ordained that Thady should not molest Philip in respect of the said vicarage, but should be bound to deliver to Philip the said letters and any others impetrated by him from the apostolic see in respect of the vicarage, and that Philip should be bound to pay Thady a certain sum of money; that subsequently the present pope (upon its being set forth to him by Thady that Nellanus Maicmathuna (fn. 7) alias Magugyr, rector of the parish church of St. Fergus, Inyscaeyn, in the said diocese, had committed dilapidation and usury and other excesses and crimes, then expressed), ordered John Ogoband, a canon of Kilmore and certain other judges [not here expressed], if and after Thady accused Nellanus before them, to summon Nellanus and others concerned, and if they found the foregoing to be true, to deprive and remove Nellanus, and to make provision of the said rectory to Thady; and that, after the said canon had proceeded (fn. 8) to a citation against Nellanus, at length, by the intervention of certain common friends, Thady (who was of less power and fortune [than Nellanus], and was afraid that harm might befall himself and his brothers on account of the foregoing (fn. 9) ) make a bargain with Nellanus that if Nellanus would pay him, for that time only, 3 marks sterling of the money of that country and a certain parcel of a certain tithe then expressed, he would leave Nellanus in peaceable possession of the rectory, and deliver to him the above letters impetrated by him; and that, after the payment to him alike by the said Philip of a certain sum agreed upon between them and by Nellanus of the said other sum, he duly delivered to Nellanus the said later letters, thereby committing simony, and incurring the sentences of excommunication promulgated therefor. At the petition of the said Thady, who states that he is at the Roman court, and has meanwhile abstained from the celebration of mass, the pope hereby orders the above bishop to absolve him from the said crime and sentences etc., enjoining penance, dispense him on account of irregularity, and rehabilitate him. To the abbot of St. Mary's, Derry (Deren.), the dean of St. Mary's, Antwerp, in the diocese of Cambrai, and John Okearwlan, a canon of Derry. Mandate, at the recent petition of Patrick Maccathmayl, priest, of the diocese of Derry (containing that formerly, on the voidance of the rectory of the parish church of Druymrath in the said diocese by the death of Odo Maccathmayl, the late John bishop of Derry made collation and provision to Patrick by his ordinary authority, in virtue of which Patrick obtained possession of the said church and still holds it, but now doubts whether the said collation and provision hold good) to collate and assign to Patrick the said rectory, with cure and value not exceeding 5 marks sterling. To the bishop of Oviedo (Oueten.), the treasurer of Ardfert, and Donald Macgillapadric, a canon of Limerick. [Mandate, as below.] The recent petition of William Osichayn, priest, of the diocese of Cloyne (Clonen.), contained that on the voidance of the canonically united parish churches of Casteltunmagnel and Maynmarach in the said diocese, of the patronage of laymen, because Cena (sic) Mackairtayg, having obtained them by canonical collation, held possession of them for more than a year without having himself ordained priest and without dispensation, William Magnell, layman, of the said diocese, the patron, presented, even after they had been so long void that their collation had by the Lateran statutes lapsed to the apostolic see, the said William Osichayn to the bishop of Cloyne, (fn. 10) who instituted him, under pretext of which presentation and institution he obtained the said united churches and still detains them. The said presentation and institution being therefore without force, and the said churches being still void as above, the pope, hereby rehabilitating William [etc., orders the above three to collate and assign to him the said churches, value not exceeding 4 marks sterling, after he has duly resigned them]. Mandate—the recent petition of Donald Ofrackeilly, a canon of the Augustinian monastery of St. Martin Siena (Senen.), containing that he cannot with a quiet mind remain therein, and that he desires to migrate to the monastery of St. Mary, Drumllican, of the said order, in the diocese of Kilmore, of which his ancestors (predecessores, ? recte antecessores) were the founders—to so transfer the said Donald, who alleges that he has the licence of his superior, and cause him to be received as a canon of the said monastery of St. Mary.
