Mandate to collate and assign to Donald Mascalay, clerk, of the diocese of Elphin, a canonry of Elphin and the rectory of Termundbearayd (fn. 2) alias Cluaincope in the said diocese, value not exceeding 8 marks sterling, wont to be assigned as the prebend of the said canonry, void by the death of John Macoly; summoning and removing William Offeargayll, clerk, of the diocese of Ardagh, who has without canonical title detained possession of the rectory for more than a year but less than two years. To the abbot of St. Mary's Insule de Inysgadh, in the diocese of Killaloe (Laonien.) and the dean and the chancellor of Killaloe. Mandate (the pope having been informed by Donatus Maccrayth, perpetual vicar of Kylwsynd (recte Kylwfynd) in the diocese of Killaloe, that Cornelius Odeayd alias Oleayn, a canon of Killaloe, after having been ordered by authority of the ordinary and admonished, under pain of deprivation, to reside in person, and to be present at divine offices, as he is bound to do, by reason of his canonry and prebend of Ynyskachy, has in contempt of such monitions and mandates neglected to reside, and has openly committed and incurred perjury, about which perjury he is notoriously defamed; seeing, moreover, that the rectory of the united churches of Occormaic in the said diocese is void by the resignation made to the pope this day of Maurice Higillahanayn (recte Migillahanayn), through Cornelius Macmahona, clerk, of the diocese of Limerick, substituted by the said Donatus, who was appointed Maurice's proctor) if and after Donatus accuses the said Cornelius Odeayd before the above three, to summon him and others concerned, and if they find the foregoing to be true, to deprive and remove him, and in that event to collate and assign the said canonry and prebend, value not exceeding 30 marks sterling, and the said rectory, which is of the patronage of laymen, and has cure wont to be exercised by a perpetual vicar, and whose value does not exceed 12 marks sterling, to Donatus, who is of noble birth, and was lately dispensed by papal authority, on account of illegitimacy as the son of an abbot of the order of St. Augustine and an unmarried woman, to be promoted to all even holy orders and hold a benefice even with cure, after which he had himself so promoted and obtained by canonical collation the said vicarage of Kylwsynd; whether they be so void, or the canonry and prebend be void by the death of Robert Ykeyllyr, clerk, or by the entry into the order of St. Augustine of Rory Maccrahith, and by his profession. or whether the canonry and prebend and rectory be void in any other way, and provided that the patrons of the rectory consent, notwithstanding that he holds the said vicarage, value not exceeding 6 marks sterling. The pope hereby dispenses him to receive the said canonry and prebend and rectory, and to retain them, and together with the rectory the said vicarage, for life, and also three other benefices with or without cure compatible with one another and with the aforesaid benefices, even if canonries and prebends. dignities etc., and to resign such three, simply or for exchange, as often as he pleases, and receive and retain instead three other benefices compatible with one another and with the aforesaid benefices, notwithstanding the said defect etc. Vite etc. (Her. and G. To William (W[ill]ellmo) Omulwardayn alias Brothe, (fn. 1) clerk, of the diocese of Ossory. Grant, as below. Calixtus III (upon being informed by him that Thomas Troy, then a canon of Ossory and prebendary of Achur therein, and open and notorious fornicator, procured the capture of John Thedyan (recte Ohedyan), clerk, of the diocese of Cashel, on his way from the Roman court, thereby incurring the sentences etc. promulgated therefor, and, utterly ignorant of letters, dilapidated etc. and uselessly consumed the goods of his canonry and prebend, to the shame of the clerical order) ordered the archbishop of Cashel and Matthew Ochuck (sic), a canon of Cashel, inasmuch as from fear of Thomas's power William could not safely meet him in the city and diocese of Ossory, to summon Thomas and others concerned, and if they found the foregoing to be true, to deprive and remove Thomas, and in that event to collate and assign the canonry and prebend to William, the said pope by the same letters dispensing him (who had been dispensed by papal authority, on account of illegitimacy as the son of a professed monk of the Cistercian order and an unmarried woman, to be promoted to all even holy orders and hold a benefice even with cure) to receive and retain the said canonry and prebend. William's recent petition to the present pope contained that he caused Thomas to be summoned before the said archbishop, in virtue of the said letters, and that the said archbishop, proceeding lawfully, found that Thomas had perpetrated the foregoing, deprived and removed him, and made collation and provision to William, in virtue of which he obtained and still holds possession; that Thomas appealed to the apostolic see from the said deprivation, removal and collation and provision, after the archbishop's sentence had become a res judicata, because William had in the said letters alleged that he was a clerk of [the diocese of] Cashel, whereas he was of [the diocese of] Ossory, and because the word ‘Cassalliensis’ [sic] had been erased and ‘Ossoriensis’ put [instead] without papal order; and that the present pope committed the cause, at Thomas's instance, to Master Bernard Rouira, a papal chaplain and auditor, who is said to have proceeded, but short of a conclusion. The said petition adding that it has been found that the correction and putting of ‘Ossoriensis' instead (loco) of ‘Cassillensis’ was done by order of Rodrigo, cardinal deacon of St. Nicholas's in Carcere Tulliano, vicechancellor of the Roman church, wherefore Thomas has, for the sake of peace, ceded to the pope this day the said suit and all right belonging to him in and to the said canonry and prebend, and that the pope has admitted the same, the pope, hereby calling up the cause to himself, and extinguishing the suit, hereby wills and grants that the said letters of Calixtus, and the collation and provision and dispensation made to him in virtue thereof etc. shall hold good from the date of these presents, even if the said canonry and prebend, value not exceeding 16 marks sterling, be void as above, or in any other way. Mandate to collate and assign to Richard Bossher, priest, of the diocese of Ferns (who was lately dispensed by papal authority, on account of illegitimacy as the son of a priest and an unmarried woman, to be promoted to all even holy orders and hold a benefice even with cure, after which he was so promoted) a canonry of Ferns and the prebend of Kyllarogy (recte Kyllanogy), with the annexed parish church of Colscriff (recte Colstuff) in the said diocese, value together not exceeding 8 marks sterling, which became void at the apostolic see, and therefore ipso facto reserved, by the promotion made by Calixtus III of John Purcell, [now] bishop, then elect of Ferns, to that church, and by his consecration, administered to him at the said see by order of the said pope, who died without having disposed thereof, so that they still remain void and reserved to the present pope; summoning and removing Maurice Sanyche (? recte Smythe), clerk, of the said diocese, who, as Richard alleges, under pretext of a collation made to him by the ordinary, he having no papal dispensation on account of illegitimacy as the son of a priest and an unmarried woman, and without any other tittle of canonical right, has for more than four years but less than five detained the said canonry and prebend and annexed church, after and contrary to the said reservation, as he still does. To the bishops of Tricarico (Tricaricen.) and Glasgow and the archdeacon of Lothian (Laudonie) in the church of St. Andrews. Mandate as below. The recent petition of James Lyndesaye, precentor (cantor) of Moray, contained that lately, on the voidance of a canonry of the chapel royal of St. Mary at St. Andrews and the prebend of Strabrok therein. of the patronage of the lord of the place of Enrugy in the diocese of Aberdeen. by the death of George de Crethton. Gilbert de Rethe, knight and lord of the said place of Enrugy, the patron, presented the said James to James bishop of St. Andrews within the lawful time. The said petition adding that the said bishop, although requested by James several times (pluries). has unjustly refused to institute him, and the canonry and prebend being still void as above, the pope hereby orders the above three to collate and assign them, value not exceeding 24l. sterling, to James, who alleges that he is by both parents of a great race of barons of the realm of Scotland. Wenzel's ‘An. 4. to. 10.’ There is no contemporary flyleaf, but on the bottom edge of the volume is the usual hardly legible contemporary description: ‘Primus de prebendis vacantibus et de diversis anno iiiio . domini nostri domini Pii pape ii.' There are i–cccx[vi.] ff. of text, the last few of which are injured by waterstains.
