1460. 7 Kal. Sept. (26 Aug.) Siena. (f. 4.) (fn. 2)	To the abbots of Clare (de Forgeo) and St. Mary's, Inisgad, in the diocese of Killaloe, and Cornelius Odeayd, a canon of Killaloe. Mandate to reserve to their gift, for collation to Maurice Ogyllahanan, perpetual vicar of the parish church of Eaglaysandenoyc in the diocese of Killaloe (who was lately dispensed by papal authority, on account of illegitimacy as the son of a priest and an unmarried woman, to be promoted to all even holy orders and hold a benefice even with cure, after which he had himself so promoted and obtained the said vicarage and a certain portion in the secular [and] collegiate church of Yniscathayd in the said diocese) the rectory of the parish churches of Ocormaege in the said diocese, which is of the patronage of laymen and has habitual cure of souls, but not actual, seeing that its cure is exercised by the perpetual vicars of the said churches, (fn. 3) and the value of which does not exceed 12 marks sterling, void by the promotion of Thady Macraych, elect of Killaloe, to that church and by the consecration which is to be administered to him; notwithstanding that he holds the said vicarage and portion, value not exceeding 6 marks and 20s. sterling respectively. He is hereby dispensed to receive the rectory and to retain with it for life the said vicarage, and to resign both, simply or for exchange, as often as he pleases, and hold instead two other parish churches or their perpetual vicarages, notwithstanding the said defect etc. Vite etc. (G. de Piccolominibus. \| xxv. 1460. 6 Id. July. (10 July.) Siena. (f. 61.)	To the bishop of Dunkeld. Mandate, at the petition of John Hudton, a monk of the Cistercian monastery of St. Mary, Cupar (de Cupro), in the diocese of St. Andrews (containing that on its voidance by the death of abbot William Blar, Nicholas V granted it in commendam for life to the late Thomas de Lewingston, a bishop in the universal church [sometime bishop of Dunkeld], who under pretext thereof obtained possession of the rule and administration; and that on the death of the said bishop Thomas and consequent expiration of the said commenda and the renewed voidance of the monastery as aforesaid, the convent duly elected the said John, a professed monk of the order, in priest's orders and of lawful age, who consented; and adding that he doubts whether for certain reasons the election holds good) to confirm the said election of John, if found fit, to the said monastery which, as the pope has learned, is still void as above; and moreover, pro tuitiori cauthela, to make provision to him thereof, net value not exceeding 40l. sterling a year. The above bishop is to cause him to be blessed by any catholic bishop, who after blessing him shall receive from him the usual oath of fealty according to the form enclosed, and shall send the form of oath taken by John as soon as possible to the pope by John's letters patent sealed with John's seal. Mandate to collate and assign to Thomas de Murhede, clerk, of the diocese of Glasgow, a nephew of Andrew bishop of Glasgow and a student at Bologna, (fn. 5) a canonry and the prebend of Casteltaris in Glasgow, value not exceeding 9l. sterling, void by the death without the Roman court of William Walteri; whether it be so void, or be void in any other way. Mandate to collate and assign to Thomas Macgillavanach, a canon of Kilmacduagh (Duacen.) (who was lately dispensed by papal authority, on account of illegitimacy as the son of a priest and an unmarried woman, to be promoted to all holy orders and hold a benefice without cure, (fn. 6) and afterwards, having been made a clerk, to receive and retain a canonry and prebend of Kilmacduagh in the event of their being collated to him in virtue of a papal mandate of provision thereof, they being then void, and who from fear of the power of the below-named William cannot safely meet him in the city and diocese of Kilmacduagh) the rectory of Kyllthomaessy in the diocese of Kilmacduagh, value not exceeding 16 marks sterling, of lay patronage, so long void by the death of Thomas Ohygelayn without the Roman court, that by the Lateran statutes its collation has lapsed to the apostolic see, although William Ocorgrayn, priest, of the diocese of Tuam, who is to be summoned and removed, having been presented by the patron after the said lapse and instituted by authority of the ordinary, has unduly detained possession for several years; whether it be void as above, or by the death of Donald Yhacgnasay, or by the resignation of the said Thomas Ohygelayn or of John Macgillavanach, or in any other way, and notwithstanding the said defect or that he holds a canonry of Kilmacduagh without cure and the prebend commonly called [the prebend] of Cauda therein, their value not exceeding 4 marks sterling, with which he is hereby dispensed to receive and retain the said rectory. Plenary absolution and remission and indulgence, to last during the coming ten years, of all their sins etc., even in cases reserved to the apostolic see, to all penitents who, being truly penitent and having confessed, visit from the first to the second vespers on the feast of the apparition of St. Michael the church of the college of St. Salvator founded by James bishop of St. Andrews in the city of St. Andrews for thirteen masters, scholars studying in theology and certain chaplains, and their servants, and give alms, according to their ability, for the completion of its buildings and ornaments and its fortification in order that it may be safe from the attacks of enemies etc.; with faculty hereby for fit confessors, appointed by the bishop of Dunkeld or his vicar in spirituals and by the provost of the college and two senior masters, to hear the confessions of all such faithful on nine days, namely, the said feast day and the four preceding and following it, and grant them absolution and enjoin penance. All the moneys thus given are to be kept in a box shut with two keys, one kept by the said provost and two masters, the other by the collector of the papal Camera in Scotland, and a third part thereof shall be reserved to the said Camera for the expedition against the Infidels, the other two parts to be applied by the said master and two seniors for the completion of the said buildings, ornaments and fortification etc. Salvator noster Jesus Christus. 5 Id. April. (9 April.) Siena. (f. 309d.)	To the bishops of Brechin and Marsico (Marsicensis) and the prior of St. Andrews. Mandate, as below. The recent petition of Thomas Levingston’, bishop [now] in the universal church, [sometime bishop] of Dunkeld, contained that Nicholas V granted to him in commendam for life the previously reserved parish church of Carnismule alias Kyrkyuir (rectius Kyrkynir) in the diocese of Whiteherne, and that in virtue thereof he obtained possession; that Calixtus III, for certain false reasons suggested to him by Patrick Lo[c]kard, priest, of the diocese of Glasgow, annulled the said commenda, ordered pope Nicholas's letters and the petition from which they had emanated to be cancelled from his registers, removed bishop Thomas from his possession of the said church, and made collation and provision thereof to the said Patrick, certain executors being appointed; that a cause having arisen between bishop Thomas and Patrick about the church, and having lawfully devolved to the Roman court, the said pope Calixtus committed it at bishop Thomas's instance to John Didaci de Coca, a chaplain, then of the said pope, now of the present pope, and auditor of causes of the apostolic palace, and that the said auditor took some proceedings; that the present pope, for certain reasons set forth by James king of Scots, and at his petition, called up to himself the said cause etc. and ordered [above, Reg. Vat. CCCCLXX, f. 398d.] the provost of the collegiate church of St. Salvator in the city of St. Andrews and two others [not here named] to summon Patrick and others concerned, and if they found that the said commenda was revoked for false causes, to annul the said letters extorted from pope Calixtus and the said collation and provision and their consequences, and to order and decree the said letters of Calixtus and the petitions from which they had emanated to be cancelled from the said registers, and moreover to restore the commenda and letters of pope Nicholas granted to bishop Thomas, and their consequences, and also bishop Thomas himself, to the state in which they were before the said letters of Calixtus had been extorted, and also to restore bishop Thomas to possession of the said church, and inhibit Patrick from molesting bishop Thomas, etc. The pope has recently learned that John Achilmere, provost of St. Salvator's, proceeding at the instance of bishop Thomas, has found that the said commenda was revoked for false reasons, and that the statements made on behalf of the said king were true, and has promulgated a definitive sentence on behalf of bishop Thomas and against Patrick, by which he has annulled, ordered and decreed, and restored etc., in accordance with the pope's said mandate, and has condemned Patrick in the costs. At the petition of bishop Thomas, who alleges that the said sentence has become a res judicata, the pope hereby orders the above three, after they have found the foregoing proceedings to have been lawful, to confirm the said senten e and its consequences, extinguish the said suit, impose perpetual silence on Patrick in regard to the said church, and execute the said sentence, causing it to be observed by ecclesiastical censure without appeal.
