To the abbots of St. Finbar's cave (de Antro Sancti Fymbarry) and Tracton (de Albotractu), in the diocese of Cork, and Donald Omongayn, a canon of Cork. Mandate, as below. The pope has learned that the perpetual vicarage of Rynnroyn in the diocese of Cork, of the patronage of laymen, barons, has been so long void (because John Omongayn, when holding the rectory of Cenneith in the same diocese, obtained the said vicarage, by presentation by the patron and institution by authority of the ordinary, and detained it together with the said rectory for more than a month without dispensation, against ‘Execrabilis,’ and still detains it) that by the Lateran statutes its collation has lapsed to the apostolic see; and the pope has moreover been informed by Dermit Onchante [sic], priest, of the said diocese that the said John has dilapidated etc. the goods of the said vicarage, committed simony and neglected to reside and serve in the vicarage, of which and of divers other crimes he is defamed in those parts. The pope therefore orders the above three, if and after Dermit (who was lately dispensed by papal authority, on account of illegitimacy as the son of unmarried parents, (i) to be promoted to all even holy orders and hold a benefice even with cure, (ii) to receive and retain a canonry of Cork and the prebend of Drumdaliag therein, provision of which was ordered to be made to him, and to resign them as often as he pleased, and receive and retain instead a benefice compatible with the aforesaid benefice, after which last dispensation he obtained the said canonry and prebend, but is not now in possession of them) accuses John before them, to summon him, and if they find the foregoing or enough thereof to be true, to remove him, and in that event to collate and assign the said vicarage, value with its annexes not exceeding 12 marks sterling to Dermit. To the chancellor of Killaloe (Lagonien. rectius Laonien.). Mandate (the pope having been informed by Patrick Porcell, rector of Callan in the diocese of Ossory, that John [O’]Hedyhan, archdeacon of Cashel, has committed simony, dilapidated the goods of his archdeaconry and other benefices, publicly kept a concubine and concubines by whom he has had offspring at present living) if and after Patrick, who is by both parents of a noble race of barons and dukes, accuses John before the above chancellor, to summon him, and if he find the foregoing to be true, to deprive and remove him, and in that event to collate and assign the said archdeaconry, a non-major non-elective dignity with cure, value not exceeding 20 marks sterling, to Patrick; whether it become void by such deprivation and removal, or be void by the death of William Radychleff, who claimed to have a right in it, or by the resignation of the said John, or in any other way, and notwithstanding that he holds the said parish church, value not exceeding 40 marks sterling. He is hereby dispensed to receive the archdeaconry, and to retain with it for life the said parish church, or without that church (vel absque ea) any other benefice, or without both of them (seu sine illis) any two benefices, with cure or otherwise incompatible, even if major or principal dignities etc., and to resign them, simply or for exchange, as often as he pleases, provided that he do not hold two parish churches or their perpetual vicarages, or such mixed. To Dermit Occurryn, archdeacon of Leighlin. Collation and provision etc., as below. His recent petition contained that lately, after he had been dispensed by papal authority, on account of illegitimacy as the son of a priest and an unmarried woman, to be promoted to all even holy orders and hold a benefice even with cure, on the archdeaconry of Leighlin, a non-major dignity, becoming void by the death of Donatus Omurhy at the apostolic see, and the rectory of Ymissyl in the diocese of Leighlin, of lay patronage, becoming void by the death of Bernard Ocurry without the Roman court, the bishop of Leighlin made collation and provision to him of the archdeaconry, in virtue whereof he obtained possession, and that under pretext of a presentation by the patrons of the rectory he took possession thereof without any institution and that, without any other dispensation on account of the foregoing and without having himself ordained priest, he has held both together for about eight years, as he still does, against ‘Execrabilis.’ They being therefore still void as above, and so long void that their collation has by the Lateran statutes lapsed to the apostolic see, the pope, specially derogating for this turn only from the said right of patronage, hereby makes collation and provision to him, who is a subdeacon, of the archdeaconry, non-elective and with cure, and value not exceeding 4 marks sterling, and of the rectory, with cure and value not exceeding 6 marks sterling; whether the archdeaconry became void by the death of Donald Olannagayn, and the archdeaconry and rectory became void by the resignations of the said Donatus Omurhy, Bernard [Ocurry] and Donald Olannagayn, or in any other way, and notwithstanding the said defect and that the present pope lately ordered provision to be made to him of a benefice with or without cure wont to be assigned to secular clerks, in the collation etc. of the prioress, commonly called the abbess, and the convent of the Augustinian monastery of St. Mary, Grany, in the diocese of Dublin. The pope further dispenses him to receive and retain for life the said archdeaconry and rectory, or (vel) such benefice with cure. Sedes apostolica, pia mater. |

Mandate to collate and assign to David Miagh, clerk, of Cork, who is of a race of nobles and barons, the archdeaconry of Cork, a non-major dignity, value not exceeding 20 marks sterling, upon the voidance of which by the resignation of John Iwrassall to Jordan bishop of Cork, that bishop made by his ordinary authority collation and provision thereof to the above David, who in virtue thereof obtained and still holds possession, but doubts whether for certain reasons they hold good; notwithstanding etc. The pope hereby dispenses David to receive and retain therewith for life any two, or without it any three benefices with cure or otherwise incompatible, even if dignities etc. or two parish churches or their perpetual vicarages, or such mixed, and to resign them all, simply or for exchange, as often as he pleases, provided that he do not hold more than two parish churches or perpetual vicarages. To the bishops of Aberdeen and Whiteherne and the dean of St. Patroclus's (Sancti Patroch rectius Patrocli), Soest (Susacien.), in the diocese of Cologne. (fn. 3) Mandate, as below. The recent petition of Andrew Lyell, rector of Blar in the diocese of Dunkeld, bachelor in decrees, contained that on the voidance of the parish church of Nelbland (fn. 4) (rectius Newland) in the diocese of Glasgow, of the patronage of laymen, by the promotion made by the present pope of Ninian, [now] bishop of Whiteherne, or by his consecration made by papal authority, or by the lapse of the canonical time for the consecration of bishops, Janet, relict of the patron, James Dugles lord of Daldalketh [sic] in the diocese of Glasgow [sic], in her capacity of usufructuary of a third part of the lands etc. of the said James, her husband, and in accordance with a constitution of Scotland patron for that turn, presented the said Andrew to Andrew bishop of Glasgow, who wrongfully refused to institute him and, on the presentation of James de Dugles, who alleged that he was lord of the said place, instituted Humphrey de Valante, priest, who under pretext thereof intruded himself and has wrongfully detained possession for seven or eight months, from which presentation, institution and intrusion Andrew has appealed to the apostolic see. At the said petition, adding that although Andrew, who is a continual commensal member of the household of James king of Scots, believes that in consequence of the said presentation made to him he has a right in or to the said church, he desires pro pocioris cautele suffragio provision thereof to be made to him by papal authority, the pope hereby orders the above to collate and assign to him the said church, value not exceeding 40l. sterling, inducting him and removing the said Humphrey and any other, etc. He is hereby dispensed to retain for five years with the said church of Nelblandis [sic] his said church of Blar, value not exceeding 24l. sterling, or with one of them one other (unam alteram, rectius unum alterum) benefice, or without both of them any two other benefices, with cure or otherwise incompatible, even if dignities etc., or two parish churches or their perpetual vicarages, or such mixed, and to resign them, simply or for exchange, as often as he pleases.
