4 Calixtus III.

De Regularibus.

1458.
11 Kal. July.
(21 June.)
St. Peter's, Rome.
(f. 92d.)
To Thomas Kirkam, abbot of the Cistercian monastery of St. Mary, Vale Royal (Vallis regallis), in the diocese of Lichfield and Coventry. Grant to him, to whom the pope intends to make this day provision of the church of Sodor in the Isle of Man, (fn. 2) and whose recent petition contained that he could not decently keep up his estate from the slender fruits etc. of the episcopal mensa of Sodor, to retain for life in commendam the said monastery, the value of which the pope holds to be sufficiently expressed hereby, even after the pope has made him provision of the said church and after he has been consecrated etc. Personam tuam. (P. and Jo. Baptista. | P. l. de Varris.) [3 pp. See below, p. 359.]
5 Id. June.
(9 June.)
St. Peter's, Rome.
(f. 105d.)
To the abbots of Lindores and Inchcolm (Insule Sancte [sic] Columbe) in the diocese of St. Andrews. Mandate, as below. The recent petition of David, abbot of the Cistercian monastery of Dere in the diocese of Aberdeen, contained that although provision was made to him of the said monastery on its voidance by the deprivation for his faults and demerits of Nicholas de Fores made, by his ordinary authority, by Thomas, bishop in the universal church, who had special power for the purpose from John abbot of Cîteaux, to whom such deprivation and provision belong, and that although in virtue of the said provision he obtained peaceable possession of the rule and administration, nevertheless William Ernot (rectius Euiot), a monk of Dere, alleging that provision had in virtue of letters of the present pope been made to him of the said monastery as void by the voluntary resignation of the said Nicholas to the pope, prevented David, as he still does, from peaceably exercising the said rule and administration, even after the said William had voluntarily resigned before the said bishop and a notary public and witnesses the said provision and the letters thereof. At the said petition, for the commission of the cause which David intends to bring against William, the pope hereby orders the above two to summon William and others concerned, hear both sides, and decide what is just, causing their decision to be observed by ecclesiastical censure, etc. Humilibus supplicum votis. (P. and A. de Cortesiis. | P. xv. de Varris.) [2 pp. See above, p. 322.]

De Dignitatibus Vacantibus.

6 Non. May.
(2 May.)
St. Peter's, Rome.
(f. 164d.)
To the archbishop of Cashel, Matthew Ochurk, a canon, and of the official of the same. Mandate (the pope having been informed by William Omulroardayn alias Obroche, clerk, of the diocese of Ossory, (fn. 3) that Thomas Archer, dean of Ossory, has laid violent hands on a certain clerk and, being therefore excommunicate, has taken part in divine offices in contempt of the Keys, and that Thomas Troy, a canon of the same church and prebendary of the prebend called [the prebend] of Achur therein, an open and notorious fornicator, has procured the capture of John Yhedyan, clerk, of the diocese of Cashel, when returning from the Roman court, and has incurred the sentences etc. promulgated therefor, and that both of them, ignorant of letters, have dilapidated the goods etc. of their said respective benefices), if and after William (who was lately dispensed by papal authority on account of illegitimacy as the son of a Cistercian monk and an unmarried woman, to be promoted to all even holy orders and hold a benefice even with cure, and who from fear of the power of the said Archer and Troy cannot safely meet them in the city and diocese of Ossory (fn. 4) ) accuses Archer and Troy before the above three, to summon them [and if they find the foregoing to be true] to deprive and remove them from the [said deanery and] canonry and prebend, and in that event to collate and assign the said deanery, which is a major dignity after the pontifical in a collegiate [sic] church, is elective and has cure, and the said canonry and prebend, value not exceeding 40 and 16 marks sterling respectively, to William, whom the pope hereby dispenses to receive them, resign them, simply or for exchange, and receive and retain [two] similar or dissimilar benefices for life, notwithstanding the said defect etc. Vite etc. (P and H. Mashe[i]m. | P. xxxxii. Secundo Non. Julii Anno Quarto. de Varris.) [2½ pp.]
4 Non. July.
(4 July.)
St. Peter's, Rome.
(f. 165d.)
To the abbots of Wotarlamand and Kilcooly (de Aruicampo), in the diocese of Cashel, and Matthew Ocuyrke, a canon of Cashel. Mandate (the pope having been informed by Matthew Ogriffa, perpetual vicar of Disertmalacala in the diocese of Killaloe (Laonien.), bachelor in decrees, that Cornelius Omulruonaid, dean of Cashel, has dilapidated the goods of the deanery and committed perjury) if and after Matthew (who for more than four years in the university of Oxford and for four years in Ireland in a place which is not a university has publicly lectured in the faculty of canon law, and was lately dispensed by papal authority, on account of illegitimacy as the son of a priest and an unmarried woman, first to be promoted to all even holy orders and receive the said vicarage, afterwards to receive the rectory of ecclesiastical fee in the parish church of Dramcleyb (sic) in the said diocese and four compatible benefices, and subsequently a canonry of Limerick and the prebend of St. Munchins therein and the perpetual vicarage of Garr[e] in the diocese of Limerick and any benefices of any number and kind, with and without cure, compatible with the foregoing, even if canonries and prebends, dignities etc., not being major or principal dignities, and to resign them, simply or for exchange, as often as he pleased, after which first dispensation he had himself promoted to all the said orders) accuses Cornelius before the above three, to summon Cornelius, and if they find the foregoing to be true, to deprive and remove him, and in that event to collate and assign the said deanery, a major elective dignity with cure, value not exceeding 24 marks sterling, to Matthew; notwithstanding that he holds the said rectory, which is without cure, and vicarage of Disertmalacala, and that provision was lately ordered to be made to him by papal authority of the said vicarage of Gar[re] and of the said canonry of Limerick and prebend of St. Munchins, value not exceeding 5, 10, 20 and 20 marks sterling respectively. He is hereby dispensed to receive and retain for life, together with the deanery, if it be collated to him, whichever he prefers of the said vicarages of Disert and Garr[e], or without those [benefices] (fn. 5) any two other benefices with cure or otherwise incompatible, even if they be dignities etc., and one of such dignities be major or principal, etc., and to resign such incompatible benefices, simply or for exchange, as often as he pleases, and receive and retain instead two other incompatible benefices, provided that they be not two parish churches or perpetual vicarages or major or principal dignities, etc. Litterarum sciencia, vite etc. (P. and [A. de]Amelia. | P. l. Quarto Id. Julii Anno Quarto. de Varris.) [4 pp. See above, p. 72.]

To Thomas Oseancain (cf. below) alias Scolan, bachelor in decrees. Collation and provision of the archdeaconry of Lismore, a non-major non-elective dignity with cure, value not exceeding 24 marks sterling, void at the apostolic see and therefore ipso facto reserved, by the pope's promotion of John, [now] bishop, then elect, of Ferns to that church, and by his consecration which took place by the pope's order at the said see; whether it be so void, or by the promotion formerly made by papal authority of the late Robert Power to the united churches of Lismore and Waterford and by his consecration without the said see, or by the death of John Rewe or William Mouchel, or the resignation of the late John Keuernock, or in any other way. Litterarum etc.
Concurrent mandate to the bishop of Orvieto and the abbots of Meallanfath and Mothel (Mocalia) in the diocese of Lismore. Hodie dilecto filio Thome Oseanchan (cf. above). (P. and B. de Monte.
