(24 March.)
St. Peter's, Rome.
(f. 10d.)
To all the brethren and sisters in Ireland of the third order of St. Francis called [the order] of Penance. Appointment, grant and indult etc. as below. Their recent petition contained that there are in Ireland many religious houses in which persons of both sexes of their third order of St. Francis dwell under the regular habit and observance of the said order, and in which are religious men in the priesthood and learned in canon law, who could on account of their nearness exercise the visitation of the said persons more conveniently than any one of another order; but that, inasmuch as it is said to be provided in their rule that they shall have as visitor a priest of some (alicuius) approved order, they have been hitherto wont to be visited by other friars of mendicant orders, elected by them for the purpose. The said petition adds that, on account of the distance of places and the dangers of the roads, it is not convenient for them to be visited by friars of other orders, especially seeing that in their said order there are, as stated, friars sufficient and fit etc. to exercise such office of visitation, wherefore they desire to have a visitor of their order. At their said petition (for the appointment as visitor, for this first turn, of Thomas Oruayn, a priest professed of their said order, expert in canon law, the oldest of all the friars of the house of St. Mary de Cillanabrenaynd in the diocese of Tuam, the chief of all their houses in Ireland, in which house he made his profession, with full power to do all things pertaining to the office of visitation, and for the commission to him of the rule and administration etc. of the said house, of which place he is a native (fn. 2); for leave in perpetuity after the death of the said Thomas to elect as their visitor a priest of their own or other order; and for a grant that in future no place given to their order in perpetual alms may be transferred to another order without consent of the ordinary and of the visitor and of themselves) the pope hereby appoints the said Thomas as visitor of all the houses of their said order and of the persons of both sexes dwelling therein; with power to inquire, correct, punish and, if need be, excommunicate, and absolve (provided that the consent of the minister-general of the order of St. Francis be forthcoming), and do and execute other things belonging to the said office; commits to him for life the administration and government of the said house; and makes them grant and indult that they may depute and have, after the death of the said Thomas, as their visitor with the like powers, a fit priest of their choice of their own or other order, and that the places given to them by the faithful cannot without their consent and that of the ordinary be transferred to another order. Dispositione divina. (M. Ferrarii. | l. A. de Hirspaco. A. de Veneriis. [In the margin: Martii. 2 pp. Wadding, Annales Minorum, vol. XII. (Rome, 1735), p. 641, with the mis-reading ‘Cillavanabrenaynd.’]

Vat. CCCCLV, f. 289]. At his recent petition (containing that the said predecessor did not dispense him to retain together two parish churches or their perpetual vicarages, and that the fruits etc. of the said church of Heriettysham are worth more [than he stated], although not more than 55l. sterling, wherefore he fears lest the present pope's said later letters be reputed surreptitious (fn. 4) ) the pope hereby grants and decrees that his said later letters shall hold good, as if etc. Litterarum etc. (M. Footnotes

  • 1. On the back of the volume is the usual modern label, with ‘Calix. iii. Secret. L. vii. A. i. ii. iii. Tom. xxv.’ Inside it is the usual front half of the original sheepskin binding, with the contemporary description ‘Liber primus de anno tercio sanctissimi domini nostri domini Calisti pape iii,’ below which is ‘M. Ferrarii,’ and other unimportant contemporary notes. The ‘Rubricelle,’ slightly more than 20 pp., are headed ‘Secuntur Rubricelle primi libri anni tercii sanctissimi domini nostri domini Calisti divina providentia pape tercii, qui fuit inceptus de fine mensis Aprilis mcccclvii, de bullis registratis apud M.
