Mandate (the pope having been informed by Malachy Omukiayn [sic], a monk of the Cistercian monastery of Abington (de Wothynia) in the diocese of Emly, that Richard Symur, abbot thereof, has committed simony and dilapidated and alienated its possessions and publicly kept a concubine, and is much defamed of these things in those parts) if Malachy (who is priest, and whom the pope hereby absolves from all sentences of excommunication etc., as far only as regards the taking effect of these presents, and dispenses on account of irregularity contracted by celebrating masses etc., and rehabilitates, and who from fear of Richard's power has no hope of obtaining justice in the city and diocese of Emly) accuses Richard before the above abbot, to summon him, and if he find the above to be true, to deprive and remove him, and in that event to make provision to Malachy of the said monastery, value not exceeding 30 marks sterling, and in the event of his doing so, to grant that he may be blessed by any catholic bishop, who shall [thereafter] receive from him the usual oath of fealty according to the from enclosed, and send the said oath to the pope by Malachy's letters patent sealed with the above abbot's (rectius Malachy's) seal (fn. 2). Mandate—the pope having been informed by John Oleathluyr (rectius Oleachluyr), a Friar Preacher of the house of Athy in the diocese of Dublin, that Andrew alias Henry Ocuona, abbot of the Cistercian monastery of Baltinglass (de Vallesalutis) in the diocese of Leighlin, has dilapidated and alienated and uselessly turned to evil uses and consumed its possessions, publicly committed perjury and other enormous crimes, and has laid violent hands on a number of religious, even to the effusion of blood, etc.—if and after John, who has studied theology in the university of Oxford for several years and has been lector thereof in the convent of the said house of Athy, accuses the said Andrew before the above three, to summon him, and if they find the foregoing to be true, to deprive and remove him, and in that event to make provision of the said monastery, value not exceeding 40 marks sterling, to John, and cause him to be blessed by any catholic bishop. After he has been appointed, he shall wear the habit worn in the said monastery and conform to its regular institutes. Mandate—the Augustinian monastery of St. Mary, Cong (de Cunga), in the diocese of Tuam, being void by the death of Theobald de Burgo, although Dermit Odubayd, who behaves as abbot, has, after having been deprived and removed by papal authority from the rule and administration, detained them for about two years, without any canonical title; and the pope having this day ordered the above three to cause Walter de Burgo, archdeacon of Annadown (who was lately dispensed by papal authority, on account of illegitimacy as the son of an archdeacon and an unmarried woman, to be promoted to all, even holy orders and hold a benefice even with cure, and subsequently, after he had obtained by canonical collation the rectory of Gnobeag (fn. 7) in the diocese of Annadown and had been promoted to all the said orders, to receive the said archdeaconry, which is a non-major dignity, provision of which had been made to him, and to retain it and the said rectory together for life) to be received as a canon of the said monastery and to receive his profession, with the requirement that, as soon as he was so received and made his profession etc., he should resign the said archdeaconry and rectory, value not exceeding 8 and 10 marks sterling respectively—to make provision to the said Walter (whom the pope hereby absolves from all sentences of excommunication etc., dispenses on account of irregularity contracted by celebrating masses etc. when under such sentences etc., and rehabilitates, as far only as regards the taking effect of these presents) of the said monastery, value not exceeding 50 marks sterling, summoning and removing the said Dermit; whether it be void as stated, or become void by such deprivation, or be void by the death of Thomas Ydubayd or in any other way. Mandate—the pope having been informed by William Maecyda (sic), priest, of the diocese of Tuam, that Donald, abbot of the Augustinian monastery of St. John the Evangelist, Tuam, has dilapidated and alienated the possessions thereof and, being a notorious concubinary, has uselessly consumed them with a concubine whom he publicly keeps in his house and by whom he has had offspring still alive, and has committed divers other excesses and crimes [not here expressed] about which he is defamed, and has by his neglect allowed the buildings of the monastery to fall to ruin—to cause the said William (whom the pope hereby absolves from all sentences of excommunication etc., as far only as regards the taking effect of these presents) to be received as a canon of the said monastery and to receive his profession, and thereupon, if and after William, who has no hope of obtaining justice in the city and diocese of Tuam, accuses Donald before the above dean, to summon him, and if he find the foregoing to be true, to deprive and remove him, and in that event to make provision of the monastery, value not exceeding 16 marks sterling, to William; notwithstanding that Eugenius IV made provision (fn. 10) to him of a canonry of Kilmacduagh (Duacen.) and another of Killaloe (Laonien.), with reservation of as many prebends and of a dignity etc. of one of them, in virtue of which he accepted and got provision made to him of the archdeaconry of Kilmacduagh, a non-major dignity, of which he is not in possession and about which he is litigating without the Roman court, which archdeaconry, or all right therein or thereto, he is to resign as soon as he has made the said profession etc. The dean is to grant that he may be blessed by any catholic bishop. Eugenius IV ordered the treasurer of Ross to make to Robert Ihuollachain, a Cistercian monk, provision of the Cistercian monastery of St. Mary, Carrigillihy (de Fonte vivo), in the diocese of Ross, on its voidance by the death of abbot Nicholas, dispensing him by the same letters, on account of his illegitimacy as the son of a priest and an unmarried woman, to be promoted to all, even holy orders and hold it. At Robert's recent petition (containing that Donatus Odonauan, archdeacon of Ross and Donald Omonghan, a canon of the same, as commissioners of Dermit Odonauan, treasurer of the said church, made provision to him, in virtue of which he obtained possession of the rule and administration of the monastery, and is still in possession, but has not yet been blessed; and adding that he doubts whether for certain reasons the said provision holds good) the pope hereby (absolving Robert from all sentences of excommunication etc. which he may have incurred, dispensing him on account of irregularity, and rehabilitating him, as far only as regards the taking effect of these presents) orders the above chancellor to make provision to him, who is a priest and has made his profession of the said order, if found fit, of the said monastery, value not exceeding 20 marks sterling, whether it be still void as above, or by the death of Macc[r]obius Ylachnayn, or in any other way, and, in the event of his doing so, to cause him to be blessed by any catholic bishop. Eubel, II, 103.’ The passage in the bull, corresponding to the above ambiguous clause, is as follows: ‘volentes nichilominus et eadem auctoritate decernentes quod tu, de cuius persona etiam hodie ecclesie sancte Ruffine certo modo vacanti providere intendimus, nichilhominus cardinalis remanens et cardinalatus dignitatc retenta, archiepiscopi Cantuarien. dignitate officio nomineque fungaris, ac ipsi Cantuarien. ecclesie quoadvixeris, etiam tali quod ab ea absque expresso consensu tuo absolvi non possis, vinculo censcaris astrictus.…’
