Mandate (the pope having been informed by Henry Ograda, clerk, of [the diocese of] Killaloe, that Thady Ohanrahayn, prior of the Augustinian monastery of Ynyscronayn in the said diocese, has committed wilful perjury, is a public and notorious fornicator, and has dilapidated and alienated and uselessly consumed the possessions of the said priory) to cause the said Henry (who was lately dispensed by authority of the ordinary, notwithstanding his illegitimacy as the son of unmarried parents, to be tonsured and promoted to minor orders, and who in virtue thereof has had himself made a clerk) to be received as a canon of the Augustinian monastery of SS. Peter and Paul, Clare (de Forgio alias de Clar), of the said order and diocese, on which the said priory depends and by whose canons it has been wont to be governed, and to receive his profession; and after he has been so received and has made his profession, if and after he accuses Thady before the above three, to summon Thady, and if they find the above to be true, to deprive and remove him, and in that event to collate and assign the said priory, which is conventual and has cure, the value of which and of its annexes does not exceed 12 marks sterling, to Henry, whom the pope hereby specially dispenses, notwithstanding the said defect, to be promoted to all, even holy orders and receive and retain the priory. Mandate (the pope having been informed by Thomas Macreuayr, rector of Theacdampnata in the diocese of Clogher, that John Ocomalaych, abbot of the Augustinian monastery of SS. Peter and Paul, Armagh, has committed perjury and, a public and notorious fornicator, has dilapidated and alienated and uselessly consumed the possessions, even precious ones, of the monastery and is defamed thereof in those parts) to cause Thomas (who is a priest, and who was lately dispensed by papal authority notwithstanding his illegitimacy as the son of unmarried parents related in the fourth degree of affinity, to be promoted to all, even holy orders and hold a benefice even with cure) to be received as a canon of the said monastery, and to receive his profession; and after he has been so received and has made his profession, if and after he accuses John before the above abbot, to summon John, and if he find the above to be true, to deprive and remove him, and in that event to make provision to Thomas of the said monastery, value not exceeding 20 marks sterling, and cause him to be blessed by any catholic bishop; without prejudice to the archbishop of Armagh, to whom the monastery is by ordinary right subject. To the abbot of St. Mary's, Lisgobail, in the diocese of Clogher, and the dean and Nimeas Macgillacoisgili, canon of Clogher. Mandate, as below. The recent petition of Peter Offlannagan, sacrist of the parish or collegiate church of Devenish (de Daminis) in the diocese of Clogher, contained that formerly, on the voidance of the Augustinian priory of St. Patrick in the said diocese (by the deprivation, in virtue of the provincial statutes of Armagh and synodal statutes of Clogher, of Bernard Magrach (rectius Magrath) [now] a canon of the said order, then prior of the said priory, who had committed simony, was a public and notorious fornicator, and was involved in divers other crimes [not here expressed] of which he was defamed in those parts (fn. 5), and had dilapidated and alienated and uselessly consumed the possessions of the priory) Roger, bishop of Clogher made collation and provision thereof by his ordinary authority to the said Peter, who has not had possession nor taken the fruits. Seeing that, in accordance with the aforesaid (fn. 6), the said collation and provision do not hold good, and that the priory is still void as above, the pope hereby orders the above three to summon Bernard and others concerned, and to cause the said Peter (whom the pope hereby absolves from all sentences of excommunication etc. as far only as regards the taking effect of the presents, who is of a race of dukes, is an expert in canon law, is in about his twenty-fourth year, and was lately dispensed by papal authority, notwithstanding his illegitimacy as the son of a priest and an unmarried woman, to be promoted to all, even holy orders and hold a benefice even with cure, after which he had himself made a clerk) to be received as a canon of the Augustinian monastery of SS. Peter and Paul, Armagh, and to receive his profession, on which monastery the said priory depends, and moreover to collate and assign to him the said priory, which is not conventual nor a dignity nor a personatus, and is not elective, has cure, and whose value does not exceed 24 marks sterling; notwithstanding that he holds the said sacristship, an office with cure, value not exceeding 3 marks sterling, and that the pope lately ordered provision to be made to him of a benefice with or without cure, even if a canonry and prebend, administration or office in a cathedral or a collegiate church, in the collation etc. of the bishop and the dean and chapter etc. of Clogher. He is hereby dispensed, notwithstanding the said defects of age and birth, to receive and retain the priory, and as soon as he has been received as a canon of the said monastery and made his profession, or taken the habit and worn it for three days etc., he is to resign the said sacristship, and the said other letters and their consequences shall be null and void. Mandate, at the recent petition of the abbot and convent of the Augustinian monastery of Navan (de Novana) in the diocese of Meath (containing that although the said monastery, which is notable and famous, was in its primeval foundation sufficiently endowed with fruits, etc. and well built (fn. 8), nevertheless in consequence of wars and fire and other misfortunes with which those parts have long been afflicted, the said fruits etc. have become so few that the proper and wonted number of canons cannot be maintained, nor the abbot attend to the repair of the said buildings and support his other burdens), if the above abbot and canon find the facts to be as stated, to appropriate in perpetuity to the said monastery, value not exceeding 100 marks sterling, the perpetual vicarage of the parish church of Ardbrikan in the said diocese, value not exceeding 20l. sterling, which is not more than two miles distant and whose rectory was lately united to the monastery, so that on the death or resignation of the present vicar the abbot may take possession; the pope further granting indult that the abbot and convent may cause the vicarage to be governed, and the cure of souls of the parishioners exercised, by a secular or regular priest appointed and removed at the pleasure of the abbot. To the bishop of Spoleto, and the archdeacon and the official of Aberdeen (Alberdonen., rectius Abberdonen.). Mandate, as below. The recent petition of Malcolm Brydy, a monk of the Benedictine monastery of St. Thomas the Martyr, Arbroath (de Albrocho, rectius Abbrocho, rectius Ab[er]brotho[c]), in the diocese of St. Andrews, contained that formerly, on the voidance of the priory or administration or vicarage of Fyvy, of the said Order, in the diocese of Aberdeen, by the resignation of John de Sanctoandrea, its prior or vicar, to abbot Richard and the convent of the said monastery, the said abbot and convent in accordance with ancient custom made by their ordinary authority collation and provision to the said Malcolm, who in virtue thereof obtained possession; and adding that he took an oath to the said abbot, upon being required by him, however, to do so, that he would not impetrate a fresh provision nor a confirmation in the matter of the said priory, administration or vicarage from the apostolic see, nor render obedience to the bishop of Aberdeen, the ordinary, for the said priory, wherefore, and for certain other reasons, he doubts whether the said collation and provision hold good. The pope therefore, hereby relaxing the said oaths (fn. 10) and decreeing that Malcolm is not bound to observe them, and restoring him to the state in which he was before them, and absolving him from perjury, orders the above three to collate and assign to him the said priory, which is not conventual, nor a dignity nor a personatus, is not elective, has the cure of souls of the parishioners of Fyvy, depends on the said monastery, and has been wont to be governed by monks thereof, and whose value does not exceed 12l. sterling. To the abbot of Cupar (de Cupro) in the diocese of St. Andrews, and the provost of the church called the chapel royal of St. Andrews (fn. 11). Mandate, as below. The recent petition of Nicholas de Fychkil (cf. below, f. 158d.) and William Bassinden, Augustinian canons of Scone and Inchaffray (Insule Missarum) respectively, in the diocese of St. Andrews and Dunblane, and of John Smert, priest, of the diocese of St. Andrews, contained that on the voidance of the perpetual vicarage of Logy in the said diocese of St. Andrews by the death of Thomas Gardener, abbot [Thomas] and the convent of Scone, to whom by ancient custom belongs the presentation thereto, presented the said Nicholas to the vicar-general in spirituals of the bishop of St. Andrews; that the said vicar-general, in virtue of special power-from the bishop, instituted Nicholas, who in virtue of the said presentation and institution obtained possession, whilst the said William and John afterwards obtained the making to them of provision thereof by letters of the present pope; that a cause arose between them and that the pope, on its devolving to the Roman court by Nicholas's appeal from (et, rectius ‘a’) certain grievances, committed the cause of the appeal and of the principal matter, at Nicholas's instance, to William elect of Oloron, then as now (etiam tunc) holding the place of a papal auditor, who is said to have proceeded short of a conclusion. At the said petition, adding that the cause could be decided at less labour and expense to the said parties in those parts than in the Roman court, and its merits be made clearer there, and that they therefore consent and desire it to be called up and committed there, the pope hereby, with the said consent, calls up the cause to himself, orders the above two to resume it, with the consent of the said parties, hear it further and decide it without appeal, causing their decision to be observed by ecclesiastical censure. To the bishops of Aberdeen and Brechin, and the abbot of Cupar in the diocese of St. Andrews. Mandate, as below. The recent petition of abbot Richard and the convent of the Benedictine monastery of Abbirbrothot (sic) in the diocese of St. Andrews contained that on its being formerly set forth to the present pope that Walter Painter, [now] a monk thereof, proposed to resign the rule and administration, the pope ordered the bishops of Glasgow and Dunkeld to receive and admit his resignation, and to cause the said Richard to be received as a monk of the said monastery and to receive his profession, and thereupon to make provision to him of the monastery, and to reserve and assign to Walter a yearly pension for life on its fruits etc., to be paid by the said Richard and his successors, abbots of the monastery; that afterwards, upon its being set forth to the pope on behalf of Walter that John Araws, archdeacon of Glasgow, sub-delegated by the said bishop of Glasgow, proceeding to execute the said letters, made provision to Richard, and reserved and assigned certain [lands] possessions and goods belonging to the abbatial mensa as a pension for Walter for life, and that, upon its being alleged by some that the bishop of Glasgow had not power to sub-delegate the said archdeacon in the matter of the said pension, and that there was therefore a doubt as to whether the said reservation and assignment and the rest held good, the pope ordered the bishop and prior of St. Andrews, with the ‘quod si nonambo’ clause, if they found the reservation and assignment lawful, to decree that they held good as if the said bishop of Glasgow had had power to sub-delegate the said archdeacon, and that the said Walter might use and enjoy the said lands, possessions and goods for life, under pretext of which letters the said prior, having found the said reservation and assignment lawful, monished and ordered the said abbot [Richard] to pay the said pension under pain of excommunication, and decreed that all the archdeacon's proceedings held good, and that Walter could hold and use and enjoy the said lands, possessions and goods; that, although it was objected by the said abbot Richard and convent before the said prior that the said pension was, as they were ready to prove, so excessive that they could not support it in any wise, and could not be compelled to pay the half of it (fn. 12), but that if another tolerable and reasonable pension were constituted he [abbot Richard] was, in accordance with the first mentioned letters of the pope, ready to pay it, upon the prior unjustly refusing to hear them in the matter, they appealed to the apostolic see, in contempt of which appeal the said prior (not ignorant of it, and although a good part of the time for prosecuting it still remained unexpired) publicly proclaimed excommunicate the said abbot, who did not obey the said monition and mandate and was not bound to do so; that on its being afterwards set forth to the pope on behalf of the said Walter that although in accordance with the foregoing he ought to use and enjoy the said [lands] possessions and goods freely and peaceably for life, abbot Richard prevented him from retaining them and using and enjoying possession of them, and its being added that the letters to be drawn up in regard to the matters thus set forth might be held surreptitious, because no mention had been made in them of the said appeal of abbot Richard and convent, the pope ordered the said bishop of St. Andrews to cause the fruits etc. of the said [lands] possessions and goods to be paid to Walter, and to cause him to enjoy peaceable possession of them in accordance with the pope's prior letters, under certain penalties, notwithstanding abbot Richard's said appeal; as is [all] contained in divers letters of the pope. Seeing that, as the said petition added, the cause of the said appeal has not been called up, and that the said petitions (inasmuch as no mention was made of the excessive pension and the reasonable one, as above, amounting to about a moiety of the fruits of the monastery) have not ceased to be surreptitious (fn. 13), the said abbot and convent (alleging it to be unjust and unreasonable that one monk, however decrepit, should without burden have as many revenues, or almost, as the abbot, who has to bear the burdens of the monastery and monks and other burdens) have petitioned the pope to commit the cause of the said appeal and principal matter to judges in those parts, and order the abbot to be conditionally absolved from the said sentence of excommunication etc., the pope hereby orders the above three to summon Walter and others concerned, and, after receiving from the said abbot a pledge that if they find the said sentence was justly delivered, he will obey their mandates and those of the church, conditionally to grant him the said absolution, and in regard to other matters, hear both sides and decide what is just, without appeal, causing their decision to be observed by ecclesiastical censure. To the abbot of Cupar in the diocese of St. Andrews, and the provost of the church called the chapel royal of St. Andrews (fn. 14). Mandate, as below. The recent petition of Nicholas de Fithkyl (cf. above, f. 116d), an Augustinian canon of Scone in the diocese of St. Andrews, contained that on the voidance of the perpetual vicarage of Logy with its annexes, in the said diocese, by the death of Thomas Gardener, abbot Thomas and the convent of Scone (the presentation belonging by ancient custom to the abbot and convent) presented Nicholas, who is illegitimate, being the son of a priest professed of the said Order and an unmarried woman, for the said vicarage, which was wont to be governed by canons of the said monastery, to James, bishop of St. Andrews, and that John Legate, archdeacon of St. Andrews then vicar-general in spirituals of the said bishop, in virtue of special power therefrom, instituted Nicholas, who had obtained no canonical dispensation on account of the said defect, the institution being thus null and void, and that under pretext of the said presentation and institution he took possession of the vicarage and still detains it, taking the fruits; that a cause arising between him and William Bassynden, an Augustinian canon of Inchaffray (Insule Missarum), and John Smert, priest, of the said diocese, about the said vicarage, which each of the latter two claimed, the pope committed it, at the instance of Nicholas, to William elect of Oloron, then a papal chaplain and auditor, and afterwards, calling it up for certain reasons to himself, gave commission by other letters [above, f. 116d] to the above two to resume and terminate it. At the said petition, adding that the presentation and institution are without force, and that it is alleged by some that also the said William and John have no right in or to the vicarage, the pope, hereby abolishing all disability contracted by Nicholas by reason of the foregoing, and willing him to resign, orders the above two if, as a result of the suit, they find that neither William nor John has such right, to collate and assign the vicarage, value not exceeding 5l. sterling, to Nicholas, whom the pope hereby dispenses to receive and retain it, notwithstanding the said defect etc. Solet sedis apostolice. Mandate, at the recent petition of Eugenius Macmanh[a]m, canon of the monastery of St. John the Evangelist of Arrouaise of the Order of St. Augustine in the city of Tuam (fn. 15) (containing that on account of the slenderness of the fruits of the said monastery, and also because he is not useful or necessary there, and is not a native of the said city, he cannot live or dwell [therein] with a quiet mind and a good conscience, and that he desires to be transferred to the monastery of St. Michael, of the said Order, in the diocese of Tuam, otherwise in the city of Mayo (fn. 16), which abounds in means and revenues, and in which Eugenius, who is a native of that place, can live more conveniently etc.) if they find the facts to be as stated, to transfer Eugenius (whom the pope hereby absolves from all sentences of excommunication etc. as for only as regards the taking effect of these presents) to St. Michael's, and cause him to be received as a canon thereof. To Thomas Obrueyn, canon of Tuam. Mandate, as below. The pope has learned that a canonry of Kilmacduagh (Duacen.) and the prebend without cure (simplex) of Keandmara therein, to which canonry and prebend the rectory of the parish church of Diseart Ceallayd in the diocese of Kilmacduagh was lately, with consent of the patrons and the chapter of Kilmacduagh, united by authority of the ordinary, have been so long void by the death of Nicholas Odugilla that by the Lateran statutes their collation has lapsed to the apostolic see, although David Odonchua, clerk, of the said diocese, who is to be summoned and removed, has, under pretext of a collation made to him by his father as ordinary (fn. 17), after the said lapse, detained possession, without any tittle of right, for about two years (fn. 18). The pope therefore orders the above canon to confirm the said union, if he find that the said patrons and chapter consented, and that it was done for lawful reasons, and to collate and assign the said canonry and prebend and rectory, the value of all not exceeding 6 marks sterling, to Thomas Macgillavanach, clerk, of the said diocese, who lately had himself made a clerk without mention of his illegitimacy as the son of a priest and an unmarried woman, and who from fear of David's power has no hope of obtaining justice in the city and diocese of Kilmacduagh; whether they be void as stated, or by the resignation of David Walsh (Valen(sis)), clerk, or by the deprivation of the said Nicholas made by authority of the ordinary, or by the plurality of his prebends, or by the non-promotion to the priesthood within the lawful time of the said David or of a certain David de Burgo, who was formerly rector of the said rectory before the said union (fn. 19), or whether they be void in any other way; and notwithstanding the said defect, on account of which the pope hereby dispenses him to act as a clerk and be promoted to all, even holy orders and receive and retain the said canonry and prebend. The present pope recently, on learning that a canonry of Ross and the prebend of Logi therein was void by the death of Richard Clepham, granted provision to be made thereof, thus void, to John Donaldi and Richard Cadi, priests, and Robert Cadi, subdeacon, of the dioceses of Dunkeld and Glasgow (fn. 22). Seeing that the said John Donaldi, Richard Cadi and Robert [Cadi], who is an abbreviator of apostolic letters, have this day surrendered to the pope the said grants, the letters about which have not been drawn up, and all right in or to the said canonry and prebend, and that they are in or to the said canonry and prebend, and that they are still void as above, the pope hereby orders the above three to collate and assign to John de Balfour, priest, of the diocese of St. Andrews, M.A., who is by both parents of noble birth, and all of whose benefices and their values and his dispensations the pope hereby holds to be sufficiently expressed by these presents, the said canonry and prebend, value not exceeding 9l. sterling. The recent petition of Cornelius Odo(n)mmayn’ alias Otrraletenayn (sic), perpetual vicar of Disertediyelach (rectius Disert Odryelach) in the diocese of Ardfert, contained that formerly, on the voidance of a canonry of Ardfert and the prebend of Fyenninn therein by the death of John Offla[t]hman, the late Maurice Stach got provision made to him by authority of the ordinary, and John Fitzmuris got provision made to him by papal authority; that afterwards the said Maurice, even after he had possessed them for some time in peace, obtained possession of the deanery of the said church, a major dignity, and the said John, after he had got the said canonry and prebend adjudged to him, obtained possession of the precentorship of the same church, a non-major dignity, to both of which dignities are annexed other canonries and prebends of the said church, the collation being in each case made by papal authority, whereby the said canonry and prebend and all right belonging to the said Maurice and John at the time of their obtaining the said respective dignities have become and are void. The pope therefors orders the above three to collate and assign to the said Cornelius (who was lately dispensed by papal authority, on account of illegitimacy as the son of a priest and an unmarried woman, to be promoted to all, even holy orders and hold a benefice even with cure, after which he obtained the said vicarage, collated to him by papal authority, and has been promoted to the priesthood) the said canonry and prebend, value not exceeding 3 marks sterling; whether they be void [as above or] (fn. 24) by the deaths of the said John Offlathman or the said Maurice (who died at the apostolic see after he had been promoted by the present pope to the said church of Ardfert, and had been consecrated by order of the pope), or by the resignation of one of the aforenamed, or by the said promotion and consecration, or in any other way; and notwithstanding that he holds the said vicarage, value not exceeding 3 marks sterling, and that the pope recently [above, p. 542] ordered provision to be made to him of the [perpetual] vicarage of Kyllkany (sic), value also not exceeding 3 marks sterling, [in the same diocese], then about to become void, and dispensed him to retain both vicarages together for life. Mandate to admit by papal authority the resignation which Maurice Ohuoyn proposes to make of a canonry of Cloyne (Clonen.) and the prebend of Cathiroltan therein, and to collate and assign them, value not exceeding 5 marks sterling, to Nicholas Yscamcain alias Scolan, clerk, of the diocese of Cashel, who lately, without mentioning his illegitimacy as the son of unmarried parents had himself made a clerk. He is hereby specially dispensed to act as a clerk and be promoted to all, even holy orders, and receive and retain the said canonry and prebend and therewith three other benefices with or without cure compatible with one another and with the canonry and prebend, even if canonries and prebends, dignities etc., and to resign all, simply or for exchange, as often as he pleases, and hold instead four other compatible benefices.
