To the priors of Killmorenasynna, Cluaintuasgeartnasynna and Roscoman, in the diocese of Elphin. Mandate (the pope having been informed by Eugenius Obeyrun, clerk, of the diocese of Elphin, that Rory Omochan, canon of Elphin and John Macdiarmada and Malachy Othanaym, perpetual vicars respectively of the parish churches of Killcemnoran and Eachruym in the diocese of Elphin, have each dilapidated, namely, Rory the goods of the rectory of Trebryuyn and Kyncalechyn, assigned by papal authority as a prebend of the said church of Elphin, and formerly belonging to the capitular mensa thereof, and the said John and Malachy the goods of the said vicarages, have each committed simony in the obtaining of the said rectory and vicarages, or otherwise, and each committed perjury, that John and Malachy have often, in contempt of the Keys, celebrated [masses etc.] in presence of persons excommunicate and interdicted by authority of the ordinary, and that Rory has been excommunicated by the same authority and publicly proclaimed excommunicate) if and after the said Eugenius, who is of a race of dukes, accuses the above three before them etc., to summon them, and if they find the above to be true, to deprive and remove them, namely Rory from the said canonry and rectory, and John and Malachy from the said vicarages, and in that event to collate and assign the said canonry and prebend-rectory, without cure, and vicarages, value not exceeding 8, 2 and 3 marks sterling respectively, to Eugenius; whether they become void by such deprivation, or the vicarage of Eachruym be void because Dermit Obeyrun held it without having himself ordained priest, or by the death of Malachy Yanayun, or the vicarage of Killcemnoran be void by the resignation of the same Malachy Yanayun, or whether they be void in any other way. Eugenius (who alleges that the said parish churches are not more than one mile apart, and can be served by one vicar) is hereby dispensed to receive and hold for life the said rectory and vicarages. Mandate (the pope having been informed by Thomas Onurchuan (rectius Omurchuan, as it is also written below), clerk, of the diocese of Killala (Aladen.), that Mulerus Bared, canon of Killala and David Otarpa, perpetual vicar of the parish church of Crosmolina in the said diocese, have committed simony, have dilapidated, namely Mulerus, who is a bigamist, the goods of his canonry of Killala and prebend of Oreablochacon (otherwise called the rectory in the ecclesiastical townland of Oreab in the said diocese) in the said [church] (fn. 2), and David, who is a public fornicator, the goods of the said vicarage) if and after Thomas (who, notwithstanding his illegitimacy as the son of unmarried parents related in the fourth degree of kindred, has been made a clerk, and who, on account of the inordinate favours which Mulerus and David have in the city and diocese of Killala, has no hope of obtaining justice therein), accuses Mulerus and David before the above archbishop etc., to summon them, and if he find the above to be true, to deprive and remove them, and in that event to collate and assign the said canonry and prebend and vicarage, value not exceeding 1½ and 4 marks sterling respectively, to Thomas, if found fit; whether they become void by such deprivation, or the canonry and prebend be void by the death of William Bared or because Thomas Bared, when holding them, entered and made his profession as a canon of the Augustinian monastery or cell of Crosmolina in the said diocese, and the vicarage be void because Eugenius Ocenndubayn held it for more than a year without having himself ordained priest, or whether they be void in any other way. To the abbot of St. Mary's de Petra, Kilmacduagh (Duacen.). Mandate (the pope having been informed by John Odubgilla, scholar, of the diocese of Kilmacduagh, that William Ocorcrain, canon of Kilmacduagh, in obtaining possession of the rectory of Athanry in the diocese of Tuam, made a division and assigned a part of the fruits to another, thereby committing simony, has also committed perjury, and is defamed (fn. 3), and, detaining without any title, but de facto, the third part of the said rectory, has dilapidated the goods moveable and immoveable of the said rectory, of which he has been judicially deprived by apostolic authority) if the said John, after he has been made a clerk, accuses William before the above abbot etc., to summon William, and if he find the above to be true, to deprive and remove him from his canonry of Kilmacduagh and prebend of Kyllenain therein, and in that event to collate and assign them, value not exceeding 20s. of the money current in those parts, to the said John, who is hereby dispensed, notwithstanding his illegitimacy as the son of a priest and an unmarried woman, to be promoted to all, even holy orders and hold them. To Walter Blare, canon of Ross [in Scotland]. M. Collation and provision to him, who is by both parents of noble birth, of a canonry of Ross and the subdiaconal prebend therein, value not exceeding 15l. sterling, which became void, and therefore reserved to the apostolic see (in accordance with Eugenius IV's general reservation of all benefices void by the promotion of their holders to cathedral churches), by the promotion made by the said pope of John, bishop of Caithness (Cathenen.) to that church [below p. 295], and by his consecration, the said pope dying without having disposed of the said canonry and prebend; the collation and provision made thereof by Thomas, bishop of Ross (perhaps in ignorance of the said general reservation) to the said Walter (who, being similarly ignorant, obtained possession under pretext of the said collation and provision, and has held possession for more than a year, but without taking any fruits) being (in accordance with the present pope's continuation of the reservation of all such of the above benefices as had not been disposed of by pope Eugenius at his death) null, and the said canonry and prebend being therefore still void, as above, and reserved; notwithstanding that provision was lately made to him by papal authority of the archdeaconry of Teviotdale (Tevedalie) in the diocese (rectius church) of Glasgow, of which he is not in possession, value not exceeding 30l. sterling, and that the present pope also lately granted to him provision of a canonry of Dunkeld and another of Aberdeen, with reservation of as many prebends and of a dignity etc. of one of them. To Richard Clepham, canon of Moray, bachelor of canon law. Reservation, as below. Lately Eugenius IV granted to Walter Stewart, who was holding a canonry and the prebend of Cardros in Glasgow, a certain other canonry and prebend therein, and ordered certain judges to collate and assign the said canonry and prebend of Cardros, upon their becoming void by Walter's obtaining the said other canonry and prebend, to Robert, [now] elect of Dunblane, then of lower rank (fn. 4), as is contained in letters of the present pope, those of pope Eugenius not having been drawn up before his death. Seeing that the present pope has meanwhile made provision to the said Robert of the said church [below p. 298], wherefore the canonry and prebend of Cardros are still expected to become void by the said obtaining possession [of the said other canonry and prebend by Walter], the pope hereby reserves them, value not exceeding 16l. sterling, to his gift, for collation to the above Richard, who is a priest; notwithstanding that he holds a canonry of Moray and the prebend called the vicarage of Elgyn Centum solidorum therein, the chancellorship of Dunkeld, which is a nonmajor dignity with cure, the value of each of which does not exceed 10l. sterling, and a yearly pension for life of 6l. sterling assigned to him by papal authority on the fruits etc. of a certain canonry and prebend of Glasgow; and that the pope has granted him provision of a canonry of Aberdeen with reservation of a prebend and a dignity etc. therein, and of a benefice with or without cure, even if a canonry and prebend, dignity etc., in the collation etc. of the bishop and the prior and chapter etc. of St. Andrews. Mandate (the pope having been informed by John Pursell, clerk, of the diocese of Limerick, who is by both parents of a great race of nobles, that James de Geraldinis alias Omale, rector of Rathronayn alias Michauir in the said diocese, of the patronage of laymen, has publicly kept a concubine, dilapidated the goods of the said church and converted them to his own uses and those of his said concubine and to other improper uses, and has committed simony and perjury; seeing also, as the pope has learned, that a canonry of Limerick and the prebend of Ardcathne therein have been so long void, by the death of Nicholas Fitz [sic], that by the Lateran statutes their collation has lapsed to the apostolic see) if and after the said John accuses the said James before them etc., to summon James, and if they find the above to be true, to deprive and remove him, and in that event to collate and assign the said rectory, and also the said canonry and prebend (whether void as stated, or by the death of William Russel, or in any other way), value not exceeding 12 and 6 marks sterling respectively, to John; notwithstanding that the present pope recently ordered provision to be made to him of the precentorship of Lismore, which is a non-major dignity with cure, and of a canonry of Cloyne (Clonen.) and the prebend of Kilmedonok therein, value not exceeding 20 and 12 marks sterling respectively, then about to become void. Mandate (the pope having been informed by John Ocronyn, rector of Treyna in the diocese of Cork, that Nicholas Oceallaid, canon of Cork, has dilapidated the goods of his canonry and prebend with cure of Kyllbricayn, publicly kept a concubine, has for many years neglected to reside in the church of Cork or the said prebend and celebrate and serve therein, and by his neglect has allowed a child to die without the sacrament of baptism) if and after the said John (who has for divers years studied canon law) accuses the said Nicholas, who is a priest, before them (seeing that on account of the inordinate favours which Nicholas has in the city and diocese of Cork, John has no hope of obtaining justice therein), to summon Nicholas, and if they find the above to be true, to deprive and remove him, and in that event to collate and assign the said canonry and prebend, value not exceeding 1½ marks sterling, to John; whether they become void by such deprivation, or be void because the said Nicholas held them and the rectory of Cothcull in the diocese of Cloyne (Clonen.) for more than a month against Execrabilis, or be void in any other way; notwithstanding that he holds the said rectory of Treyna, value with its annexes not exceeding 6 marks sterling, which (as he alleges that it is not more than one mile distant from the place of the said prebend) he is hereby dispensed to hold for life with the said canonry and prebend.
