To the bishops of Ely and Norwich and the abbot of St. John's, Colchester, in the diocese of London. Mandate, as below. It was recently set forth to the pope by William Gybbis, rector of Hungate, Norwich, (fn. 3) that the late James Siffe, a citizen of Norwich, a parishioner of the said church, bequeathed to the fabric of the Friars Preachers’ house of St. Dominic, Norwich, 40s. of English money, appointing as his executors Richard Sannys, a priest, and Thomas Freser, a layman, of Norwich, and the said rector; that the said executors paid 30s. to the prior and friars of the said house, and that the remaining 10s. were retained for the said rector for his canonical fourth; that the said prior and friars, claiming payment of the said 10s., brought the executors before divers judges in the court (in audiencia) of John, archbishop of Canterbury, and afterwards before the chancellor of the realm of England; that finally (after the said judges had proceeded, short, however, of a conclusion, and after the said executors had been acquitted (fn. 1) ), Thomas Crosse, a friar of the said order, alleging himself to be the proctor of the said prior and friars, and asserting that by special papal privilege they were exempt from paying the said fourth etc., appealed to the pope; and that the pope committed the appeal and the principal matter to the late Anthony Petri, then a papal chaplain and auditor of causes of the apostolic palace, who pronounced that the said cause had not lapsed to the Roman court, from which decision the said proctor or prior and friars did not appeal within the lawful time, as far at least as the said rector or his proctor has lawful cognisance. (fn. 2) At the said petition, which added that the cause can be dealt with more conveniently and with less expense to the said rector in England (in partibus) than in the said court, the pope hereby calls it up to himself and orders the above three to resume it, hear it further and decide it.
