Mandate, at the recent petition of John Somerton, rector of Lonchelboure in the diocese of Salisbury (containing that after Martin V's reservation to himself and his successors of absolution from sentences of excommunication etc. for simony, he, who is a priest, paid a sum of money to certain laymen on account of his presentation to the said church, thereby committing simony) to absolve him from the said sentences etc., enjoining penance, dispense him on account of irregularity and rehabilitate him. To Henry Rayne, prior of the Augustinian priory of Marton in the diocese of York. Dispensation, at his recent petition, containing that formerly the said conventual priory was able to maintain a prior and sixteen canons, but that on account of wars etc. it is so much improverished that its fruits etc. are not worth more than 100l. sterling a year, with which the prior and the thirteen persons who reside in it cannot be conveniently maintained and its daily burdens be borne) to hold in commendam, as long as he holds the said priory, any benefice with or without cure, secular or regular, even if a parish church etc., of any value, and to resign it, simply or for exchange, as often as he pleases. To the provost of the king's college of St. Mary, Eton by Windsor, in the diocese of Lincoln. Indult, as below. The present pope lately, upon learning that the above college was a resort of penitents, granted, at the petition of Henry, king of England, faculty to the provost and his successors to hear the confessions of all faithful of both sexes, without requiring licence or assent of any, grant absolution, except in cases reserved to the apostolic see, and enjoin penance, with faculty to the said provost and his successors to depute a master, a fellow of the college, to do so in their absence. At the recent petition of the said king (containing that the provost is so much engaged with the rule of the persons and goods of the college that he cannot conveniently attend to the said hearing of confessions, and requesting a faculty for the provost for the time being, as often as seems opportune to him, to depute three or four other fellows, priests, of the said college, to hear the said confessions), the pope hereby grants indult that the provost for the time being may on the feasts of St. Mary the Virgin depute three, or at other times two, fit priests of the said college to hear the said confessions etc., and that such priests may commute the vows of the said faithful, except only vows of pilgrimage to the Holy Land (peregrinationis transmarine) and of visits to SS. To William, abbot of the Benedictine monastery of Bury St. Edmunds, immediately subject to the Roman church, in the diocese of Norwich, salutem etc. Meritis tue devotionis inducimur ut hiis que tue contem platione persone tibi a nobis concessa fuere, ne ex hiis aliqua ambiguitas oriatur, nostre declarationis oraculum ac apostolice (sic) muniminis robur adiiciamus. Dudum siquidem nostre ema[ne]runt littere tenoris subsequentis ‘Nicolaus etc. dilecto filio Wilhelmo abbati monasterii sancti Edemundi de Bury Romane ecclesie immediate subjecti ordinis sancti Benedicti Norwicensis diocesis salutem. Personam tuam nobis et apostolice sedi devotam paterna benivolencia prosequen(tes) etc. Datum Rome apud Sanctum Petrum Anno etc. Millesimo quadringentesimo quadragesimo nono, Kal. Januarii Anno Tercio.' Et istam reperies registratam superius de verbo ad verbum etc. After this very briefly registered letter of 1 Jan. 1449[–50] and indication that it is to be found registered above [viz. p. 57], the present letter continues, with the words ‘Cum autem sicut exhibita nobis nuper pro parte tua peticio continebat,' to relate that, as the above abbot's recent petition contained, he (who is Henry, king of England's proctor in the Roman court, and could not be present in person at the appointment of the aforesaid [i.e. in the above registered letter of 1 Jan. 1450] confessors in the aforesaid realm and principality) has substituted and commissioned a number of other honest and fit men to appoint and choose in his stead the said confessors, and that some doubt whether the said substitution and commission hold good. The pope therefore, at the said petition, approves the said substitution and commission and their consequences, and grants that the said letters shall hold good as if it had been expressed therein that he could make such substitution, etc. Meritis tue devotionis. To the archdeacon of Totnes (Tottonie) [in the church of Exeter]. Mandate, as below. The petition of the prior and convent of the Augustinian monastery of the place of Plympton in the diocese of Exeter contained that from of old there was a dispute between them and the parishioners of the chapel, with cure, of St. Mary at the said place, about burials etc. and especially about the question whether the said chapel (which, as the pope has learned, depends on the parish church of SS. Peter and Paul, Plympton) ought to be deemed and called a chapel with cure or a parish church, and also about the administration of sacramentals, the blessing of palms on Palm Sunday, the making of a procession in the said chapel on that day and on Rogation, Ascension and St. Mark's days, and the repair of the stalls and of the pulpits in the chancel of the chapel, and other articles; (fn. 1) and that at length the parties chose as arbitrators John Cobethorn, dean of Exeter, and Henry Webber, a canon of Exeter, John Rowe, clerk, bachelor of theology and John Fortescu, the king's serjeant-at-law, (fn. 2) layman, of the said diocese, who ordained that the said chapel with cure should in future be subject to the said parish church, and that the peoples of both should be called and deemed parishioners in common, (fn. 3) which arbitration the parties afterwards confirmed, ratified and approved, as is said to be more fully contained in a public instrument. The pope therefore, at the said petition, orders the above archdeacon, if he find the facts to be as stated etc., to confirm the said arbitration etc. and the consequences thereof, etc. Humilibus supplicum votis. Licence, at the petition of the above prior and convent (containing that they have the patronage of a number of benefices with and without cure wont to be governed by secular clerks, and that if they could present three of their canons for as many of such benefices, and have such three benefices governed by them, it would be a relief to the prior and convent, and provision would probably be better made to the said benefices), to present three of their canons to three such benefices, even if parish churches or perpetual vicarages; with licence for the ordinaries to institute, and for the canons thus instituted to govern their benefices. Indult that the confessors of their choice may, after hearing their confessions, grant them, once in life, absolution from all their crimes and excesses, even in cases reserved to the apostolic see, and enjoin penance; and that they may also grant to them once, in the hour of death, being contrite and having confessed, plenary remission of all their sins; that they may absolve them from sentences of excommunication etc., enjoining penance, dispense them on account of irregularity contracted by celebrating mass etc., not in contempt of the Keys, when under such sentences, and rehabilitate them. Lately, as James, king of Scots has intimated to the pope, James, bishop of St. Andrews, at the petition of William de Crechton, temporal lord of the place of Crechton in the diocese of St. Andrews, chancellor of the realm of Scotland, erected, with consent of James de Crechton, knight, son and heir of the said William, and of the prior and chapter of St. Andrews, the parish church of the said place, of the patronage of the said William, into a collegiate church, and instituted therein a provostship, being a principal dignity, eight canonries and prebends for as many canons forming the chapter, and two for two boys, and a perpetual vicarage with the cure of souls of the parishioners; appropriated to the said collegiate church, with the consent of the rector, the parish church of Lochorlbart (rectius Lochorwart) in the said diocese, and instituted in that church a perpetual vicar to exercise the cure of souls; and reserved to the said William and his successors the patronage of the said provostship, canonries and prebends and vicarage, and the presentation to the bishop; whilst the said William endowed the said collegiate church and its fabric and the said provostship, canonries and prebends and vicarage, and augmented the original foundation. At the petition of the said king, the pope hereby orders the above bishop, if he find the facts to be as stated, to approve and confirm by papal authority the said erection, appropriation, reservation etc. Romanus pontifex.
