5 Id. July.
Florence
(f. 197d.)
To the abbots of Lindores (de Lundoris), Camwskeneth (rectius Cambuskeneth), and Balirawtynathe (rectius Balmorynache) in the diocese of St. Andrews. Mandate as below. The recent petition of the abbot and convent of the Benedictine monastery of St. Margaret, Dunfermeline, in the diocese of St. Andrews, and William de Boyis, licentiate in canon law, a monk thereof, contained that about sixty years ago Robert, king of Scotland (considering that the monks of the church of Durham in the conventual priory of the place of Coldinghame in the said diocese, ungratefully forgetful that his predecessors, founders of the said priory, had given it to the said church, had been guilty of plots and betrayals against the said place and its inhabitants, and crimes against the king's majesty, or had aided and abetted the same) expelled the monks who were in the said priory, separated the priory from the said church, deprived the chapter of the said church of the patronage of the priory and transferred it to the said monastery, so that in future the presentation of the prior should belong to the abbot, and his institution to the bishop of St. Andrews; that (after the present pope's reservation of all conventual priories), upon the voidance of the said priory by the death without the Roman court of William Drakys, abbot Andrew and the convent of the said monastery, perhaps ignorant of the said reservation, presented to James, bishop of St. Andrews, the above William de Boyis; and that, upon John de Olles, a monk of the said church [of Durham], alleging that he had been presented to the priory, void as above, by the chapter of the said church to the said bishop and by him instituted, the said William appealed to the apostolic see. Seeing that, in accordance with the aforesaid, the said presentations and the said institution are without force, and that the priory is still void as above; and seeing that, as the said petition added, the said monastery is situate almost in the middle of the realm and therefore has to support hospitality etc., that king James, many of whose progenitors, kings and queens of Scotland, are buried therein, has for it a singular devotion, that the abbots since the said separation have presented, at times of voidance of the said priory, divers of their monks to the bishop of St. Andrews, by whom they have been instituted, and that (for the foregoing reasons and also on account of the fact that the chapter and the citizens of Durham are rebels against the said king) the said king and bishop James, the said abbot and convent, the barons and nobles of the realm and the university of doctors, masters and students of St. Andrews desire the said separation, gift, transfer etc. to have the papal confirmation, the pope hereby orders the above abbots to summon the bishop of Durham, the above chapter [of Durham] and others concerned, to inquire into the above (except only the matter of the said voidance, presentations and institution), and if they find the facts to be as stated, to separate the said priory and its prior and monks and goods etc. from the said church, and from the jurisdiction etc. of the bishop of Durham and the said chapter [of Durham], and to subject them to the said monastery and its abbot and monks, decree that it shall in future be governed only by monks of the said monastery, grant the right of presentation [to the abbot of the said monastery] and that of institution to the said bishop in perpetuity. They are further to summon the said John and others concerned, and hear and decide the said appeal, causing their decision to be observed by ecclesiastical censure, without appeal, and if they find that the said John has no right, are to collate and assign the said priory, with cure and non-elective, value not exceeding 600l. sterling, to the said William de Boyis. They have faculty to publish citations by public edict in public places near the city and diocese of Durham, which shall be binding as if personally served, etc. Sedis apostolice circumspecta benignitas. (B. and Ciprianus. | B. lx. Non Decembris Anno Duodecimo. Valven.) Concurrent letters to the chapter of the church, to the clergy and to the people of the city and diocese, and to the vassals of the church—Apostolatus etc.; to the archbishop of Tuam—Ad cumulum; and to king Henry—Gracie divine. Footnotes

  • 1. On the back of the volume is the modern Latin description: 1442. An. xii. Gregorius (corrected to Eugenius) IV, to which Lib. 161 has been added later. A flyleaf has, in different contemporary hands: Primus de prebendis, de prebendis et dignitatibus vacantibus, prouisionibus prelatorum et plenaria remissione Anno xii domini nostri Eugenii pape iiii and R(ecipe) Marsille. Another flyleaf has the modern: Vid[i pro R.C.A.] Hilb [sic] et Ang. (which occurs in earlier Lateran registers, as noted passim in the footnotes to Cal. Lett. VIII, e.g. p. 664; see also the footnote to Reg. CCCXCVI, below) and Lib(er) clxi, fol(iorum) 287. As the volume actually contains ff. i.—ccciiii (followed by blank ff. cccv–cccxv) it would seem that this latter flyleaf does not belong to it. A similar contemporary description to the above, viz Primus de prebendis ... occurs, as usual, on the bottom edge of the volume.
  • 2. Eubel, Hierarchia, II, p. 209, has, with a reference to the Obligationes, vol. 66, f. 59, 'ob. Thomae. Guilelmus Lindevode (Linwarde) ... 1442 Junii 27.' Obl. 66, f. 59d. has, however, the better spelling 'Lyndewode.' He adds in footnote 'Jam 1436 Sept. 19 illi eccl. vac. per tr. Thomae ad Wigorn. praefectus est in epum. (Obl. 66, 28); sed hae tr. et prom, effectum non habuerunt. The spelling in Obl. 66, f. 28d. is indistinct but is evidently meant for 'Linwode.
  • 3. Eubel, op. cit. II, p. 87: ob. Jo ... Martinus Pinardi, can. ips. eccles. 1442 Sept. 3' from' Obl. 66, 60' which in fact has '... prouidit ecclesie .. ds persona magistri Martini Pinardi eiusdem ecclesie canonici vacanti per obitum quondam Johannis...'
  • 4. Eubel, op. cit. I, p. 64.
  • 5. 'de Ibernia' is added in the margin by An.
  • 6. ydoneitate dilecti filii Mauricii M. canonici monasterii Sancti Angeli de Castellis dicti [i.e. Premonstratensis]ordinis Policastren. dioc. There is perhaps a confusion with the Benedictine abbey of St. Angelo at the place called le Caselle in the diocese of Policastro, of which as a Benedictine abbey there are mentions in the Vatican Archives as early as the time of Urban VI, if not earlier, and as late as the sixteenth century, if not later.
  • 7. Eubel, op. cit. II. p. 88, has under 'Achaden.', ob. Thaddaei a(pud) s(edem) a(postolicam), Cornelius abbas mon. b. Mariae de Brolio [sic] O. Cist. def. nat. patiens, 1449, Oct. 15, from Obl. 72, 38. Obl. 72, f. 38d. has however '... prouidit ecclesie Achaden ... de persona domini Cornelii abbatis monasterii beate Marie de Boolio ordinis Cisterciensis vacanti per obitum quondam Thadei ultimi episcopi etc. dispensando secum super defectu natalium ...' The 'etc.' means not 'apud' but 'extra' Romanam curiam. Gams was at any rate right in placing Blackdon amongst the bishops of Achonry.
  • 8. 'Agneti' is inserted above the line by An.
  • 9. Cf. below, ff. 248, 250d. 267, 271, 281d., 282.
  • 10. Between the usual brief 'Sincere etc.' and 'Datum ... .' there is a caret, to which corresponds in the margin the insertion: Hinc est quod nos vestris devotis supplicationibus inclinali ut liceat vobis et cuilibet vestrum ac Johanni filio vestro habere allare portatile etc. An.
  • 11. homini ad leges.
  • 12. et dilecte in Christo filie eius uxori mulieri Londonien.
  • 13. The amount of the fee, xxv instead of the ordinary xii, indicates a more extensive grant than the mere indult to choose their confessor which the brief 'Benigno etc. Dalum ... 'implies. Cf. f. 228.
  • 14. Between the 'Sincere etc.' and the 'Datum' of the as usual briefly registered indult is a caret, to which corresponds in the margin the insertion, made by the scribe himself: Hinc est quod nos tuis, que ut asseris dilecti filii Johannis Spreuer de Melton Roffen. dioc. hominis ad leges uxor existis, deuotis supplicacionibus inclinati ut liceat tibi habere altare portatile etc., to which the registrator has added his usual 'An.'
  • 15. rectori alterius portionis de S. nuncupate parrochialis eoclesie de W.
  • 16. The order is not here mentioned. Cf. the next indult.
  • 17. This unusual clause presumably refers to the Friday fast.
  • 18. qui ut asseritis, dilecti filii magistri Willelmi Swan, legum doctoris, scriptoris et familiaris nostri, filii existitis...
  • 19. In the date millesimo ... quadragesimo primo, 'primo' is corrected in the margin by 'An.' to 'secundo.'
  • 20. homini ad leges.
  • 21. An' is written inadvertently in the margin by the registrator, Antonius de Adria.
