Mandate to collate and assign to John Odonchua, perpetual vicar of Cleceallid and Bac in the diocese of Kilmacduagh (who is a priest, and who was lately dispensed by papal authority, as the son of a priest and an unmarried woman, to be promoted to all, even holy orders and hold a benefice even with cure, after which he obtained the said vicarage) a canonry of Kilmacduagh and the prebend called Monyncayn therein, and the precentorship thereof, a non-major non-elective dignity with cure, value not exceeding 1 and 2 marks sterling, and void by the deaths of Dermit Ofathe and Dermit Macleynd, respectively; summoning and removing Denis Olyga, priest, of the said diocese, who has unlawfully detained them for more than two years without being sufficiently dispensed as the son of a priest and an unmarried woman; notwithstanding that he holds the said vicarage, value not exceeding 3 marks. He is hereby dispensed, on account of the said defect etc., to receive the said canonry and prebend and precentorship, and to retain the said precentor- ship and vicarage together for life. Mandate to make provision to Maurice Macdonchayd of Ireland, (fn. 5) a canon of the Premonstratensian monastery of St. Angelo de Castellis, in the diocese of Policastro (fn. 6), who asserts that he is the son of unmarried parents related in the double fourth degree of kindred and the fourth and third degrees of affinity, if found fit, of the Premonstratensian monastery of Holy Trinity, Lochque in the diocese of Elphin, immediately subject to the Roman church, value not exceeding 14 marks sterling, void by the death without the Roman court of abbot Ruodricus, and to grant that he may be blessed by any catholic bishop. 5 Id. July. Florence (f. 197d.)	To the abbots of Lindores (de Lundoris), Camwskeneth (rectius Cambuskeneth), and Balirawtynathe (rectius Balmorynache) in the diocese of St. Andrews. Mandate as below. The recent petition of the abbot and convent of the Benedictine monastery of St. Margaret, Dunfermeline, in the diocese of St. Andrews, and William de Boyis, licentiate in canon law, a monk thereof, contained that about sixty years ago Robert, king of Scotland (considering that the monks of the church of Durham in the conventual priory of the place of Coldinghame in the said diocese, ungratefully forgetful that his predecessors, founders of the said priory, had given it to the said church, had been guilty of plots and betrayals against the said place and its inhabitants, and crimes against the king's majesty, or had aided and abetted the same) expelled the monks who were in the said priory, separated the priory from the said church, deprived the chapter of the said church of the patronage of the priory and transferred it to the said monastery, so that in future the presentation of the prior should belong to the abbot, and his institution to the bishop of St. Andrews; that (after the present pope's reservation of all conventual priories), upon the voidance of the said priory by the death without the Roman court of William Drakys, abbot Andrew and the convent of the said monastery, perhaps ignorant of the said reservation, presented to James, bishop of St. Andrews, the above William de Boyis; and that, upon John de Olles, a monk of the said church [of Durham], alleging that he had been presented to the priory, void as above, by the chapter of the said church to the said bishop and by him instituted, the said William appealed to the apostolic see. Seeing that, in accordance with the aforesaid, the said presentations and the said institution are without force, and that the priory is still void as above; and seeing that, as the said petition added, the said monastery is situate almost in the middle of the realm and therefore has to support hospitality etc., that king James, many of whose progenitors, kings and queens of Scotland, are buried therein, has for it a singular devotion, that the abbots since the said separation have presented, at times of voidance of the said priory, divers of their monks to the bishop of St. Andrews, by whom they have been instituted, and that (for the foregoing reasons and also on account of the fact that the chapter and the citizens of Durham are rebels against the said king) the said king and bishop James, the said abbot and convent, the barons and nobles of the realm and the university of doctors, masters and students of St. Andrews desire the said separation, gift, transfer etc. to have the papal confirmation, the pope hereby orders the above abbots to summon the bishop of Durham, the above chapter [of Durham] and others concerned, to inquire into the above (except only the matter of the said voidance, presentations and institution), and if they find the facts to be as stated, to separate the said priory and its prior and monks and goods etc. from the said church, and from the jurisdiction etc. of the bishop of Durham and the said chapter [of Durham], and to subject them to the said monastery and its abbot and monks, decree that it shall in future be governed only by monks of the said monastery, grant the right of presentation [to the abbot of the said monastery] and that of institution to the said bishop in perpetuity. They are further to summon the said John and others concerned, and hear and decide the said appeal, causing their decision to be observed by ecclesiastical censure, without appeal, and if they find that the said John has no right, are to collate and assign the said priory, with cure and non-elective, value not exceeding 600l. sterling, to the said William de Boyis.
