To the archbishop of Canterbury. Mandate to excommunicate John de Breydon, canon of Salisbury, and Thomas Hotofth, rector of Pontragach, in the same diocese, until they restore to liberty John Bonaure, canon of Chichester, and Bernard Viventis, canon of Bazas, and Peter Viventis, nephew of Bernard, John being proctor and Bernard sub-executor of Galhardus, cardinal of St. Lucy's in Silice, to whom provision was made of the prebend and treasurership of Salisbury, void by the death of Walter de Wivill. The archbishop has been already commissioned to cite the said John and Thomas, who, in contempt of the apostolic see, have caused the said proctor and sub-executor to be imprisoned. If these are not released within eight days John and Thomas are to come before the pope to do and receive what justice demands.

The contested election by the chapter of James de Breminham, although confirmed by Malachi, archbishop of Tuam, after William's appeal to the pope, having been examined by Bertrand, bishop of Ostia, and James having died at the Roman Court after his consecration, and William having resigned, the present appointment is made.

Mandate to give to William de Savinhaco the prebendal portion of Bromesyerd, in the diocese of Hereford, which he obtained on its supposed voidance by the consecration of William, bishop of Winchester, who had obtained it uncanonically, under pretext of an unlawful collation made to him by the king on the consecration of John, bishop of Hereford, who previously held it, and by whose consecration it is still void. Mandate to give to Thomas de Trillek, canon of Hereford, the canonry and prebend of Yatton in Wells, void by the death of Robert de Baldok, papal provision of the same having been made by John XXII. first to the said Thomas and then to Alan de Conesbourgh, canon of Lichfield, between whom and Robert de Stra[t]ford, now bishop of Chichester, then holding the said canonry and prebend by collation of the ordinary, there was a suit heard before successive papal auditors. At the time of the provision made to Thomas he was under age, the prebend being a priest-prebend; but as Alan has since resigned his right, Thomas is appointed, notwithstanding that he has the canonry and prebend of Morton Minor in Hereford, the chapel of Imere in the diocese of Salisbury, and the church of Eadburbury in that of Lincoln. Mandate to give to John Bateman called ‘de Vienna,’ canon of Salisbury, the canonry and prebend of Hereford, value 8l. which he, being a clerk of Matilda of Lancaster, countess of Ulster, obtained at the request of her kinswoman queen Philippa, on its voidance by the consecration of William, bishop of Winchester, who had obtained it uncanonically, under pretext of collation made to him by the king on the consecration of John, bishop of Hereford, notwithstanding that Bateman has canonries and prebends of Salisbury and Wilton. Provision of the canonry and prebend of St. Davids, value 4 marks, void by the death of John de Walwayn at the apostolic see, which he has held for five years on collation of the ordinary, notwithstanding that he has a canonry and prebend of Llandaff, value 7l. 15s. 10d. The fruits which he received from St. Davids, in the belief that Walwayn did not die at the apostolic see, and which he has spent in scholastic uses, are remitted. [Cal. Pet. i. 115.]
