Ld. Cornwallis, Privilege, Goldsmith, his Servant arrested.

Upon Oath made at the Bar of this House, by James Fish, "That John Goldsmith, menial Servant to the Lord Cornwallis, a Peer of this Realm, was (on or about the Third Day of this Instant February) arrested, at the Suit of Henry Shugforth, by Phillip Barber Bailiff, employing Rob't Clarke an Attorney, who hath since prosecuted the said John Goldsmith, notwithstanding that the said Henry Shugforth, Phillip Barber, and Robert Clarke, did know the said John Goldsmith to be his Lordship's Servant as aforesaid; all which is done contrary to the Privilege of Parliament:"

Shugforth, Barber, and Clark, to be attached.

It is therefore ORDERED, by the Lords Spiritual and Temporal in Parliament assembled, That the Serjeant at Arms attending this House, or his Deputy, do forthwith attach the Bodies of the said Henry Shugforth, Phillip Barber, and Rob't Clarke, and bring them in safe Custody to the Bar of this House: And this to be a sufficient Warrant on that Behalf.

Sir Robert Carr's Bill.

Hodie 2^a vice lecta est Billa, "An Act for settling the Estate of Sir Rob't Carr Baronet."

Upon the Second Reading of the Bill, intituled, "An Act for settling the Estate of Sir Rob't Carr Baronet, and the Petition of Dame Mary Carr, Wife of Sir Rob't Carr Baronet, on Behalf of herself and her Husband:"

It is ORDERED, by the Lords Spiritual and Temporal assembled in Parliament, That the said Dame Mary Carr, and Sir Rob't Carr the Younger, and all such other Persons who shall then offer themselves as concerned in or by the passing of this Bill, may be heard, at the Bar of this House, on Tuesday next, at Ten of the Clock in the Morning, by their Counsel and Witnesses.

River Avon Bill:

The Lord Bishop of London reported, "That the Committee have considered of the Bill for making the River of Avon navigable, from Christ Church, to the City of New Sarum; and have thought fit to make some Amendments, and added a Proviso thereunto, which are offered to the Consideration of this House."

The said Amendments and Proviso, being read Twice, were Agreed to.

The Question being put, "Whether this Bill shall pass, with the Amendments and Proviso now read?"

It was Resolved in the Affirmative.

Message to H. C. with it.

A Message was sent to the House of Commons, by Sir William Child and Sir Moundeford Brampston:

To deliver them the Bill for making the River of Avon navigable to New Sarum; to which the Lords do agree, with the Amendments and Proviso added, and desire the Concurrence of the House of Commons therein.

and to remind them of the one concerning Streets and Highways.

Also to put them in Mind of a Public Bill formerly sent down, being an additional Bill concerning amending and repairing the Highways and Streets near the Cities of London and Westm. and concerning Hackney Coaches.

Deeping, &c. Fens Bill.

The Lord Lucas reported from the Committee, the Bill concerning Deeping Fenn, with some Amendments. And, upon an Offer of changing the Names of some of the Trustees, it was proposed that the Bill might be re-committed.

But the Amendments were read Twice, and the Bill ordered to be re-committed, for the Purpose aforesaid: And the Committee is appointed to meet this Afternoon at four of the Clock.

ORDERED, That the Lord Eure, and the Lord Ward are added to the Committee for the Bill concerning Pinmakers.

E. Carlisle, Privilege. Coale and Browne released.

Whereas John Coale and John Browne stand committed to the Serjeant at Arms attending this House, for arresting William Lydall, menial Servant to the Earl of Carlile, a Peer of this Realm, contrary to the Privilege of Parliament; this House being informed, by the said Earl of Carlile, "That the said John Coale and John Browne have acknowledged their Offence, submitting themselves unto his Lordship, do humbly beg the Pardon of this House for the same:"

It is ORDERED, by the Lords Spiritual and Temporal assembled in Parliament, That the said John Coale and John Browne be, and are hereby, discharged from their present Restraint, paying their Fees: And this shall be a sufficient Warrant on that Behalf.
