A Message was sent to the House of Commons, by Sir Thomas Bennett and Sir William Glascocke:
To deliver the Bill for supplying the Loss of certain Evidences in the Time of the late Troubles, belonging to the Estate of Richard Lord Byron, and to desire their Concurrence therein.
Earl of Berks Privilege, concerning his Tenants in Charlton, &c. being served with Ejectments.
Whereas it appeared to the House, by the Oaths of John Gastrell and Robert Younge, "That Francis Freeman, James Crabb, Edward Avon, William Tarrant, and Gregory Herbert, have brought, and caused to be brought, several Declarations of Ejectments against the Tenants of the Earl of Berks, in the Manor of Charlton and elsewhere, thereby to eject them out of the Possession of their several Lands which they hold of the said Earl, wherein his Lordship is immediately concerned:"
Freeman, Crabb, Avon, & al. sent for.
It is ORDERED, by the Lords Spiritual and Temporal in Parliament assembled, That the said Freeman, Crabb, Avon, Tarrant, and Herbert, shall appear before the Lords in Parliament on Wednesday the Eighth of this Instant, to answer such Matters as are complained of, for Breach of the Privilege belonging to the said Earl of Berks, a Peer of this Realm; and herein they nor any of them are to fail, as the contrary will be answered to this House.
Withers, L. Byron's Chaplain, Privilege.
Whereas Samuell Withers, a domestic Chaplain to the Lord Byron, being in Custody at Norwich, was charged there with an Action of Debt, at the Suit of Francis Clifford, by his Attornies William Jermine and Robert Becket, and removed by them into the King's Bench, and kept in Custody there, contrary to the Privilege of Parliament:
Jermine and Becket sent for, for arresting him.
It is ORDERED, by the Lords Spiritual and Temporal assembled in Parliament, That the said Jermine and Beckett shall appear before their Lordships on Wednesday the Eighth of this Instant, to shew Cause why the said Withers is kept under Restraint; and that at the same Time he be brought before their Lordships.
Roch admitted in Formâ Pauperis, in Withering's Suit against her.
Upon the Petition of Mary Roche, Defendant in a Writ of Error depending in this House, between her and William Witherings Plaintiff:
It is ORDERED, by the Lords Spiritual and Temporal in Parliament assembled, That the Petitioner is hereby admitted in Formâ Pauperis in this Cause; and that Mr. Serjeant Hyde, Mr. Serjeant Earle, Mr. Baldwin, and Mr. Jones, are assigned for her Counsel, and Mr. Somers for her Attorney.
