Their Lordships, or any Three; to meet this Afternoon, in the Prince's Lodgings, at Three of the Clock.

Militia Bill.

Then the Amendments and Alterations in the Bill concerning the settling the Forces of the Kingdom were read the First Time throughout; and read again in Parts, and debated.

The First Alteration, was the Word ["Lord"] to be added to the Lieutenants; which the House of Commons left out.

And, after Debate, the Question being put, "Whether to adhere to the former Vote, in keeping in the Word ["Lord"]?"

It was Resolved in the Negative.

Then the Lord Treasurer, the Lord Privy Seal, D. Bucks, the Earl of Bristoll, Earl of Anglesey, the Lord Wharton, Lord Holles, and the Lord Ashley, are appointed to draw up Reasons, to be offered to the House of Commons at a Conference, why their Lordships do not adhere to the keeping in the Word ["Lord"].

As to that Alteration which concerns the Lieutenants to give Commissions to Officers; it is referred to the former Committee, to make an Addition, to reserve the King's Right in giving Commissions to Officers.

To the Clause concerning charging of Horse and Arms, and raising of Money:

After Debate, the Question being put, "Whether to agree with the House of Commons in that Part of this Clause, of joining the Deputy Lieutenants with the Lieutenants in the Matter of Charge?"

It was Resolved in the Affirmative.

The Question being put, "Whether this House shall adjourn presently?"

It was Resolved in the Negative.

Concerning that Clause about searching the Houses of Peers for Arms:

After Debate, the Question being put, "Whether to agree to the Alteration brought from the House of Commons, with this Addition, ["or by other Directions from His Majesty, and either Way in the Presence of a Lieutenant or Deputy Lieutenant"]?"

It was Resolved in the Affirmative.

Message from H. C. with a Bill; to remind the Lords of Two;--and for a Conference about the Norwich Stuffs Bill.

A Message was brought from the House of Commons, by Mr. Coventry and others; who brought up a Bill for providing Carriage, by Land and by Water, for the Use of His Majesty's Navy and Ordnance; to which their Lordships Concurrence is desired.

2. To put their Lordships in Mind of expediting the Bill concerning Sheriffs; and the Bill for mending the Common Highways.

3. To desire a Conference, about the Bill for regulating the making of Norwich Stuffs.

The Answer returned was:

Answer.

That as to the Matter of the Conference, their Lordships will send an Answer by Messengers of their own.

Militia Bill.

Next, the Clause concerning the assessing and charging the Peers with Horse and Arms, was considered of.

And the House was adjourned into a Committee during Pleasure, for the better Debate thereof.

The House being resumed;

These Lords following were appointed presently to withdraw, and prepare an Expedient according to the Sense of the Committee upon the Debate, and report the same to this House:

The House was adjourned during Pleasure, while the Committee withdrew.

The House was resumed.

Report was made from the Committee, of a Proviso concerning the assessing and charging the Peers with Horse and Arms; which was read, as followeth:

"Provided always, and be it Enacted, by the Authority aforesaid, That no Peer of this Realm shall be charged with Horses, Horsemen, and Arms, or Foot Soldiers and Arms, otherwise, or in any other Manner, than as is herein after expressed; that is to say, That His Majesty, His Heirs and Successors, shall and may, from Time to Time, issue out Commissions, under the Great Seal of England, to so many Peers, not fewer than Twelve, as His Majesty, His Heirs and Successors, shall think fit, who, or any Five of them, shall have Power from Time to Time to assess all and every or any the Peers of this Realm, according to the Proportions in this Act appointed, for the finding of Horse, Horsemen, and Arms, or Foot Soldiers and Arms, and for other the Purposes in this Act mentioned; which Assessment or Charge so made shall be from Time to Time respectively certified to the respective Lieutenants of each County, to the Intent that the said Charge may be borne according to the Intent of this Act; and that in case there shall be any Default in Performance of any Thing to be done by any Peer by virtue of this Act, that then it shall be lawful for the respective Lieutenants and Deputy Lieutenants, or any Three of them, to cause Distresses to be taken for the same, in any of the Lands of such Defaulters, within their said Counties or Limits respectively; and in case Satisfaction shall not be given within the Space of One Week after such Distress taken, then such Distresses to be sold for the Performance of the said Service, and the Charge incident thereunto; and the Overplus, if any be, to be restored to the Owner."

ORDERED, That this House agrees to this Proviso, nemine contradicente.

Next, was taken into Consideration the Clause concerning the voluntary paying of Ten Pounds in Money, in Lieu of Horse and Arms.

The Question being put, "Whether to agree with the House of Commons, for rejecting of this Clause?"

It was Resolved in the Affirmative.

ORDERED, That the Committee for naturalizing Mark Le Pla do meet To-morrow Morning, at Eight of the Clock.
