PRAYERS.

Bill for confirming Two Acts, and for naturalizing Hyde et al.

It was moved, "To have a Conference with the House of Commons, concerning the Addition made by them to the Bill for confirming of Two Acts; and to give them the Reasons why this House does not agree to the said Addition of the Bill for confirming the naturalizing of Francis Hyde and others."

Which was ordered accordingly.

Message to H.C. for a Conference about it.

A Message was sent to the House of Commons, by Sir Thomas Bennett and Sir Wm. Childe:

To desire a present Conference in the Painted Chamber, touching the Bill for confirming Two Acts therein mentioned.

The Earl of Anglesey and the Lord Ashley were appointed to manage this next Conference.

Highways Bill.

The Earl of Portland reported, "That the Committee have considered of the Bill concerning amending Common Highways, and have made some Alterations, and added certain Provisos;" which are offered to their Lordships Consideration.

The said Amendments and Provisos were read Once; and, after Debate, ordered to be re-committed; and these Particulars especially to be regulated according to the Sense of the House upon the Debate; videlicet,

The Clause of Horses going abreast in a Cart.

The Clause of buying Mens Lands.

The giving an Oath.

The Clause of making Highways to be broader, wherein the County of Cornwall is to be excepted.

And the Clause for making new Highways.

This Committee is appointed to meet this Afternoon.

Message from H.C. with the Bill for Money for Officers who served the King during the late Troubles.

A Message was brought from the House of Commons, by the Lord Bruce and others; who brought up the Bill for Distribution of Threescore Thousand Pounds amongst the truly indigent and loyal Commissioned Officers; to which Bill their Lordships made certain Amendments, and sent the same to the House of Commons, and desired their Concurrence therein: That the House of Commons, taking the said Amendments into their Consideration, do agree to some of them, but do not agree to others; and also the House of Commons have made some new Amendments therein, to which they desire their Lordships Concurrence.

This Bill not brought up according to the Course of Parliament.

This House, conceiving that the bringing up of this Bill thus by Message is contrary to the usual Proceedings of Parliament in Cases of this Nature; Resolved, To send the said Bill to the House of Commons again by Message, with their Lordships Sense upon it.

And the Lord Privy Seal, Earl of Portland, and the Earl of Bristoll, were appointed to draw up what is fit to be sent to the House of Commons upon this Occasion; and to offer the same to this House in the Afternoon.

Le Pla et al. Nat. Bill.

A Message was brought from the House of Commons, by the Lord Gorge and others; who brought up a Bill for the Naturalization of Mark Le Pla and others; to which they desire their Lordships Concurrence.

Answer from H.C.

The Messengers sent to the House of Commons return with this Answer:

That they will give a Conference, as is desired.

Message from thence to sit P.M.

A Message was brought from the House of Commons, by Sir Solomon Swale and others:

To desire that their Lordships will please to sit this Afternoon.

L. Culpeper's Bill.

Hodie 2a et 3a vice lecta est Billa, "An Act for confirming an Act for restoring to Thomas Lord Culpeper, Son and Heir and sole Executor of John Lord Culpeper, Baron of Thorsway, and Master of The Rolls, deceased, all his Honours, Manors, Lands, and Tenements, Leases not determined, and Hereditaments whatsoever, whereof the said John Lord Culpeper was in Possession on the Twentieth Day of May 1642, or at any Time after, which have not been sold or aliened by the said John late Lord Culpeper, by Acts or Assurances to which himself was Party and consenting."

The Question being put, "Whether this Bill shall pass?"

It was Resolved in the Affirmative.

Message from H. C. with Bills;--and for a Conference about the Militia Bill.

A Message was brought from the House of Commons, by Mr. Churchill and others:

To let their Lordships know, that whereas their Lordships did send down divers Bills, with Amendments, the House of Commons do now return the said Bills, having agreed with their Lordships in the said Amendments; videlicet,

1. "An Act concerning the Collection for the Protestants of Piedmont."

2. "An Act for settling a Capital Messuage, or Mansion-house, with the Appurtenances, in Kensington, in the County of Midd. upon Baptist Viscount Campden, and his Heirs."

3. "An Act concerning repairing of Bengworth Bridge."

4. "An Act for confirming of the Estates of several Tenants, Copyholders of the Manors of Rannes, Irchester, and Rushden."

5. "An Act concerning the Tenants of the Honour of Clitheroe."

Also to desire a Conference, concerning the Bill for settling the Forces of this Kingdom.

The Answer returned was:

That this House will give a present Conference, and appoint it to be in the Painted Chamber.

The Lord Privy Seal, Earl of Bridgwater, the Earl of Bristoll, and the Earl of Portland, were appointed to report this Conference.

The Lord Privy Seal reported the Draught of a Message to be sent to the House of Commons, upon Occasion of a Message received from them this Morning, which was read, as followeth:

Message to H. C. to return the Bill for Money for Officers who served the King during the late Troubles, on account of Irregularities in their Proceedings about it.

"Whereas there was a Bill formerly brought up from the House of Commons, intituled, "An Act for Distribution of Three Score Thousand Pounds amongst the truly loyal and indigent Commissioned Officers; and for assessing of Offices, and distributing the Monies thereby raised for their future Supply;" which Bill their Lordships returned with several Amendments and Alterations; and the said Bill was this Day again returned, by a Message from the House of Commons to the Lords, expressing, That the said House doth agree to some of the Amendments made by the Lords; to others, they did not agree: And also signified, that their House had made some other new Amendments, to which they desired their Lordships Concurrence. This their Lordships observing to be against the Course of Parliament, that such Transactions should be returned by Message, which ought to have been by Conference, whereby Reasons might have been given for their Dissent from their Lordships; the Lords, in Consideration thereof, have returned the said Bill, as it was this Day delivered at the Bar, to the End the due Course of Parliament in the transacting of Things of this Nature may be observed."

This being approved of by the House; a Message was sent to the House of Commons, by Sir William Childe and Sir Toby Woolridge, together with the Bill, and their Lordships Sense as aforesaid.

Conference concerning the Militia Bill.

The House was adjourned during Pleasure, and the Lords went to the Conference; which being ended, the House was resumed.

ORDERED, That the Report of this Conference be made on Monday Morning next.

Bill to prevent Stoppages in the Streets of Westminster.

ORDERED, That the Committee for the Bill to prevent the Stoppage of the Streets by Carts shall meet on Monday Morning next, at Nine of the Clock.
